Rochester, Kent: Kayleigh Smee

CONVICTED (2023) | Kayleigh Smee, born c. 1989, of Cambria Avenue, Rochester ME1 3HZ – killed a chihuahua by hurling him 30ft out of third-floor window.

Mother-of-two Smee, who works as a cleaner, threw the eight-year-old dog, called Prince, from the window of a third-storey flat in Rochester. While Prince initially survived the fall, he was too badly injured to be saved.

Jeremy Cave, prosecuting on behalf of the RSPCA, told how Smee and boyfriend Ryan Doe had been out drinking and returned to her flat in Rochester.

A row broke out and Smee claimed her lover was violent and had damaged the door of the flat after she threw him out.

As he stood below her window, Smee began throwing out crockery before throwing out Prince, alleging her lover had often beaten the animal.

Smee initially claimed not to have tossed the canine out of the window, then claimed he may have been thrown out with clothes.

But Mr Cave said none of the eye witnesses saw any clothes on the ground, just the injured dog.

Prince was then taken for treatment by a vet after suffering bleeding and severe spasms but 12 hours later he was put down despite emergency treatment.

Smee pleaded guilty to causing unnecessary suffering to Prince.

John Connor, defending, told the court Smee had been “of good character for about the last decade”, and that her previous offending was not animal related.

He said Smee was in an abusive relationship at the time of the incident and had “an awful lot going on in her life”.

Judge Philip Statman told Smee: “Prince, this much loved little Chihuahua, died the most awful death…which was wholly avoidable.

“This was an ugly incident which happened spontaneously but was not done out of revenge.”

He said some people say the way animals are treated is the hallmark of a civilised society.

The judge told her that she had only pleaded guilty days before the trial was due to begin and said he was not convinced her remorse was genuine.

He said she was “thinking about herself” too much, evidenced by her looking around the courtroom throughout the hearing.

Sentencing | 12-month jail sentence suspended for two years; 200 hours of unpaid work; 30 rehabilitation activity days. Banned from owning or keeping a dog for 10 years (expires July 2033).

Darlington, County Durham: Xanthia Wheeldon

CONVICTED (2022) | Xanthia Jade Wheeldon, born 30 June 1996, of Ashfield Court, Darlington DL3 7TR – threw a hamster out of a window.

Wheeldon pleaded guilty to causing unnecessary suffering to an animal in relation to a Syrian hamster named Snowy.

In a prosecution brought by the RSPCA, it was alleged that she threw the hamster out of a window on or around August 24, 2021.

She was due to go on trial charged with the offence but changed her plea to guilty on the day it was expected to start.

It is not known whether Snowy survived.

Sentencing | fined £250. Banned from owning any animals for five years.

Wavertree, Liverpool: Vasile and Adrian Serban

CONVICTED (2021) | Vasile Serban, born c. 1995, of Bannerman Street, Wavertree, and his brother Adrian Serban, born c. 1989, of Grosvenor Road, Wavertree – stabbed a dog before hurling her to her death from a balcony

The pair, Roma gypsies from Romania, fled the UK in the sickening attack in Toxteth.

They were part of a gang of drunken louts who targeted Mihaela Filip, her son Christian Dutu, and their beloved American bulldog Hindo.

Adrian threw a broken bottle, which hit Ms Filip’s right hand, causing three deep cuts, before four thugs scaled the victims’ balcony.

Hindo tried to protect her owners, but was knifed with a broken bottle by Vasile, then flung onto a parked van in the road below.

Horrifying mobile phone footage filmed by witnesses captured the shocking moment the animal was thrown, then limped away and died.

Mr Dutu was also stabbed in the chest by one thug, then dragged inside his home, where his shirt was ripped and his trousers pulled down.

Meanwhile, Adrian also set upon Ms Filip – pulling her hair and repeatedly punching her – on the evening of April 21, 2018.

The brothers were jailed in their absence, having skipped a trial in September 2019.

Vasile admitted affray and was found guilty after the trial of “destroying property” – criminal damage – namely Hindo. He was jailed for 22 months.

Adrian was found guilty of affray and wounding Ms Filip. He was jailed for three years.

Trimsaran, Carmarthenshire: Daniel Williams

#MostEvil | Daniel Ashleigh Williams, born c. 1989, of Garden Suburbs, Trimsaran, Wales SA17 – threw a pet dog 30 feet out of a window, causing him to suffer serious leg and hip injuries.

Williams threw four-year-old chihuahua/Jack Russell crossbreed Dobbie out of a two-storey high window after breaking into his owner’s flat. The tiny dog fell 30 feet onto the ground below and suffered injuries to his legs and hip.

Williams pleaded guilty to causing criminal damage and a further count of causing unnecessary suffering to a protected animal.

A victim impact statement was read out in court on behalf of Dobbie’s owner Jordanna Davies, which revealed that since the incident, Dobbie had been taken to the vets for an operation on his leg and hip.

Ms Davies had paid immediate emergency vet fees amassing £2,222.21, and was told if she could not raise the funds required, Dobbie would have to be put to sleep.

Dobbie is still to undergo further leg surgery which will cost £3,000, and a hip operation. Until then, he is currently in plaster.

“It caused me great stress and anxiety,” the statement read.

“I don’t feel safe living there anymore after knowing he was able to smash the window and get in. I was settled before the incident took place. I had to live with my window boarded up for a while.

“Dobbie is a small, defenceless pup who would not hurt anyone.”

Williams’ lawyer, Rebecca Carter told the court that her client had “substantial mental health difficulties and suffers from borderline personality disorder, depression and anxiety.”

Sentencing: Jailed for 18 weeks and ordered to pay £1,587.61 compensation to Dobbie’s owner. Banned from keeping animals for two years (expired November 2021).

Wrexham, North Wales: Nathan Kendrick

Habitual criminal Nathan Kendrick, whose 21 previous convictions include common assault, grievous bodily harm and drug dealing, hurled the helpless dog out of a bedroom window in front of his former partner Lucy Lewis and her two children. Miraculously the dog was uninjured.

Kendrick had been in an “on/off” relationship with Ms Lewis which she broke off two weeks before the incident.

When she went to collect her son from a nearby playing field, Kendrick followed them home and took the dog off the lead and said he was “going to hang the dog on Gwersyllt railway station”.

When she rang Kendrick later he told her it was “dead”.

She went round to his house and watched as Kendrick threw the dog from the bedroom window.

He then came out of his property and attacked Ms Lewis, almost pushing her in front of an oncoming vehicle.

In January 2019 Kendrick received an 18-week sentence for the attack on Ms Lewis and a further 18 weeks to run concurrently for causing unnecessary suffering to an animal.

Kendrick’s barrister, Matthew Curtis, argued that his client had been treated harshly and a community sentence would have been more appropriate.

Curtis said: “There were a number of pushes on his former partner, but this was of lower culpability and the starting point is a medium-level community order,” said Mr Curtis

However, the judge said the custodial sentence reflected that Ms Lewis had been targeted and was in fear of suffering serious injury, adding that it was “more in luck that the dog was not maimed or killed”.

He described Kendrick as “controlling” and said that his “antecedents show a worrying lack of control and threatening behaviour and violence.”

Sentencing | 18 weeks in jail for the animal cruelty offence to be served concurrently with an 18-week sentence for attacking the woman.

Wallasey, Merseyside: Kelly Smyth

CONVICTED (2018) | Kelly Smyth, born c.  1978, of Poulton Road, Wallasey CH44 – killed her pet lizard by throwing it from a first- floor window towards police officers

Smyth was found guilty in her absence of two animal cruelty offences at Wirral Magistrates Court in relation to the death of the native Australian lizard, known as a blue-tongued skink.

The court heard how Merseyside Police had attended her first floor flat on June 25, 2018.

When they arrived Smyth told them she no longer wanted her pet dog and they were concerned she would harm him, so they led the pet away to their van.

As they took the dog outside, officers said they saw Smyth at her first floor window and heard what they described as a “loud slapping noise.”

They went to the area where the noise came from and found the skink frothing at the mouth and dying on the pavement.

Officers took the seriously injured reptile to a nearby veterinary practice but he had died on arrival and the police referred the case to the RSPCA.

RSPCA inspector Anthony Joynes, who investigated the case, said: “A post mortem revealed this poor skink had suffered a multitude of injuries after being thrown from the window including a broken back, haemorrhage to the brain and blood on the lungs.

“From the point of impact it took minutes to die and must have suffered terribly. It is awful that this pet was left to die in agony on the cold, dark concrete of a pavement for no reason.

“The RSPCA take all cruelty cases involving all animals very seriously and we treat this act involving a small reptile the same as if it was a cat or a dog – as the pain and suffering would be the same.

“This case also acts as a reminder that exotic animals need specialist care and many people are unaware of how much of a commitment these animals are when they take them on as pets.”

Sentencing:
Smyth was also given a 12-month community order, a fine of £50, and ordered to pay £150 costs and a £85 victim surcharge. Banned from keeping animals for just three years (expired October 2021).

Paisley, Renfrewshire: Alexander Arrol

CONVICTED (2017) | Alexander David Arrol, born  23/06/1986, of Waverley Road, Paisley, Renfrewshire – threw a Jack Russell terrier named Max from the window of a second-floor flat, causing him to have a leg amputated

The court heard that Arrol had been asked to leave a party a short time before launching his callous attack on the helpless dog. Max was taken for treatment to a local vet where he was found to have head trauma and wasn’t able to support weight on his right hind leg. The leg later had to be amputated.

Arrol pleaded guilty to causing the dog unnecessary suffering, in breach of the Animal Health and Welfare (Scotland) Act 2006, by throwing him through the window to his severe injury on February 27, 2017.

He also admitted a charge of culpably and recklessly breaking the window and throwing a television set and other unspecified items onto the street below.

Arrol’s lawyer told the court that his client – a career criminal with 55 previous convictions  – suffered from anxiety and depression.

Sentence: Arrol was jailed for 10 months for the offences, reduced from a year as he admitted his guilt.

Melton Mowbray, Leicestershire: Wayne Keightley

CONVICTED (2016) | Wayne Keightley, born 5 July 1974, of Rutland Street, Melton Mowbray LE13 1QR – threw a nine-week-old puppy from the window of his third-floor flat

In a prosecution brought by the RSPCA, habitual cocaine user Keightley was found guilty of causing unnecessary suffering to the 9-week-old Staffy named Gypsy after throwing her from the window of his third-floor flat. The distressed puppy suffered injuries to her face, leg and abdomen in the 20-foot fall but has since recovered.

The court heard how Keightley smashed the window with a vase, threw Gypsy out the window and then jumped out himself minutes later. Sadly he survived with just a fracture to his ankle. He was found on the floor outside in a “rambling” state dragging himself away from the property.

The court heard he told paramedics he had taken a line of cocaine “a couple of hours” before the incident and had also drunk three cans of lager on the same day.

He told the court seven men entered his property to steal watches and were stabbing him in the hands with a pole with a spear-head attached whenever he tried to pick up the frightened puppy. This was not accepted by the court.

As well as having Gypsy confiscated, Keightley is banned from keeping pets of all kinds for the next three years.

He received a 10-week sentence for the offence against Gypsy and a further four-week sentence because he had been subject to a suspended sentence for possessing a knife at the time of this offence.

He spent half of his 14-week sentence in custody and the second half out on licence.

RSPCA inspector Andy Bostock, who investigated, said: “When Gypsy was found on the floor, she was obviously in pain and was very distressed.

“She was immediately taken to a vet and was treated for injuries to her face, leg and abdomen. She is a very, very lucky dog to have not been more seriously injured, considering also how young and delicate she was at nine-weeks-old.

“There is absolutely no excuse to throw an animal out of a window like this – Gypsy would have been terrified and in pain from the various injuries she received. She got off lightly and is now thriving in her foster home.”

Sentence: 10-week prison sentence for animal cruelty (a further four weeks for knife possession); banned from keeping any animal for three, yes THREE, years (expired September 2019).

Castle Donington, Leicestershire: Sean Wilkinson

CONVICTED (2015) | Sean Luke Wilkinson, born 01/02/1984, formerly of Silver Street, Barrow upon Humber, and as of December 2017 living at Radford Meadow, Castle Donington DE74 2NZ – laughed after throwing his pet cat out of 24ft high window, breaking her pelvis and five of her ribs.

Wilkinson laughed after throwing his cat out of a third-floor window in a fit of rage after she weed on him. He opened the window of his top-floor flat and flung the one-year-old cat nearly 24 feet to the ground below.

A neighbour saw him walk out of the block of flats laughing and later pick up the pet, called Luna, and suggest the neighbour let his dog out to have a go at her. The witness raised the alarm and RSPCA inspectors took Luna to a vets’ practice where she was diagnosed with five broken ribs and double fracture of the pelvis as a result of the 7.3-metre plunge.

The RSPCA had requested magistrates ban Wilkinson from keeping any pets.

But the court heard Wilkinson’s mum, who is a veterinary nurse, keeps a dog and a cat at home in Silver Street, Barrow, where her son lived at the time of sentencing.

She wept in the back of the court as magistrates imposed the ban on keeping cats which meant she had to find a new home for her kitten.

Luna survived the ordeal and has since been rehomed.

Sentence:  300 hours of unpaid work, vets’ fees and costs totalling around £2,500, which Wilkinson was allowed to pay off at £20 per week. Banned from keeping cats for 10 years (expires January 2025).

Walsall, West Midlands: Dean Edwards

CONVICTED (2012) | Dean Andrew Edwards, born 22/04/1968, formerly of Smith House, Stoney Lane, Walsall and more recently  40 Ingot Close, Walsall WS2 7DD – battered his dog to death before hurling him 60ft off a block of flats in an attempt to cover up the attack

Dean Edwards beat his two-and-a-half-year-old Staffordshire Bull Terrier named Diesel so badly his internal organs suffered “catastrophic injuries”.

He then threw the body of the dog over his balcony at Smith House. The animal was discovered lying in a pool of blood on the ground by another resident of the tower block the next morning, and police and RSPCA were called.

Vicious Edwards claimed at the time that the first he knew of Diesel being on the ground was when he was alerted by a neighbour. He told the neighbour he thought the dog had been sleeping on his balcony and must have rolled off the edge.

But when Edwards’ flat was inspected “splatters” of blood were on the inside of the balcony, the floor and also on radiators.

Baseball and rounders bats were also seized and Edwards was arrested.

A post-mortem revealed that Diesel suffered a “blunt blow” to his chest, causing “massive injury” to his heart and surrounding arteries. He suffered no fractured bones and had limited bruising to his body because he was dead before falling from the balcony.

Edwards has been banned from keeping dogs for life after he was found guilty of causing unnecessary suffering to an animal.

Sentencing him, District Judge Michael Morris said: ‘I am satisfied beyond reasonable doubt you struck a fatal blow to Diesel and attempted to throw Diesel to the ground to cover your actions.’

A spokesperson for the RSPCA said: ‘We are pleased to hear Mr Edwards was convicted of the offences and the sentence reflects the seriousness of the offence.’

Sentence: six months in prison. Banned from keeping dogs for life
