CONVICTED (2023) | June Thistleton, born 16 March 1959, of Trent Road, Norley, Wigan WN5 9LY -failed to seek vet treatment for her cat’s nose tumour.

Thistleton’s cat Oscar had such a severely ulcerated nasal lesion that sadly he had to be put to sleep.

A post-mortem examination of the ulcer was taken and it was later found to be a malignant tumour.

Thistleton had pleaded guilty to causing the animal suffering by denying him treatment.

RSPCA inspector Rachel Whalley said: “When Thistleton called our Wigan branch clinic in late January ‘23 to make an appointment for Oscar, she told staff over the phone that ‘part of the cat’s nose has fallen’ off.

“She then cancelled a series of appointments, and the cat was finally brought into the vet clinic by another person three days later.

“When the vet examined Oscar, she found he was suffering from a large ulcerative lesion on his upper lip which extended to his nose which she suspected could be a cancerous tumour.

“Given the severity of the lesion, the severe and chronic pain this would have been causing the cat and the impossibility of being able to attempt treatment of the lesion without prolonging suffering, the vet decided that immediate euthanasia was in Oscar’s best interests.”

Insp Whalley added: “During my discussion with the defendant at her home, Thistleton claimed that she had not noticed Oscar’s lesion until very recently. However, this contradicted what a social worker told me.

“She had visited the house back in December and had noticed Oscar’s lesion at that time – more than a month before Oscar was eventually taken to the vet. She alleges that Thistleton told her she was going to take Oscar to the vet then said she couldn’t afford it.”

The vet who had examined Oscar reported that in her opinion, he had suffered chronic pain due to an untreated tumour on the nose and upper lip and his suffering would have been ongoing for many weeks.

She said: “I would expect a reasonable, and responsible pet owner to recognise a nasal defect such as this as being a potential cause of pain and would expect a pet owner to seek veterinary attention at a much earlier stage, when the lesion would have been much smaller.

“In addition, I would expect a pet owner to identify the other clinical signs Oscar was likely to have been exhibiting at home, such as sneezing, and reluctance to groom, or difficulty eating, and these issues should have also prompted the owner to seek veterinary attention. In failing to do so, Oscar’s owner has caused prolonged and severe suffering to him.”

Insp Whalley said: “It was Thistleton’s legal responsibility to care for her cat and she failed to do this. There was no excuse for failing to seek veterinary care for poor Oscar when it was abundantly clear that he so desperately needed it.

“This was a tragic case and simply shouldn’t have happened.

“The RSPCA urges anyone struggling to take care of their pet to ask for help, rather than neglecting them and leaving them to suffer.”

Sentencing | 12-month community order with 20 rehabilitation activity requirement days and 60 hours of unpaid work; £200 costs. No mention of a ban.

Chell Heath, Stoke-on-Trent: Robert Taylor

CONVICTED (2023) | Robert Taylor, born c. 1988, of Standersfoot Place, Chell Heath. Stoke-on-Trent ST6 6HR – found with a dead gosling in his bath.

Robert Taylor, an employee of Churchill China, was fined after a gosling he had taken from a canal path died in his bath.

Taylor was interviewed by police when they received information about an incident at Taylor’s home on June 12, 2023.

Prosecutor Sue Hayers said: “They attended and discovered a gosling dead in a bath with a small amount of water in it. He [Taylor] was arrested.”

In his police interview Taylor said he had taken the bird from a canal towpath. He said he thought he was doing the right thing. He said he intended to call the RSPCA or the RSPB but neither organisation was alerted.

He said when he got home he put the gosling in a bath of water. He then went and got drunk. It was then too late to call anyone. He woke up, saw the bird and did not do anything. By the time he woke again the bird was dead and the police had arrived.

Taylor pleaded guilty to taking a wild bird.

Sentencing | fined £250 plus £100 costs and £100 surcharge.

Edinburgh: Simon Wallace

CONVICTED (2023) | Simon Wallace, born c. 1996, from Morningside, Edinburgh but with links to the Gorgie area of the city – booted his partner’s dog in the ribs during an argument in the street.

Wallace kicked the unnamed sharpei so hard the pet was flipped onto her side.

The attack, which took place on Balcarres Street in the Morningside area of Edinburgh on June 24, 2023, was witnessed by members of the public who called police.

Wallace appeared from custody at Edinburgh Sheriff Court on Tuesday 25 Jul and pleaded guilty to causing an animal unnecessary suffering.

Sheriff John Cook jailed Wallace for 96 days after noting he had an “appalling record” for domestic offending.

The sheriff banned Wallace from owning any animals for five years.

According to reports, the unnamed dog was not physically injured.

CONVICTED (2023) | Lewis Hudson, born 9 June 2000, of Crispin Road, Netherley, Liverpool L27 7BE – tortured his girlfriend’s kitten over eight months by shooting her, scalding her in the shower and covering her in bleach before beating her to death.

During an eight-month campaign of terror, Lewis Hudson subjected the kitten, known as Binx to multiple sadistic attacks, culminating in her horrific death in August 2022.

The appalling catalogue of abuse began not long after Hudson had moved into a flat in Prescot with his now ex partner, Summer – who owned Binx – in August 2021.

In the months that followed Summer noticed several injuries on the cat. Hudson initially denied all knowledge, but soon began openly abusing Binx.

On one occasion he punched the kitten after she had scratched the furniture.

He also left her in the shower with the water running for long periods of time. Her owner found the distressed animal in the the bathroom, which was full of steam. She was crying and panting and her skin was hot to the touch.

In June 2022, Summer was watching funny cat videos on her phone when Hudson told her he had a funny video to show her. He then showed her a video of him stamping on Binx in steel toe cap boots. The cat was screaming and Hudson told her he would continue to do so if she did not do as she was told.

On another occasion Summer found Binx lying motionless and matted with blood in the bath after she had been hit with a shovel in the shower. This had been done with such force, the young animal’s teeth had been broken

Hudson would also shoot the cat with pellets from his BB gun. He even soaked them in cleaning fluids before firing them – and also hit Binx with a mop soaked in bleach “in the hope it would kill her”.

Summer tried to make arrangements for the cat to be rehomed but Hudson refused to allow this because he feared the injuries would be traced back to him and he wanted a dog.

In a disturbing series of text messages sent in August 2022, Hudson told his then partner that the cat was “going to get it” and he was “going to whack her with this shovel”.

He then told her “if you don’t get home now I am going to kill it”.

He finished by telling Summer “everyone in your family thinks I am a soft c because I am polite and quiet to them. I’ll f**** show them the real me if they want.”

She returned home to find Binx lying motionless. Her fur was matted with blood where she had been hit with the shower head.

Her fangs had been cleanly hit out of her mouth due to the force. Summer passed out when she saw the cat’s injuries while her mum called the police.

Hudson was arrested at the scene. When questioned by the police, Hudson claimed he “was all talk” and had kicked the cat away from him causing her to hit the TV stand.

In his witness statement RSPCA Inspector Anthony Joynes, who investigated for the charity, said: “Binx was wrapped in a bag, covered with a towel and contained within a cardboard box. I saw she had a number of fresh looking wounds around her nasal area and chin. I noted there were no obvious signs that might suggest Binx had been involved in a road traffic accident and her claws did not appear scuffed.

“The inside of her mouth was bloodied and I noted that both upper canines were broken. When handling Binx I noted a crisp packet type sound coming from the chest area which can be a sign of subcutaneous emphysema and indicative of chest trauma.”

Inspector Joynes arranged a post mortem examination. It showed that Binx’s body was covered with abrasions and bruises.

Her ribs were fractured and her lung was punctured, which was confirmed to be the cause of death. The court heard the cat had “suffered extensively”.

“Faeces and blood were reportedly seen in multiple areas of the premises, indicative that the cat was injured and mobile for a period of time immediately prior to death,” said a report by an independent veterinary expert.

“The most likely cause of death in this animal, otherwise healthy, was a traumatic and non- accidental pneumothorax. It is clear that the animal suffered multiple, different, blunt traumas and that the animal was conscious when this occurred.

“Furthermore, the healing fractured rib and the “aged” bleeding, support the existence of a previous traumatic event to the chest, many days ahead of the fatal set of injuries listed above.”

In mitigation, the court heard Hudson had experienced “traumatic events in his childhood”. He was supported by his dad in court and it is understood that his mother bakery owner Lisa Hudson and grandmother Marion Hudson are also standing by him..

Honour Judge Brian Cummings KC called the criminality “a sickening catalogue of cruelty to a defenceless animal”. He noted the totality of the offending and the prolonged and “sadistic” nature of the torture. In mitigation he took into account Hudson’s guilty pleas to two counts of animal cruelty and one of harassment relating to the text messages to Summer.

Judge Cummings jailed Hudson for two years and three months. He also imposed a restraining order that stops him contacting Summer for 10 years, as well as disqualifying him from keeping any animal for life.

Speaking after the sentencing hearing, inspector Joynes said: “This case involved stomach-churning and sadistic levels of cruelty over a prolonged period.

“The extreme suffering Binx endured at the hands of Hudson was used to hurt and punish Binx’s owner – who was obviously devastated by what happened to her beloved pet.

“This is one of the most extreme examples of physical and psychological suffering inflicted on an animal I’ve seen in 14 years with the RSPCA. This case involved nothing short of torture and is exactly why the Animal Welfare (Sentencing) bill was introduced in 2021 to increase sentencing powers for the most extreme cases of animal cruelty.”

The RSPCA worked in partnership with the police to bring the charges against Hudson.

Sentencing | two years and three months in jail and a lifetime ban. 10-year restraining order prohibiting him from contacting Summer.

The’ Daniels and their associate Ricky Kerswell, a traveller, admitted cruelty to a female wirehaired Dachshund known as Coco and to a female wirehaired Dachshund puppy by failing to provide veterinary treatment in respect of the animals’ skin disease.

In a written statement from an RSPCA inspector, the court heard that Coco and the puppy had been found in a downstairs small room at the rear of a property in Willow Road, Rochester. They were found in dirty conditions. Fleas were evident and they had fur loss.

A vet who attended the location also provided a written statement for the court. It was said that Coco’s “skin had large patches of hair loss and small areas of inflammation”.

He added: “The dog had a strong smell typical of animals with severe skin disease. The bald patches were particularly obvious around the eyes, on the ears, and on the limbs and tail. Patches of infected and red skin were noted on the belly, neck and rump.”

The puppy was also said to have “a lot of hair loss”.

The vet said: “The ears were bald and leathery due to the severe skin disease.

“The pup smelt much stronger than the mother and was noticeably withdrawn and depressed. She scratched and rubbed her belly at least every minute. Fleas could also be seen crawling over her body.”

Both were said to be suffering by the vet due to the severe skin disease.
Following a hearing at Sevenoaks Magistrates’ Court on 10 July both of the dogs were signed over to the RSPCA. At sentencing an order to remove further dogs was also made.

In RSPCA care the two Dachshunds made a full recovery and have been cared for by some of the charity’s dedicated foster carers.

The Daniels have indicated that they intend to appeal.

Sentencing | ordered to pay £333 costs and a £114 victim surcharge. Samantha Daniels received a 10 week tagged curfew, Jayson Daniels received 108 hours unpaid work and Kerswell was ordered to undertake 108 hours unpaid work plus 20 RAR days. All were disqualified from keeping dogs for a woeful 18 months (expires early 2025),

Self-styled ‘rat-catcher‘ Grant Campbell pleaded guilty to seven charges of causing unnecessary suffering by failing to provide veterinary treatment for various conditions and injuries affecting six dogs in his care, including a broken leg.

His brother David Campbell pleaded guilty to one charge of failing to provide a suitable environment for two of the dogs and failing to keep them free from suffering, injury or disease as their clinical condition strongly displayed signs of neglect and failure to seek veterinary care.

Scottish SPCA inspector, Dawn Murrie, said: “We had several dealings with Grant and David Campbell from March 2021 in regard to the conditions dogs were being kept in and traps Grant Campbell had around the Newmains area.

“Advice was given on the conditions the dogs were being kept in on several occasions and we issued an animal welfare notice that the Campbells complied with. Advice was also given to Grant Campbell on the operation of his traps and the requirements for their appropriate use.

“On 19 October 2021 we received another complaint to our animal helpline about the conditions at the property.

“We attended and it was immediately clear that there were issues throughout. There was a strong foul odour as we entered, and the pathway into the garden and dog kennels was covered in faeces, hazards and rubbish.

“The kennels themselves were full of urine and faeces with a complete lack of suitable, dry bedding available for the dogs.

“One kennel was so full of faeces that no part of the flooring was visible. The door to this kennel was closed over and, at first, we assumed this to be a dumping ground for all of the faeces accumulated from the other dogs. Further examination revealed two large, adult deerhound type dogs, lying in the back compartment of the kennel.

“We had immediate concerns for the welfare of all of the animals on the premises and removed them for veterinary examination.

“Lass, one of the deerhounds, was found to have pressure sores and a fracture in her leg that the vet estimated would have been present for around three to four weeks. The break had been left untreated for so long that she had to have her leg amputated.

“Boy, another deerhound, only had three legs and was suffering from a displaced toe. Not only would this have caused him pain but the extra stress on them due to his missing leg would have been more than a normal limb usually supports.

“Gibbs, a pug, was suffering from a severe bacterial skin infection. Pinky, another pug, had an extremely infected and swollen toe.

“Tara, a Staffordshire bull terrier, and Buffy, a lurcher, were found to have arthritis, an extremely painful condition when left untreated.

“All of the dogs were suffering from dental disease to some extent.

“We are pleased that both brothers have received bans on keeping animals.”

Sentencing |

Grant Campbell: two year supervision order and six month restriction of liberty order. Banned from keeping any animal indefinitely.

David Campbell: community payback order of 300 hours to be completed over three years. Banned from keeping any animal for five years (expires July 2028).

Hastings, East Sussex: Shadelle Moynes-Burns

CONVICTED (2023) | Shadelle Moynes-Burns aka Delly Burns, born c. 1992, of 26 Gladstone Terrace, Hastings TN34 3JX – routinely subjected a puppy to violence causing multiple severe injuries.

Moynes-Burns pleaded guilty to three animal cruelty charges in a prosecution brought by the RSPCA after concerns were raised about her puppy Teddy.

Teddy was found to have 11 rib fractures and multiple injuries consistent with repeat blunt force trauma.

The animal welfare charity was called to investigate when the young crossbreed was presented to a vet surgery in December 2021 with multiple rib fractures and injuries to his paws and tail.

Teddy had been seen several times by a vet between October and December 2021 for separate alleged accidents including falling from a bed and choking on a stick.

He was brought into the vet on December 31, 2021, with fluid-filled lumps all over his body.

Following an x-ray, he was found to have 11 rib fractures and multiple injuries consistent with repeat blunt force trauma. He also had fractures to his front paws consistent with them being hit with an object, which also impacted the use of his hind legs.

The vet said it was unlikely the injuries would have been caused by accidents and the rib fractures and lumps on his body (haematomas) were a sign of abuse.

Teddy’s injuries were so bad that the vet considered putting him to sleep but decided that, with the correct care, he could recover.

In mitigation, Lewes Crown Court was told Moynes-Burns had a troubled past, including mental health and attachment issues and was deeply embarrassed by her behaviour.

The court heard she did love Teddy and sought help for him.

During her sentencing, the judge said: “My hope is that you get better, but the keeping of animals will no longer be a part of your life. You can apply in 20 years but the chances of it being lifted are zero.”

In a statement, the vet said: “Teddy is now recovering well in RSPCA care. He is growing well, using his front feet normally and his hind legs are healing well. In spite of everything he has gone through he is a happy, friendly and trusting dog which is a pleasure to see”.

RSPCA inspector Zoe Ballard, who investigated for the charity, said after the hearing: “This is a very special little dog who has had an unimaginable start to life. His rescue was made possible by all those who bravely spoke and cared for him. He has touched the hearts of everyone he has encountered throughout his journey.”

Sentencing | nine-month custodial, suspended for 18 months. 25 rehabilitation activity requirement days. Banned from keeping pets for at least 20 years.

Low, who has two previous convictions for near identical offences, was jailed and handed a second lifetime ban for leaving dogs, cats and a goose to live in squalor

The custodial sentence came after he was found guilty by trial of five offences under the Animal Welfare Act. This includes causing unnecessary suffering to dogs, cats and a goose.

Furthermore, it was said that Low failed to care for 11 dogs and puppies. He was also found to be in breach of a lifetime disqualification order imposed in May 2007.

Among the animals found at the scene were an emaciated yellow Labrador and two dead puppies. Low also had cats that “all appeared unkempt with dirty coats” with one found to have a large polypoid affecting his ear.

A preliminary post mortem on the dead puppies revealed that both animals were in “poor body condition” and had likely “starved to death.”

The vet also confirmed that a tabby cat was found to have a burst abscess under his chin as well as thick pus coming out of his right ear. The Labrador was described as “thin with a body condition score of one out of nine where one is emaciated and nine is obese, she weighed 16.1kg.”

Six puppies were all examined and were estimated to be aged between eight and 10 weeks old. It was said they were “small in stature and all of thin body condition.”

In a witness statement provided to the court, RSPCA inspector Rachael Davies described the location where Low kept the animals as a clearing in the forest.

The inspector said there was lots of rubbish and recycled plastics, tins, bike wheels, plastic bags and general waste lying around on the ground in the clearing.

She said: “I could see an extremely skinny yellow Labrador type dog and white long haired German Shepherd type dog tethered to what I would describe as some sort of trailer. The dogs had no access to any suitable shelter, there was a sodden cushion on the ground near the German Shepherd and lots of empty dirty metal bowls. I could clearly see all of the ribs and hips on the Labrador, and could easily feel her spine, her teats were enlarged.”

In a caravan, she found eight black and chocolate Labrador cross puppies who were “very small”. Insp Davies added that the pups were in a “very unsanitary” environment and she “did not see any food or water bowls inside the caravan”.

Inspector Davies spoke with Low at first and advised about getting medical attention for the animals and proper accommodation for the dogs but he was “disagreeable” and refused their help. She later returned with animal rescue officer Melanie Froude and once again asked if she would be able to take the dogs to the vets, but this was refused and she issued him with an Animal Welfare assessment warning notice.

It was soon discovered that Low had been disqualified from keeping all animals for life – and the officers reattended the address with North Wales Police.

Inspector Davies described the conditions as much the same “just wetter and colder”.

She said: “The German Shepherd was no longer tethered to the trailer with the Labrador and the puppies were roaming free in the forest clearing. Four of the puppies gathered together and huddled themselves around a lit fire bin just outside the caravan where they had been contained on my last visit.

“They were all very quiet and looked very cold and like that had lost condition since I had last seen them. The Labrador was still tethered to the same trailer and she also appeared to have lost condition looking a lot thinner. The water bowls that had been empty on my last visit now appeared to be filled with rain water.”

In total 13 animals (plus the two deceased pups) were removed and placed in the care of the RSPCA.

Since they were seized, the 13 animals have been doing well in RSPCA with the Labrador and pups settling in well in foster homes. The animals will now be found forever homes.

CONVICTED (2023) | Alan Mee, born 15 November 1961, of of 63, Larch Avenue, Newton-le-Willows WA12 8JF – took tawny owls from the wild and kept them in filthy cages.

Alan Mee was fined and disqualified from keeping birds after officers from Cheshire Police seized wild owls that were being kept in unsuitable conditions at his home.

Mee pleaded guilty to three counts of failing to take reasonable steps to ensure the needs of an animal, and two counts of possessing a wild bird.

On 20 June, 2022, Cheshire Police’s Rural Crime Team, Merseyside Police, RSPCA, and Natural England executed a warrant as a result of information relating to wild birds in the Cheshire area.

Cheshire Police led on the warrant at Mee’s address where three tawny owls were located, two of which were suspected to have been taken from the wild.

All three owls were seized due to the conditions they were being kept in, which included having dirty water, no feeding area, and the aviary being too small.

Sentencing | fine and court costs to the value of £823. Disqualified from keeping birds for five years (expires July 2028).

CONVICTED (2023) | Harry Michael Taberner, born 3 September 1992, originally from Altrincham, but with links to Weymouth, Dorset, and Harehills in Leeds – caused serious harm to a pet cat.

Victim Tulula endured a vicious assault at the hands of twisted construction worker Harry Taberner during which she suffered a catalogue of severe injuries to her head and body. Patches of her fur had been ripped out and there was swelling to her anus indicating a possible sexual motivation. Veterinary examination found evidence of previous injuries that had healed, with the implication that the attack had not been a one-off.

It’s not yet known if Tulula survived the attack after she was taken into the RSPCA’s care.

The attack took place on January 11, 2021, at an address in Chickerell, Weymouth while Tulula’s owner was away overnight, The owner returned to her home the next day to find her pet in a terrified state, soaking wet and covered in shower gel.

She confronted Taberner, who seems to have been known as ‘Mike’, who denied hurting Tulula but he left her home a short time later and disappeared.

The RSPCA had some difficulties tracking down Taberner as he kept moving addresses and failed to turn up for multiple court appearances.

On Thursday May 27, 2023, Taberner, director of Empire Roofing and Building Ltd, previously Trojan Roofing, with premises in Runcorn, Cheshire, was found guilty in his absence following his latest court now-show.

He was eventually sentenced on Tuesday, July 18, 2023.

The court said that Taberner’s vile offence was so serious because of ‘prolonged sadistic behaviour towards an animal, causing serious harm’.
