Cowdenbeath, Fife: Arran Swift / Arran Adey

CONVICTED (2024) | serial domestic abuser and dangerous career criminal Arran Swift aka Arran Adey, born c. 1986, originally from Cowdenbeath, Fife but with links to the Lochend and Restalrig areas of Edinburgh and Cumbernauld in Glasgow – killed and mutilated a hamster with a hammer in a sick revenge attack against his partner.

The death of the little hamster, named Timmy, came to light after Swift sent the woman a chilling message, stating “Timmy isn’t going to survive”.

Police found the body of the animal, along with blood splatters where he had been thrown against a wall and a hammer covered in blood and hair.

The court heard that Swift carried out a litany of abuse after entering into a relationship with the woman in 2018 or 2019.

Fiscal depute Ronnie Hay detailed the abuse, including the destruction of the victim’s pet, committed after she took Swift back following a previous split.

He said: “The complainer felt sorry for him and invited him to stay with her.

“The accused’s behaviour did not vary – he began controlling what she was doing.

“He punched and kicked at walls and mirrors.

“They separated in September 2021 and she left her flat, leaving her pet hamster Timmy.

“Between September 6 and 16 telephone records showed 391 communications were made from his phone to her.

“These messages were also threatening – she received one saying ‘Timmy isn’t going to survive. Where are you?….bad move, goodbye’.”

Police went to the property and found evidence Swift was still living there – along with the grim discovery of the pet’s body.

Mr Hay continued: “They observed the deceased hamster, which appeared to have been struck off the wall.

“They contacted the SSPCA and an inspector attended and found the hamster and blood spatters on the wall.

“She saw a hammer with blood and hair on it.”

On an earlier occasion Swift trapped the woman inside her house, tied her hands together and followed her around the house – even watching as she used the toilet – and threatened to stab her.

On another occasion he hit her, resulting in her waking from unconsciousness in the bathroom.

After the woman left Swift initially, she found him inside her house.
Swift had taken some important items, including jewellery and photographs, telling her he had taken “things that matter to you”.

He invited her to a Travelodge in Edinburgh with the promise of returning the items.

She texted her mother asking her to call the police as she needed help, only for Swift to beat her with a gin bottle.

Other incidents included stealing a television that had been taken in by a neighbour following delivery, making threats to kill her former partner, sending her photos to suggest he was in her local area and he stated he had put cameras in her home.

Swift, a prisoner at Edinburgh, admitted engaging in a course of conduct abusive of a partner or ex-partner at addresses in Fife, Edinburgh and Cumbernauld between October 2020 and January 2022.

Swift’s heinous crimes were so serious the case was remitted to the High Court in Dundee.

Presiding judge Lord Arthurson ruled that Swift poses a significant threat to the public should he be released from custody.

He said reports showed that Swift had “sadistic” tendencies and scored highly on a test to assess psychopathic behaviour.

He said: “You demonstrated extreme violence, controlling and somewhat sadistic behaviour towards your victim. You have used different aliases in relationships.

“When you are heavily intoxicated and in a state of inebriation you have felt the overwhelming desire to inflict serious pain on others. You have shown a lack of empathy. You have shown no anxiety about the consequences. There is an extremely high likelihood of you committing other offences and you have the capacity to cause lethal harm.

“You scored highly on the assessment for psychopathy. The risk of harm posed by you has been persistent over time. You have been violent against strangers and intimate partners.

“You have found it impossible to take responsibility for your behaviour. You have had eight previous partners and have shown concerning behaviour towards seven of them.

“You have described your own fantasies about harming others in the past. You killed your victim’s pet animal and mutilated the body. You repeatedly threatened to kill your victim and her family and burn down her house. This was sustained, coercive and controlling behaviour over 16 months.”

Lord Arthurson said: “I have concluded that the nature, gravity and pattern of offending are such as to demonstrate that your liberty will endanger the lives of the public at large.”

Swift will initially serve three years and nine months in prison but will be subjected to a lifelong restriction order meaning that only the parole board can decide if Swift can be managed in the community.

Swift was also made subject to a lifelong non-harassment order.

The court was told that Swift was already subject to two other non-harassment orders, had served 19 previous prison terms and was on a community payback order at the time of the latest offence.

Sentencing | three years and nine months in jail. Order for Lifelong Restriction (OLR).

Penicuik, Midlothian: Alexander Hamilton

CONVICTED (2024) | Alexander Hamilton, born c. 1959, of 112 Windsor Drive, Penicuik EH26 8EP – trapped and starved magpies to death in his garden.

Hamilton, a former gamekeeper, pleaded guilty to confining /ibirds in illegal cages in his garden.

A trial at Edinburgh Sheriff Court heard how Hamilton deprived the animals of food, water and adequate shelter, which caused them deep distress.

His disturbing operation was uncovered by SSPCA animal welfare officers on July 29, 2022, after the alarm was raised by a neighbour who witnessed two of the birds being trapped at his property.

The magpies were discovered locked up in several small metal cages, as another bird was found lying dead on paving slabs outside.

Animal welfare officers reported how three of the traps were found in the bottom corner of Hamilton’s garden, hidden from the rest of the area by a large fencing panel. They discovered the first trap to be an illegal Larsen Mate trap containing one magpie, which was crammed into the tiny space and in poor condition.

In the second cage, another magpie was found in poor bodily condition. It had managed to squeeze through the mesh on the floor and enter a space underneath the adjacent shed.

The court heard how SSPCA officers could hear the bird scraping and pecking at the wooden floor, in a clear state of distress. After intervention, the magpies were released from the cages and into the wild.

Commenting on his sentence, SSPCA Chief Inspector Mark Rafferty, Special Investigation Unit, said: “We are pleased with the five-year ban at the sentencing result. All animals should be protected from suffering and this includes magpies.

“Our team treats these cases seriously and it is good to see that the courts share this view. We will continue to investigate this type of offending, to ensure people like Hamilton are caught and stopped from further cruelty acts.

“I would like to thank the Procurator Fiscal Karon Rollo and the Wildlife and Environmental Crime Unit.”

Sentencing | 100 hours of community service. Five-year ban on owning and keeping animals (expires March 2029).

Haddington, East Lothian: John Smedley

CONVICTED (2024) | John Smedley, 56, born c. 1967, of Priory Walk, Haddington EH41 4AJ – illegally shot and killed deer.

Smedley confessed to killing the roe deer without permission in Morham, East Lothian, and also admitted to having the animal’s carcass in his home at North Berwick on April 23, 2023.

He also pleaded guilty to a third charge of possessing a Texan Air Rifle Lethal Load weapon without lawful authority.

Smedley, who has a previous conviction for the same deer hunting offence, was blasted by a judge after trying to claim that shooting the animals was deemed “acceptable” in the area.

Sheriff Matthew Auchincloss stated: “I live in East Lothian and I can tell you that it’s certainly not acceptable to poach these animals.”

Commenting on the terrifying firearm Smedley owned, the judge added: “I have seen a picture of the rifle you used. It would have looked like a sniper rifle to anybody who didn’t know what it was if they saw you walking around with it.”

Fining Smedley £800, Sheriff Auchinloss continued: “That’s so you know it’s not worth your while hunting for deer – it would be much cheaper to just buy a carcass.”

Defence lawyer Mark Hutchison said his client had grown up watching his grandfather and father hunt for deer without any repercussions.

He explained: “Mr Smedley tells me that in East Lothian, there’s a culture of this kind of thing being acceptable. Obviously it’s not acceptable. I told him he will get the jail for doing it again and he said he’ll never do it again.
“He’s never had a custodial sentence before and other than this matter, lives a pro-social life, working seven days a week.”

Addressing Smedley, Sheriff Auchincloss said: “This is not acceptable and is a crime. It may have been more accepted in your grandfather and father’s time.

“But time changes the law. I am satisfied that the custody threshold has been met. However, as this is a summary matter, I can only send you to prison if there are no other alternatives.”

A motion by Procurator Fiscal to have the rifle and ammunition forfeited was granted.

A source close to Smedley, who works as a scaffolder, claims he hunted the animals “for fun” and would allegedly give away the meat or feed it to his dog.

They added: “He’s done this before and I’d be very surprised if he doesn’t do it again. This sentence absolutely does not send the right message of deterring others.

“Everyone in Haddington honestly expected him to get the jail for his cruel actions. Where’s the justice for these animals?”

All four deer species found in Scotland – red, roe, fallow and sika – are protected under the Deer (Scotland) Act 1996. Permission to shoot them must be granted by the authorities.

Bathgate, West Lothian: Kevin Vivers

CONVICTED (2024) | Kevin Vivers, born 1965, with a last known address of Dalling Avenue, Bathgate EH48 2SB – for a catalogue of animal cruelty offences, rapes and sexual assaults over 36 years.

Vivers originally denied a series of charges, but was convicted of 27 crimes, including five animal cruelty offences alongside nine rape charges, seven assaults, and four sexual assaults.

His crimes in West Lothian and Stirlingshire spanned from when he was still a teenager in 1985 until 2021.

Vivers killed animals and subjected seven female victims, including a minor aged 13/14, to assaults, sexual assaults and rapes.

His first episode of animal cruelty was in 1985 when he began repeatedly punching a dog and kicking a cat.

In or around 2012 he attacked two dogs by lifting them by their collars, hitting them with sticks and kicking them.

In or around 1993 in Bathgate he killed two dogs by shooting one animal and slitting the throat of the other.

Vivers also apparently used dogs to hunt rabbits, deer and foxes and also allegedly drowned dogs.

A judge at the High Court in Edinburgh imposed a lifelong restriction order on Vivers and said he must serve a minimum of 10 years in prison.

Lord Lake told Vivers: “I must make it clear this does not mean you will be released automatically at the end of that period.”

He told the sex offender he would only ever be freed from jail if parole authorities were satisfied his release would not endanger public safety.

Expert reports prepared on Vivers concluded that he presented a high risk.

Lord Lake told him: “Your offences are of a serious kind, even when taken individually. When considered together they show a depraved course of conduct.”

He told the court via a video link to prison: “I have been penalised for something that is well and truly unproved.”

Det Ch Insp Steven McMillan said: “This was a difficult case due to the horrendous nature of Vivers’s crimes and the sickening animal abuse, which spanned so many years.

“I want to make it clear to anyone who has experienced sexual abuse that there is no time limit on when you can report these crimes. I would encourage any victims to come forward and report it to police.”

Vivers has been placed on the sex offenders’ register indefinitely.

Lord Lake also made orders prohibiting Vivers from directly or indirectly contacting his victims.

Sentencing | lifelong restriction order with minimum 10 years to be served behind bars.

Prestonpans, East Lothian: Scott Fleming

CONVICTED (2023) | Scott Fleming, born c. 1996, of Redburn Road, Prestonpans EH32 9NA – downloaded depraved bestiality videos.

Cybercrime officers found a horror collection of videos on Scott Fleming’s phone showing a horse, a pig and a dog being raped by adult men and women

Fleming was found to have downloaded the films to his mobile phone when police officers raided his home in Prestonpans on May 10, 2021.

Prosecutor Debbie King told the court that police arrived at the home Fleming shared with older brother Gordon Fleming with a search warrant.

Ms King said that officers from the National Child Abuse Unit searched the property and seized electrical equipment including a phone, a laptop and an external hard drive.

Four MP4 videos were discovered on the mobile device showing “sexual acts between an adult female and a horse, a pig and an adult male and a dog”.

Ms King added that one film also featured “an adult female and an adult male inserting a live moving drill into another man’s penis”.

Depraved Scott Fleming from Prestonpans, East Lothian, downloaded animal rape videos

Fleming pleaded guilty to possessing extreme pornographic material depicting bestiality but walked free from court with a community order. He also escaped being placed on the sex offenders register.

His brother Gordon Fleming, born c. 1994, also appeared in the dock accused of possessing child sex abuse images but he had his plea of not guilty accepted by the Crown.

Sentencing | nine month supervision order; 162 hours of unpaid work in the community.

Edinburgh: Simon Wallace

CONVICTED (2023) | Simon Wallace, born c. 1996, from Morningside, Edinburgh but with links to the Gorgie area of the city – booted his partner’s dog in the ribs during an argument in the street.

Wallace kicked the unnamed sharpei so hard the pet was flipped onto her side.

The attack, which took place on Balcarres Street in the Morningside area of Edinburgh on June 24, 2023, was witnessed by members of the public who called police.

Wallace appeared from custody at Edinburgh Sheriff Court on Tuesday 25 Jul and pleaded guilty to causing an animal unnecessary suffering.

Sheriff John Cook jailed Wallace for 96 days after noting he had an “appalling record” for domestic offending.

The sheriff banned Wallace from owning any animals for five years.

According to reports, the unnamed dog was not physically injured.

Prestonpans, East Lothian: Raki Islam / Kevin Martin

CONVICTED (2023) | Raki Islam, born 7 November 1978, of 195 High Street, Prestonpans EH32 9AY – for the mistreatment of multiple dogs kept at the home she shared with co-accused (but acquitted) Kevin John Martin born 16 November 1971.

Raki Islam and husband Kevin Martin had faced charges in relation to seven dogs suffering from a number of health conditions including demodectic mange, deep bacterial pyoderma, malassezia, pachy dermatitis, giardiasis, verminosis, a parasite burden, and severe bilateral conjunctivitis.

The pair were already well-known to the Scottish SPCA. Inspector Fiona Thorburn said the charity had “received multiple reports to our animal helpline dating back many years, with concerns about living conditions and animal cruelty and neglect at both the locus in Prestonpans and other properties in East and West Lothian.

Regarding the investigation and prosecution, Inspector Thorburn said: “In June 2021 a report was made to our helpline and videos sent to us of 13 dogs being kept in the rear garden of the property on High Street [Prestonpans] which was covered in faeces and had no adequate shelter.

“The videos were extremely concerning with seven of the dogs appearing to be underweight and virtually bald with very thickened skin.

“With sufficient evidence a warrant was granted by the procurator fiscal, the property was attended along with Police Scotland and the local authority.

“Entry to the property was forced and the 13 dogs were found in the garden which was heavily soiled with diarrhoea, faeces and urine. There was not enough shelter provided for the number of dogs and the smell was overwhelming.

“Several of the dogs were bald and suffering from very severe skin conditions. Their eyes and ears were also painful and infected with copious discharge, and some were underweight.

“All 13 of the dogs were removed and taken for immediate veterinary examination and treatment.

“Seven puppies were found to have a heavy mange burden, which is usually only evident in animals with compromised immune systems. They had chronic secondary infections because of this which affected their skin, ears, eyes, feet and genitals, causing pain and irritation.

“The puppies also had giardia, meaning they were both infected by, and actively shedding, the parasite causing severe diarrhoea. If left untreated this disease can be deadly.”

Islam and Martin were charged with failing to provide adequate care and allowing dogs to suffer. They were also said to have failed to provide adequate shelter and bedding and exposed the animals to faeces and urine between July 1, 2019, and June 14, 2021.

Martin faced additional allegations of behaving in a threatening or abusive manner at his home on February 23, 2021.

Martin, who is no stranger to the courts with previous convictions for offences such as assault and failure to adhere to a dog control notice pleaded not guilty to all charges against him and these were accepted by the crown.

Islam pleaded guilty to a single charge but, quite unbelievably, dodged punishment altogether.

Instead she was admonished by the court and will still be allowed to keep animals.

SSPCA inspector Thorburn expressed her disappointment over the latest shocking injustice by the Scottish courts.

She said: “We feel saddened that despite the time and effort we have taken putting together a case where Islam has been charged, she has only been admonished. We believe this decision will likely result in more dogs suffering unnecessarily in the future.

“The dogs removed from Islam’s property took several months to fully recover in the care of the Scottish SPCA and thankfully have now found loving homes where their welfare needs will be met.”

Additional Information

In February 2015 the Daily Record published an article on Kevin Martin’s dispute with neighbours over a herd of 24 pigs kept in inadequate conditions at his Magic Farm business in Willow Rise, Haddington, which he ran with brother-in-law Shafiqul Islam.

The pigs were seized in February 2014 under animal welfare laws.

Martin appealed against the seizure but his case was thrown out at the Court of Session in Edinburgh.

Martin complained to the Record that he had been discriminated against by “the poshest people in Scotland” who “bombarded the council with ridiculous complaints about me”.

The Record also reported that Martin, who “has a conviction for violence and had criminal associates”, was targeted by gangland enforcer Frank Doris in 2008 when a £30,000 contract was put on his head. Doris was hired by a property developer named Martin Black, who claimed he was living in fear of Martin after a soured business deal.

Martin said he moved to East Lothian to put his past behind him.

He said he kept the pigs for a planned social inclusion project he wanted to set up to help inner city kids learn countryside skills.

Martin, who describes himself as an “ethical entrepreneur”, claimed police raided the Magic Far business after receiving a tip-off he was running a cannabis farm.

He has a colourful business history, including interests in diamond mines in Sierra Leone and importing coconuts from Bangladesh and admitted tax evasion during a trial.


In March 2020 Kevin Martin was given a three-year ban on owning dogs after allowing a large-breed dog to roam and attack two of his neighbours’ pets.

The dog – a Turkish Kangal – savaged a retriever and a terrier in the grounds of the Whittingehame Estate, east of Haddington, East Lothian.

The Kangal – originally bred to protect livestock from wolves, bears and jackals – attacked both dogs by pinning them to the ground and biting them to the neck while out on walks with their owners.

Martin had been served with a dog control notice following a series of complaints from several worried residents of the exclusive £1.5million apartments in 2018.

But he continued to allow the guard dog, named Mia, out on her own to patrol the grounds before the out-of-control animal then went on to carry out the attacks on his neighbours’ pets.

Martin, who runs a social enterprise for disadvantaged children called the Earthy School Project, denied being the owner of the dog and breaching the control notice, and stood trial at Edinburgh Sheriff Court on several dates in 2019.

The court was told that Martin had been served with the dog notice on September 5, 2018 after numerous complaints from Whittingehame residents about the Kangal being allowed out on her own.

Martin claimed he had bought the 30kg guard dog as “a livestock guardian” as foxes had attacked his geese and hens, but denied being the actual owner of the animal.

Martin was also facing a separate allegation of assaulting sheriff officer Alex Horne, who had attended at his property in July 2018.

Mr Horne told the court that he was climbing a gate when Martin nudged it with his vehicle during a visit to the estate to serve him a notice. He also said Martin had attempted to punch him during the confrontation.

Following the evidence, Martin was found guilty of failing to adhere to a dog control notice and allowed his animal to attack other dogs, causing injury, at Whittingehame Estate on four occasions on September 14 and 29, October 3 and 28, 2018.

Martin was also found guilty of assaulting sheriff officer Alexander Horne by driving a vehicle at and colliding with a fence Mr Horne was surmounting and attempting to punch him on July 16, 2018.

The sheriff fined Martin £200 and ordered him to carry out 200 hours of unpaid work in the community.

Corstorphine Hill, Edinburgh: Thomas Gordon aka Rebecca Gordon

CONVICTED (2023) | Thomas Gordon, born 13 May 1992, from Corstorphine Hill, Edinburgh EH4 – drop-kicked his mother’s cat in a fit of rage.

Thomas Gordon, who also uses the name Becca Gordon, was recorded on a neighbour’s CCTV viciously volleying the defenceless six-year-old cat, named Oreo, into a garden following a row with his mother in January 2021.

Gordon claimed he had kicked the cat after she bit him.

Shocking footage of the attack was posted to Facebook and soon went viral with animal lovers all over the world expressing their outrage at the mindless cruelty depicted. .

Gordon was later arrested and charged. In court on Tuesday 4 April 2023, he pleaded guilty to causing an animal unnecessary suffering.

The court viewed the 10 second video clip which showed Gordon picking the cat up then dropping her and kicking her on the body as she fell to the ground.

Fiscal depute Sarah Noon told the court that police and the Scottish SPCA were alerted to the footage after it was widely shared on Facebook and the accused was identified and apprehended .

During a police interview Gordon claimed the cat had bitten him and he had retaliated by kicking her.

Gordon’s lawyer told the court her client had suffered “a momentary loss of temper” following a row with his mother and lashed out at the animal.

She added: “Thankfully, there doesn’t seem to be any lasting damage.”

In addition to a small fine Gordon, who owns two cats and a dog with his girlfriend, was given a two-year ban on owning animals.

Sentencing | fined a total of £245 . Banned from keeping or owning animals for the next two years (expires April 2025).

CONVICTED (2022) | Mark McGregor, born c. 1988, of Langside Crescent, Polbeth, West Calder EH55 8UW – subjected a young dog to a series of savage beatings

McGregor left seven-month-old Staffy Murdo with ‘large, swollen lumps’ on his head following a string of brutal attacks which took place during 2021.

The thug was finally apprehended after witnesses spotted him ‘violently strike’ the dog in his back garden, and reported him to the Scottish SPCA.

On March 5, 2021, charity inspectors attended McGregor’s property to investigate the claims, which they described as ‘very graphic and serious in nature’.

Upon arrival, they found Murdo with serious head injuries and showing signs of previous beatings. The wounded pup also appeared terrified of McGregor – cowering and urinating on the floor whenever he approached him.

The dog was immediately seized from the property and rushed to a vet for examination where the extent of his injuries was uncovered.

McGregor pleaded guilty to striking his dog and was sentenced to a curfew and 10-year ban on owning animals.

Speaking about the SSPCA’s investigation Inspector Fiona Thorburn said: “When we attended McGregor’s home, it was immediately apparent that Murdo had a noticeable swelling on his head. He approached me wagging his tail and jumping up in a friendly manner but when McGregor approached him, he appeared scared. He cowered and urinated on the floor.

“I advised McGregor of my concerns for his dog Murdo’s welfare and that veterinary attention must be sought. Murdo was then removed under section 32 of the Animal Health and Welfare (Scotland) Act 2006 to be taken for a veterinary examination.

“The veterinary examination uncovered damage consistent with the traumatic injury reported to us by the witnesses, leaving Murdo with a large lump on his head.

Leith, Edinburgh: Chris Maginn

CONVICTED (2022) | Chris Maginn, born 30 August 1946, from Leith in Edinburgh but with strong links to Tarbert in Argyll – tormented and killed animals and also committed gross acts of sexual and physical child abuse.

In a years-long campaign of historic animal and child abuse Maginn, described on his various social media profiles as “an actor, educator, community worker and sculptor”, kicked pet cats, threw a kitten at a door and drove nails into a goat’s head. He also forced a girl to kill her pet gerbil with an axe.

Maginn also sexually abused a boy and a girl and mistreated them and another girl. He abused them mentally, leaving them scared, alarmed and anxious.

He denied doing anything wrong, forcing his victims, who are now adults, to give evidence against him in a trial at Dumbarton Sheriff Court. He was convicted of five charges spanning 1981 to 1987 and jailed for just three years.

He was also placed on the sex offenders’ register for the rest of his life.

Maginn began abusing the children in March 1981, at addresses in Argyll and Bute villages. He “wilfully ill-treated” the trio, assaulted the boy, sexually abused him, and sexually abused one girl.

He treated the “children in a manner likely to cause them unnecessary suffering or injury to health.”

The court heard he also attacked them, grabbing the boy and younger girl by the throat and pushing and throwing the boy about. He sexually abused the girl, making “inappropriate and sexual comments”, having sex in front of her and making her see him naked.

She was also assaulted by him in a swimming pool in Oban, Argyll and Bute, being held against a wall, and touched by him, with him pressing his body against her. She was also made to strip and wash in front of him, was stared at while she was naked, and was touched inappropriately, before he put cream on her body.

When she was older, he continued to make inappropriate and sexual comments, stripped in front of her and made her strip. He also told her to perform sex acts on herself, tried to make her bathe with him, touched her inappropriately, tried to get her to simulate breastfeeding another child, and kissed her.

He also repeatedly sexually abused the boy, when he was aged between 10 and 13, causing the youngster to see him naked, masturbating in front of him and offering him a semen sample to view under his microscope.

Maginn also beat the boy on a number of occasions, hitting him on the head and body, leaving him injured.
