Cheltenham, Gloucestershire: Tomasz Zimny

CONVICTED (2023) | Tomasz Zimny, born 9 November 1982, of 85A St Pauls Road, Cheltenham GL50 4HY – killed an elderly pet cat by swinging her over his head and slamming her onto the ground.

Polish national Zimny was caught on camera viciously killing much loved family pet Millie in the car park of the Cleeve School in the Bishops Cleeve area of Cheltenham. The horrific incident took place on 27 March 2022.

Zimny drove into the car park to collect his girlfriend Ewa Siebida, born 21 September 1980, who was waiting for him. He got out and let their two dogs out of the car who then chased the 12-year-old cat away.

The CCTV footage shows Zimny running after Millie before picking her up by her back legs or tail and swinging her up over his shoulder and slamming her onto the ground.

Horrifically, Millie’s ordeal wasn’t yet over. RSPCA Inspector Richard Carr, who investigated the case, said: “It is clear she is injured and unable to move but is still alive. He takes some steps away – but comes back and he then appears to kick her whilst she would already be in pain.

“She can be seen to move a few more times but then is motionless for a few seconds before dragging herself under the pallets.

“Neither Zimny nor his girlfriend bothered to check on her and instead got the dogs back into the car.”

A witness who had only seen part of what had happened rushed over to Millie, to find her lying still and in shock, so he rushed her to a vet.

Millie’s family were traced through her microchip and were informed the next day of her death.

It was believed at the time to have been as a result of a dog attack.

However, the school’s headteacher viewed the CCTV covering the car park and passed the footage of Zimny’s actions onto the police and RSPCA.

Millie’s body was exhumed for a post mortem which found a number of traumatic injuries including rib fractures, a collapsed lung, partial dislocation of three spinal joints and bleeding in the lung.

Zimny, who used a translator in court and is originally from Kostrzyn, Poland, claimed he had been bitten by Millie and said because his dogs were barking at her he thought the cat was attacking them.

Zimny had worked at Cleeve School as a cleaner for seven years before the attack, but resigned shortly after.

Solicitor Lindi Meyer, who prosecuted for the RSPCA said: “Millie did not die immediately but was then kicked by Zimny and she then dragged herself under the pallets where she died from her extensive injuries soon after

“[Zimny’s] actions were premeditated and in angry revenge.”

Zimny’s partner, Ewa Siebida, had worked for the school for ten years before resigning from her post as a cleaning supervisor on the same day.

Speaking to the Daily Mail she said Zimny “didn’t want to kill the cat. He didn’t come in there and he wasn’t going to do this.

‘[The dogs] wouldn’t have hurt the cat but they’d been barking quite loud in the carpark. The cat had run away and hid under a cleaning machine. I was going to take one dog and Tomasz had gone because one of them is only a young one.

‘She ran after the cat and was getting under the machine. Tomasz has gone to take the cat from under the machine and he put his hand under.

‘The cat – probably because he was frightened – he bites Tomasz, he cuts his hand and Tomasz has taken his hand from underneath the machine with the cat on his hand.

‘He didn’t know. There was just no time – he didn’t think what he was doing. It was just a reaction from his side.

‘The cat has bite him in his hand and he just reacted automatically because he didn’t know how to remove the cat so he just thumped him on the ground.’

Siebida continued: ‘I said [to him]: “Can you put yourself in the situation and think how you would feel if this happened to one of your dogs?”

‘He understands this and he knows about this. He didn’t want to do this.

‘He doesn’t even want to think about it. He knows how it would be for him if he was in that situation.’

She added: ‘I said it was unnecessary and he completely agrees with that. He didn’t want to do this. But he’s done it. He didn’t want this situation to go that way.

‘He’s quite reactive – so he can react and doesn’t think first.

‘And now he knows to stop for a minute and think what to do and not just straight away: bang! with a cat.’

‘It was so quick. I was there and not even five metres away and I hadn’t seen it. It was just two and a half minutes from when Tomasz came to the carpark.

‘It was unnecessary for everybody. This made us leave the job, it impacted our life and it’s going to stay in the head. It won’t go easy.’

She continued: ‘I got that statements from the family about Millie and read it from the top to the bottom. It’s breaking your heart, using words like this.

‘It was really bad so I don’t think the family will be happy that Tomasz has been in the court and I don’t think this will be enough for them.

‘I was myself surprised that he’s been treated as good. For me it was the best he could get out of the situation.

‘I can imagine that this is a really bad thing and really serious, especially in England. I was expecting that it would be really bad. I was even expecting that he can go to prison. We were expecting this. We have been ready for everything.’

Siebida now works in a bakery while Zimny does self-employed building work.

Sentencing | 18 week prison sentence, suspended for 12 months; 150 hours of community service. Disqualified from owning a cat for life but may appeal after five years (expires May 2028).

Ashton-on-Ribble, Preston: Martin Mansley and Daniel Gardner

CONVICTED (2022) | Martin Mansley, born c. 1970, of Preesall Close, Preston PR2 1NU and Daniel Gardner, born c. 1978, of Starrgate Drive, Preston PR2 1NA – set fire to a dog pen, causing fatal injuries to a family’s pet.

Mansley and Gardner were jailed for a total of 19 years and 6 months for their part in an arson attack which killed a 10-year-old collie cross dog, named Patch.

Police were called to an address on Sowerby Road, near Sowerby, at around 11.30pm on September 13, 2020, to a suspicious fire.

Officers found the fire, which was started deliberately, at the front of the property, engulfing a large dog pen containing Patch.

A neighbour managed to open the kennel door to allow the dog to escape. Badly injured and in immense pain, Patch fled the scene. A search and rescue operation was launched to find him and two days later he was discovered, still alive, lying in a ditch.

Patch was rushed to a vet with severe burns down one side of his body and a damaged eye. He was also suffering from smoke inhalation and pneumonia. Due to the severity of his injuries, he couldn’t be saved and was put down a few days later.

Patch’s family suffered a second arson attempt one night after the initial attack when a bottle containing petrol was thrown at the house. Fortunately, it failed to light, and nobody was injured.

The perpetrators, Mansley and Gardner, were charges with offences related to arson but not animal cruelty.

Mansley admitted two counts of reckless arson after a week-long trial.

Gardner was found guilty of reckless arson and attempted reckless arson.

Detective Constable Mark Ryan said: “These were targeted and dangerous crimes which resulted in the death of a much loved family pet.

“The injuries suffered by the dog have caused a significant amount of trauma to the family and I thank them for their bravery in telling the court about the impact these crimes have had on them.

“Compounding this suffering, the offenders have returned and recklessly tried to set fire to the house with them in it.

“I hope this sentencing sends out a warning to people who think this irresponsible behaviour is acceptable, that they will be tracked down and prosecuted.”

Luton, Bedfordshire / Islington, North London: Ryan Gibson and Ciaran Lambert

CONVICTED (2022) | Ryan Gibson, born c. 1991, of Farley Hill, Luton, and Ciaran Lambert, born c. 1998, most recently of Pleasant Place, Islington but originally from Flitwick, Bedford – stabbed a dog and his owner and hit them both with a hammer.

Gibson and Lambert were jailed after being found guilty of aggravated burglary and grievous bodily harm in connection to the violent attack in May 2019. At least one of the pair was originally charged with causing unnecessary suffering to the dog but this charge appears to have been dropped. Consequently neither was banned from owning an animal.

At around 5.45am, the victim and his dog, Blue (pictured) were stabbed and hit with a hammer at the victim’s Flitwick home.

Blue recovered from his injuries.

Despite sustaining life threatening chest wounds, the injured victim was able to provide officers with the names of his attackers. He also mentioned he believed the attack related to a small debt.

Several neighbours were alerted by the sound of glass smashing, followed by screams and shouts. They found the victim badly injured at the bottom of the stairs to his flat.

They went to his aid, noting the injured man was more concerned for the welfare of his dog, who had sustained two injuries, than his own condition. Several neighbours were able to provide details of the car used by the attackers.

Later that morning, officers identified the car at a property in Farley Hill, Luton. Armed officers entered the property and arrested Gibson and Lambert.

During a subsequent search of the property, a number of bags of cannabis were discovered as well as a balaclava, similar to one the victim said had been worn by one of his attackers.

The victim and his dog meanwhile both received emergency treatment and were able to survive their injuries.

During a two-week trial in May, the jury heard one of the offenders filmed themselves callously bragging about the attack. They had also stolen items from the victim’s home.

Following sentencing, DC Rebecca Crowley, who led the investigation, said: “The neighbours’ swift action in calling the ambulance ultimately saved the life of the victim and his dog.

Sentencing | Gibson was sentenced to 11 years for aggravated burglary, with an extended licence of three years on release. He will also serve a concurrent sentence of nine years for GBH with intent.
Lambert was sentenced to eight years for aggravated burglary, to run concurrent with a six year sentence for GBH with intent.

Kirkham / Lancaster, Lancashire: Ashley Grundy and Steven Robinson

CONVICTED (2022) | Ashley Grundy, born c. 1990, of Preston Street, Kirkham, Preston PR4 and Steven Paul Robinson, born c. 1982, of Devonshire Street, Lancaster LA1 4TQ – decapitated a dog and left his head on a door handle in act of revenge

Violent career criminals Ashley Grundy and Steven Robinson were in The Baron’s Rest pub in Astley Village on May 19 2018 when they got into a dispute with another customer.

Grundy, whose previous convictions include dangerous driving and possession of a knife, threatened the customers in the pub and then in the early hours of the following morning the pair drove to the victim’s address in Whittle le Woods. They stole the pet Yorkshire terrier called Bailey and drove back to the Baron’s Rest where they decapitated the dog.

The victim’s mother and her child discovered the sickening sight after the duo dumped the dog’s body at the pub and left his head on the handle of an address in Astley Village where Bailey lived.

The pair were sentenced to 19 months in prison for criminal damage and outraging public decency.

The Crown Prosecutor described the incident as an act of revenge and intimidation which was intended to cause maximum fear to the victims.

Police launched an investigation following the incident and carried out extensive enquiries to bring the sadistic pair to justice.

The carcass of Bailey was later discovered in the bushes at the side of the Barons Rest. An extensive CCTV trawl showed the defendant Robinson discarding an item into the bush using a car mat to wrap the item in which was later found to be Bailey’s decapitated body.

Sgt Paul Harrison, who led the investigation, said: “This was a lengthy investigation which involved a number of officers. Officers sat through hours of CCTV and had to go through distressing incidents to compare the DNA from Bailey’s head and carcass to the DNA of the blood found in and on the vehicle that Grundy and Robinson were using. I’d like to thank all the officers involved who worked tirelessly to bring this investigation to a conclusion. I now hope that this can give some closure to the victim who lost a beloved pet due to the barbaric act of these two individuals.”

Gortin, County Tyrone: Mark McGurk

#MostEvil | horse trader Mark McGurk, born c. 1998, of Glenpark Road, Gortin, Omagh – stabbed a horse in a revenge attack against traveller Harry Evans

Paedophile Mark McGurk is currently serving a prison term for sexual activity with a child. He was on bail for the horse cruelty matter when he sexually assaulted the child, after a cocaine and alcohol binge at a birthday party on October 5, 2019.

Despite previous denials McGurk ultimately admitted deliberately causing unnecessary suffering to the horse on June 10, 2019.

The court heard police were advised of the horse being stabbed at premises in the Gortreagh Road of Cookstown and on arrival McGurk identified himself as the owner.

An on-call vet was treating the horse and a number of puncture wounds were observed.

McGurk said he has been drinking with a fellow horse trader, traveller Harry Evans (an abuser in his own right albeit not yet convicted) and claimed that Evans had stabbed the horse after becoming “agitated”

Police were told Evans may still be in the area but they found him at his Magherafelt home, where he showed them a video sent to him by McGurk, via Facebook.

The distressing footage clearly showed the horse being stabbed.

McGurk was arrested and interviewed, but with the exception of claiming to own the horse, thereafter made no comment.

A vet provided a report on the severity of the injuries, confirming the horse had to be put down.

McGurk’s defence barrister said: “[He] expresses guilt, shame and remorse, in the strongest possible terms. He was behaving erratically, unpredictably and irrationally at the time. He describes the act as a moment of madness and can give no other explanation. He got emergency assistance from a vet and tried to stop the bleeding.”

Asked why the attack was filmed, the defence said the two men had a disagreement to which Judge Ranaghan remarked: “I can’t see it as anything but revenge. Repeatedly stabbing that totally innocent animal which had the misfortune to be in the defendant’s care, was a profoundly evil act.

“I cannot begin to imagine the level of what that defenceless horse suffered involving extreme pain, fear and distress. One cut was very deep and probably caused its death. This wasn’t a moment of madness. It was at least four moments of madness. Blood was pooling around that defenceless animal’s feet. That level of evil cruelty is disturbing.”

Sentencing | jailed for seven months. Seven-year ban on owning any animal.

Scunthorpe, North Lincolnshire: Susan Foster

CONVICTED (2021) | Susan Foster, born 3 September 1961, most recently of Hazel Avenue, Crowle, Scunthorpe DN17 4LS – killed her neighbour’s family dog with poisoned meat.

Evil Susan Foster threw meat laced with antifreeze and rodenticide into her neighbour’s garden where it was eaten by German shepherd Roxy, who was euthanised after four days of vomiting.

The incident took place in June 2020 and only came to light once the dog, a German shepherd named Roxy, fell ill and became lethargic, as she was seen vomiting and not eating food properly.

A vet gave Roxy intravenous fluid therapy and antibiotics, but her condition continued to worsen. As her prognosis was considered to be very poor, she was put to sleep on humane grounds.

Meat samples from the item consumed by Roxy were preserved and analysed, and it was found that the presence of antifreeze and rodenticide was inside.

Inspector Bradshaw at the RSPCA was given footage which showed items coming over the fence into Roxy’s owner’s property, and it was also discovered that the defendant interfered with her neighbour’s security camera.

Inspector Bradshaw, said: “This was an incredibly sad case – Roxy was a beloved pet – and her owners were heartbroken by their loss.

“This act caused Roxy an immense amount of pain and suffering, and deteriorating clinical signs meant this poor dog ended up losing her life as a result.”

Sentencing: 26-week prison sentence, suspended for 12 months; 15 rehabilitation activity requirement days. Ordered to pay £2,040 in court costs, £627 compensation to Roxy’s owners and a £120 victim surcharge. Disqualified from keeping all animals for 12 months (expired December 2022).

Luton, Bedfordshire: Deon Ellis

CONVICTED (2021) | Deon Ellis, born c. 1989, said to be of no fixed abode but with a last known address of Fallowfield, Luton LU3 and with links to Corby, Northants – stole a puppy before stabbing him and deliberately running him over with his van.

Deon Ellis savagely attacked ‘XL bully’ dog Hugo, who was just four months old at the time, leaving him for dead in the road.

Hugo was later found with serious injuries and knife wounds by volunteers who had searched through the night for him following a social media appeal. The young dog had to have life-saving surgery which was paid for by public donations.

The court heard Ellis had been involved in a dispute with Hugo’s family and stole the dog in ‘revenge’ while he was being walked.

Witnesses reported Ellis grabbing and lifting the dog by his collar before leaving the scene.

Hugo was then taken more than 60 miles away to Corby where a woman heard a dog cry out in pain and Ellis driving towards him. He was then seen swerving the van to make sure he hit the animal.

The puppy was later found and taken to a vet with lacerations which were consistent with stab wounds. Blood splatters which were linked to Hugo’s DNA were found in the back of the van which was recovered in the town.

The court heard Ellis, who appeared over video-link from HMP Peterborough, callously refused to give Hugo’s owner details of what he had done to the dog.

The court heard that Ellis’ previous convictions included possession of a firearm in 2015.

Ellis was convicted by a jury of theft of a dog and criminal damage to a dog.

Recorder George Keightley told Ellis it was a “cruel, targeted and planned act” which was “motivated by revenge”.

He added: “You attempted, in my view, to either seriously injure or kill this puppy and in effect left it for dead in the street.”

Sentencing: Ellis was jailed for a total of two years and four months and will serve up to half before being released on licence.

Coney saw the cat, known as Pedro, in a supermarket car park and took him to the Quantock Hills where he put him in a shopping bag and repeatedly stamped him underfoot.

A judge at Taunton Crown Court said it had been a targeted attack designed to deliberately distress his ex.

He said: “This was an absolutely disgraceful offence.

“It was malicious, deliberate activity and beyond the pale frankly, and it was targeted.”

Prosecutor Ms Lucy Taylor said the defendant, a delivery driver, had been in a relationship with Pedro’s owner.

Following the split, she had left the animal in the care of a relative but when she returned was told he had disappeared. She printed posters and displayed them in the neighbourhood but there was no sign of him.

Six months later, in November 2019, she received a message from the defendant’s latest partner to say the defendant had killed the cat by strangling and stamping.

She said Coney had seen the cat while at Asda and put him in the footwell of the car. He had told his partner to drive to Cheddar so he could throw him off the cliffs. She had refused but instead, and out of fear, agreed to drive to the Quantock Hills.

When they got there Coney took the animal outside and killed him with his foot, she said. He then buried the bag under some weeds.

Pedro’s body was never found.

Ms Taylor said the defendant messaged his ex to try and persuade her not to go to the police.

“There was clearly evidence of planning. It seems to have been a revenge attack on what is termed his ex partner’s property but was her pet cat.”

Coney pleaded guilty to an offence of criminal damage. The offence carries a maximum of three months in prison.

When police arrested him he initially blamed his latest partner for taking the cat and he had simply released it into the wild.

Mr Harry Ahuja, defending, said Coney had initially been too embarrassed and ashamed to admit what he had done.

“It was a disgraceful act on his part to take someone’s pet and treat in that manner,” he said.

Coney had been in a toxic relationship at the time which was now over.
He said the defendant had matured since the incident and feared going to prison. He has no previous convictions.

Sentencing: 12-month community order with 60 hours of unpaid work; £200 court costs and £600 compensation to Pedro’s owner. 20 rehabilitation days. No ban on keeping animals was imposed with the judge stating that he was “not sentencing [Coney] for an animal welfare offence” despite it being “part of it”.

Wavertree, Liverpool: Vasile and Adrian Serban

The pair, Roma gypsies from Romania, fled the UK in the sickening attack in Toxteth.

They were part of a gang of drunken louts who targeted Mihaela Filip, her son Christian Dutu, and their beloved American bulldog Hindo.

Adrian threw a broken bottle, which hit Ms Filip’s right hand, causing three deep cuts, before four thugs scaled the victims’ balcony.

Hindo tried to protect her owners, but was knifed with a broken bottle by Vasile, then flung onto a parked van in the road below.

Horrifying mobile phone footage filmed by witnesses captured the shocking moment the animal was thrown, then limped away and died.

Mr Dutu was also stabbed in the chest by one thug, then dragged inside his home, where his shirt was ripped and his trousers pulled down.

Meanwhile, Adrian also set upon Ms Filip – pulling her hair and repeatedly punching her – on the evening of April 21, 2018.

The brothers were jailed in their absence, having skipped a trial in September 2019.

Vasile admitted affray and was found guilty after the trial of “destroying property” – criminal damage – namely Hindo. He was jailed for 22 months.

Adrian was found guilty of affray and wounding Ms Filip. He was jailed for three years.

Chester, Cheshire: Jonathan Holder

CONVICTED (2020) | Jonathan Nicholas Holder, born 28/02/1987, of Derwent Road, Chester CH2 2PZ – killed his elderly pet dog by stabbing him four times with a knife and slashing his throat

Holder was given the maximum jail term for animal cruelty of 26 weeks for the savage attack on 11-year-old brindle Staffordshire bull terrier, Tyrone, in February 2020.

He was also given a lifetime ban on keeping all animals after he was found guilty of the animal welfare offence.

Tyrone’s bloodied remains were discovered in the garden by Holder’s mother, Tracy Holder, after she returned home from a short trip. The dog’s body had been hidden behind a tyre and a sandpit lid at the bottom of the garden.

Mrs Holder reported the matter to police who attended the address and they called the RSPCA to help with the investigation.

A large deep knife wound could be clearly seen across the whole of the back of the dog’s neck.

There were also blood splatters found around the garden area and patio and in some areas of the house.

Bloodied clothes belonging to Holder were also found in and near the washing machine.

Holder, who was at the property while his mum was away, was arrested by police.

During an interview the following day he said he had no memory of the weekend as he had been drinking heavily. He denied killing Tyrone but said another animal was responsible for his death.

RSPCA Inspector Pamela Bird took the dog’s body to a vet’s for examination and it was found that there were five sharp trauma wounds which occurred on his neck, shoulder and left forelimb and were believed to have been caused with a knife.

The vet concluded it would have taken several minutes to die or even hours for Tyrone to die as the blows had missed main arteries.

She said: “The duration of this suffering will be a minimum of a couple of minutes to give time for the dog to walk or stagger about the lounge, kitchen, patio and garden areas haemorrhaging as he was moved around.

“However, it is more likely he suffered for a longer period of several minutes up to a maximum of four hours as none of the major blood vessels of the neck or his trachea were involved in his injuries.”

The court heard how Holder had a fresh dog bite mark on his hand which could have provided a motive for the attack – but he denied this and said it was caused by a broken glass.

He then claimed someone else had killed the dog in a “revenge attack” and denied the animal welfare charge but he was found guilty by magistrates.

Inspector Pamela Bird said: “This was an upsetting case to deal with. It was clear from the vet report that Tyrone’s death was prolonged and that he suffered a great deal.”

In sentencing, on Thursday November 5, 2020, the court was told this was a case of “absolute cruelty” and not only did Holder inflict the stab wounds he denied his involvement and tried to shift responsibility onto an unknown attacker.

Sentencing: 26 weeks in jail. Lifetime ban on owning animals.
