Cowdenbeath, Fife: Arran Swift / Arran Adey

CONVICTED (2024) | serial domestic abuser and dangerous career criminal Arran Swift aka Arran Adey, born c. 1986, originally from Cowdenbeath, Fife but with links to the Lochend and Restalrig areas of Edinburgh and Cumbernauld in Glasgow – killed and mutilated a hamster with a hammer in a sick revenge attack against his partner.

The death of the little hamster, named Timmy, came to light after Swift sent the woman a chilling message, stating “Timmy isn’t going to survive”.

Police found the body of the animal, along with blood splatters where he had been thrown against a wall and a hammer covered in blood and hair.

The court heard that Swift carried out a litany of abuse after entering into a relationship with the woman in 2018 or 2019.

Fiscal depute Ronnie Hay detailed the abuse, including the destruction of the victim’s pet, committed after she took Swift back following a previous split.

He said: “The complainer felt sorry for him and invited him to stay with her.

“The accused’s behaviour did not vary – he began controlling what she was doing.

“He punched and kicked at walls and mirrors.

“They separated in September 2021 and she left her flat, leaving her pet hamster Timmy.

“Between September 6 and 16 telephone records showed 391 communications were made from his phone to her.

“These messages were also threatening – she received one saying ‘Timmy isn’t going to survive. Where are you?….bad move, goodbye’.”

Police went to the property and found evidence Swift was still living there – along with the grim discovery of the pet’s body.

Mr Hay continued: “They observed the deceased hamster, which appeared to have been struck off the wall.

“They contacted the SSPCA and an inspector attended and found the hamster and blood spatters on the wall.

“She saw a hammer with blood and hair on it.”

On an earlier occasion Swift trapped the woman inside her house, tied her hands together and followed her around the house – even watching as she used the toilet – and threatened to stab her.

On another occasion he hit her, resulting in her waking from unconsciousness in the bathroom.

After the woman left Swift initially, she found him inside her house.
Swift had taken some important items, including jewellery and photographs, telling her he had taken “things that matter to you”.

He invited her to a Travelodge in Edinburgh with the promise of returning the items.

She texted her mother asking her to call the police as she needed help, only for Swift to beat her with a gin bottle.

Other incidents included stealing a television that had been taken in by a neighbour following delivery, making threats to kill her former partner, sending her photos to suggest he was in her local area and he stated he had put cameras in her home.

Swift, a prisoner at Edinburgh, admitted engaging in a course of conduct abusive of a partner or ex-partner at addresses in Fife, Edinburgh and Cumbernauld between October 2020 and January 2022.

Swift’s heinous crimes were so serious the case was remitted to the High Court in Dundee.

Presiding judge Lord Arthurson ruled that Swift poses a significant threat to the public should he be released from custody.

He said reports showed that Swift had “sadistic” tendencies and scored highly on a test to assess psychopathic behaviour.

He said: “You demonstrated extreme violence, controlling and somewhat sadistic behaviour towards your victim. You have used different aliases in relationships.

“When you are heavily intoxicated and in a state of inebriation you have felt the overwhelming desire to inflict serious pain on others. You have shown a lack of empathy. You have shown no anxiety about the consequences. There is an extremely high likelihood of you committing other offences and you have the capacity to cause lethal harm.

“You scored highly on the assessment for psychopathy. The risk of harm posed by you has been persistent over time. You have been violent against strangers and intimate partners.

“You have found it impossible to take responsibility for your behaviour. You have had eight previous partners and have shown concerning behaviour towards seven of them.

“You have described your own fantasies about harming others in the past. You killed your victim’s pet animal and mutilated the body. You repeatedly threatened to kill your victim and her family and burn down her house. This was sustained, coercive and controlling behaviour over 16 months.”

Lord Arthurson said: “I have concluded that the nature, gravity and pattern of offending are such as to demonstrate that your liberty will endanger the lives of the public at large.”

Swift will initially serve three years and nine months in prison but will be subjected to a lifelong restriction order meaning that only the parole board can decide if Swift can be managed in the community.

Swift was also made subject to a lifelong non-harassment order.

The court was told that Swift was already subject to two other non-harassment orders, had served 19 previous prison terms and was on a community payback order at the time of the latest offence.

Sentencing | three years and nine months in jail. Order for Lifelong Restriction (OLR).

Motherwell, North Lanarkshire: Elisha Walker

CONVICTED (2023)| serial animal abuser Elisha Walker, born c. 1996, of 535 Merry Street, Motherwell ML1 4DA – repeatedly left her two cats unattended for days at a time and eventually abandoned them altogether.

Walker was given a small fine and pathetic and pointless TWO-year ban on keeping all animals following a Scottish SPCA investigation.

She pleaded guilty to failing to provide a suitable living environment or to make adequate provisions for her two cats, Minty a black and white female, and Hamish, a tabby and white male. She also pleaded guilty to causing unnecessary suffering to the cats.

Scottish SPCA inspector, Jack Marshall, said, “We first became aware of Elisha Walker on 3 September 2019, when concerns were raised that she had abandoned the property on Merry Street and left her cats behind.

“We were given access to the property by a housing officer and found that the three cats inside were in good condition. They had access to food but had run out of water.

“The property was in substandard condition and somewhat cluttered. The litter trays needed to be cleaned and there was a bin in the bathroom shut away from the cats which smelled foul due to festering meat in in the bottom of it.

“Provisions were made for the cats, the property was secured and a Scottish SPCA calling card taped to the door urging the owner to make contact urgently.

“The owner, identifying herself as Elisha Walker replied to the card a few hours later and we attended again the following day. The property had been partially cleaned and tidied but was not yet satisfactory. We issued Walker with an animal welfare notice for the rest of the property to be cleaned and tidied to an acceptable manner, and for the cats to be tended to at least twice daily to ensure their welfare needs were being met.

“We returned on 9 September 2019 to find that the conditions of the notice had been complied with and the property was now fully clean and tidy. We advised Walker that she must keep on top of the cleanliness of the property going forward.

“We were next contacted on 16 May 2021 due to concerns that cats in the property had once again been left unattended, this time for around four days.

“An inspector visited the property and found it to be unoccupied with a foul smell emanating from it. We taped the doors to see if anyone was attending the cats and continued to visit over the next few days, supplying them with wet food through the letterbox. During this time the tape remained unbroken.

“On 19 May we were able to gain entry to the property and found two cats, Minty and Hamish, inside. The premises were in very poor condition with household rubbish, clutter and cat faeces strewn throughout. There was no food or water present for the cats and the litter trays were full of faeces.

“Some of the rubbish showed evidence that the cats had been chewing and clawing at it looking for food.

“We immediately removed both cats from the property took them to be seen by a vet.

“On veterinary examination, both cats were found to be dehydrated and in lean body condition. They had undoubtedly been caused unnecessary suffering due to being left alone without suitable food and water.

“We returned to the property on 20 May, as we had left a humane cat trap in case any of Walker’s other cats were present at the property. While we were there Elisha Walker arrived in a taxi.

“When questioned about the incident she stated she had been unwell and staying at her partner’s address and a friend had agreed to care for the cats. However, she was unable to provide any contact details for the person she named.

“Although we are glad she received a ban, we would have liked it to have been for a longer period of time. Walker has never offered any reasonable explanation as to why Minty and Hamish were left in such conditions, which resulted directly from her failure to attend regularly and maintain a suitable living environment for the cats.

“The situation overall was completely unacceptable and caused the cats considerable suffering. This was further compounded by the terrible living conditions within the property and the fact that Walker was previously given an animal welfare notice for similar issues, yet allowed them to not only reoccur but deteriorate.”

Sentencing | fined £270 and banned from keeping animals for two years (expires November 2025).

Coatbridge, North Lanarkshire: Patrick-Michael McCluskey

CONVICTED (2023) | Patrick-Michael McCluskey, born 1 June 2004, of 9 Selkirk Way, Coatbridge ML5 4TN – kept dogs and cats in a home full of household waste, clutter and animal faeces.

Teenage animal abuser Patrick-Michael McCluskey who goes by the name PM McCluskey ignored repeated warnings from the Scottish SPCA over the atrocious conditions in which he kept dogs and cats. Despite living at the same address, Sylvia McCluskey, aka Sylvia McNicoll had her not guilty plea accepted by the court.

McCluskey pleaded guilty to failing to provide a clean and safe environment for two dogs in his care, but walked free from court with an admonishment. He wasn’t even banned from owning animals.

A not guilty plea was accepted for the teenager’s mother, Sylvia Claire McCluskey, born 25 November 1963, and of the same address..

Scottish SPCA inspector, Jack Marshall, said, “We had attended the address on Selkirk Way on several occasions between October 2017 and May 2022.

“We provided Patrick-Michael McCluskey with advice and support on how to care for his animals but unfortunately the conditions at the property continued to deteriorate. We removed several dogs and cats from his care during this period.

“A previous report to the fiscal in May 2021 resulted in a fiscal’s warning being issued about the conditions animals were being kept in on the premises.

“In September 2022 we received a call from Police Scotland who had attended Selkirk Way on an unrelated matter and become extremely concerned due to conditions at the property.

“We gained a warrant to enter the address and this was conducted on 14 September 2022.

“On entering the property we found it was full of household waste, clutter and animal faeces.

“There were two one-year-old dogs at the property, a poodle-type dog named Lady and a husky named Lola.

“Due to concerns for their welfare they were immediately removed from the address and taken for veterinary examination.

“It’s disappointing that this case has only resulted in an admonishment as any responsible owner would have been able to see that the conditions within the property were far from suitable for any person, let alone an animal, to have to endure.”

CONVICTED (2023) | Allan Graham, born February 1992, of Muirhouse Avenue, Newmains, Wishaw ML2 9NF – left his elderly dog starving and drinking out of a green algae-covered water bowl.

Cruel Allan Graham received a two-year ban after his dog was found underweight with a foul-smelling coat covered in dandruff.

Graham pleaded guilty to animal cruelty charges at Hamilton Sheriff Court on 2 August 2023. The charges were in relation to a Staffy/English bull terrier crossbreed named Bruiser.

Scottish SPCA chief inspector Heather Lawson said “We attended a property on Muirhouse Avenue, Newmains, Wishaw on 14 August 2020 following a complaint to our animal helpline.

“The caller reported that there was a dog within the property who was in extremely poor body condition.

“Inside the premises we found a male, Staffordshire bull terrier cross English bull terrier type dog, known as Bruiser, in extremely poor condition. All his ribs, spine and hip bones were prominent. He had a hunched posture and a very quiet demeanour.

“There was a large bowl of water on the floor which was coloured green with algae. Allan Graham stated that the dog drank an excessive amount of water and to save him having to refill it he provided a larger bowl.

“He admitted that Bruiser was underweight and claimed he had been trying to feed him up by giving him pasta in addition to his normal dog food.

“Due to concerns for Bruiser’s welfare we removed him from the property and took him to a veterinary surgeon for examination.

“Bruiser was found to weigh 13.8kg with loss of muscle mass, especially over his hindquarters. The harness he was wearing was too big, suggesting he had lost a significant amount of weight since it was fitted. The normal weight for a dog of his breed would be between 18kg and 20kg.

“Bruiser’s coat was also in poor condition with a foul smell and quantity of dandruff.

“No clinical reason could be found for his weight loss and it was determined it was most likely due to a poor diet rather than an underlying medical condition.

“Bruiser soon regained weight in the care of one of our animal rescue and rehoming centres on a normal diet of commercially available dog food.

“We’re pleased Graham received a ban as, although he seemed to be aware that Bruiser was clearly in poor condition, he did nothing to resolve the situation.

“Bruiser’s suffering could easily have been alleviated through providing him with the correct nutrition.”

Sentencing | £450 fine. A two-year ban on owning dogs (expires August 2025)..

Newmains, North Lanarkshire: Grant and David Campbell

CONVICTED (2023) | hillbilly brothers Grant Stuart Campbell and David Campbell of 74 Woodside Crescent, Newmains, Wishaw ML2 9NA – for appalling cruelty to multiple dogs in their care.

Self-styled ‘rat-catcher‘ Grant Campbell pleaded guilty to seven charges of causing unnecessary suffering by failing to provide veterinary treatment for various conditions and injuries affecting six dogs in his care, including a broken leg.

His brother David Campbell pleaded guilty to one charge of failing to provide a suitable environment for two of the dogs and failing to keep them free from suffering, injury or disease as their clinical condition strongly displayed signs of neglect and failure to seek veterinary care.

Scottish SPCA inspector, Dawn Murrie, said: “We had several dealings with Grant and David Campbell from March 2021 in regard to the conditions dogs were being kept in and traps Grant Campbell had around the Newmains area.

“Advice was given on the conditions the dogs were being kept in on several occasions and we issued an animal welfare notice that the Campbells complied with. Advice was also given to Grant Campbell on the operation of his traps and the requirements for their appropriate use.

Tara’s painful arthritis went untreated by her heartless owners

“On 19 October 2021 we received another complaint to our animal helpline about the conditions at the property.

“We attended and it was immediately clear that there were issues throughout. There was a strong foul odour as we entered, and the pathway into the garden and dog kennels was covered in faeces, hazards and rubbish.

“The kennels themselves were full of urine and faeces with a complete lack of suitable, dry bedding available for the dogs.

“One kennel was so full of faeces that no part of the flooring was visible. The door to this kennel was closed over and, at first, we assumed this to be a dumping ground for all of the faeces accumulated from the other dogs. Further examination revealed two large, adult deerhound type dogs, lying in the back compartment of the kennel.

“We had immediate concerns for the welfare of all of the animals on the premises and removed them for veterinary examination.

“Lass, one of the deerhounds, was found to have pressure sores and a fracture in her leg that the vet estimated would have been present for around three to four weeks. The break had been left untreated for so long that she had to have her leg amputated.

“Boy, another deerhound, only had three legs and was suffering from a displaced toe. Not only would this have caused him pain but the extra stress on them due to his missing leg would have been more than a normal limb usually supports.

“Gibbs, a pug, was suffering from a severe bacterial skin infection. Pinky, another pug, had an extremely infected and swollen toe.

“Tara, a Staffordshire bull terrier, and Buffy, a lurcher, were found to have arthritis, an extremely painful condition when left untreated.

“All of the dogs were suffering from dental disease to some extent.

“We are pleased that both brothers have received bans on keeping animals.”

Sentencing |

Grant Campbell: two year supervision order and six month restriction of liberty order. Banned from keeping any animal indefinitely.

David Campbell: community payback order of 300 hours to be completed over three years. Banned from keeping any animal for five years (expires July 2028).

Airdrie, North Lanarkshire: Andrew Kirkland

CONVICTED (2022) | Andrew Dean Kirkland, born July 1990, of Thornlea Gardens, Airdrie ML6 6HW – illegally cropped the ears of his American bully pup, Kane.

Kirkland, company director of Cranium Ink Ltd, admitted causing unnecessary suffering through failing to provide veterinary treatment for injuries caused by a prohibited procedure.

A Scottish SPCA special investigations unit inspector involved in the case said “We attended a premises in Airdrie on 30 April 2021 and found Kane, an American bully puppy aged between five and six months, at the property with cropped ears.

“We immediately removed the dog due to concerns for his welfare and took him to a veterinary surgery. He was examined and it was determined the ear cropping would have taken place more than three weeks prior. Three quarters of both of the flaps on his ears had been removed and there were dimples either side of the wound consistent with the placement of suture material.

“This illegal procedure would have caused Kane considerable pain and discomfort for purely cosmetic reasons.

“At first, Kirkland tried to claim that the dog had been imported from Bulgaria with cropped ears but we know this not to be the case. We also found several photos on Kirkland’s mobile phone showing both Kane as a puppy with intact ears and with fresh wounds from the procedure while in his care.

“When confronted with this evidence Kirkland said he thought ear cropping was legal and had been told it would make his dog less aggressive and stop him fighting with other dogs.

“In the UK, as ear cropping is a prohibited procedure, any operation is unlikely to be carried out with appropriate anaesthetic or pain relief. Kirkland has allowed this to be carried out to a defenceless young dog, undoubtedly causing significant unnecessary suffering, with no regard for the pain and discomfort this would ultimately cause Kane.

“We are pleased that Kirkland has been given a ban but, given that he has shown a premeditated willingness to compromise welfare for a purely cosmetic reason, we would have liked it to be for a longer period of time.”

Sentencing | 190-hour Community Payback Order; 12 month ban on owning, keeping or working with animals.

Chapelhall, North Lanarkshire: Patricia O’Donnell and Bryan Smith

CONVICTED (2022) | Patricia O’Donnell aka Claire O’Donnell, born 29 December 1987, and fiancé Bryan Smith, born 9 November 1982, both of Kennelburn Road, Chapelhall, near Airdrie ML6 8TG – left their pet Labrador to waste away to ‘skin and bones’ and failed to treat their elderly shih-tzu’s serious health conditions.

Animal abusers: In an outrageous decision by the Scottish court neither Smith nor O’Donnell were banned from owning animals and the pair already have a new puppy

O’Donnell and Smith, who are parents, were responsible for two dogs, one of whom was found to be severely emaciated and the other gravely ill when Scottish SPCA workers attended their home in April 2021.

Smith pleaded guilty to failing to provide a nutritionally adequate diet for Romanian rescue dog Luna, who was extremely underweight with her hips, spine and ribs prominently protruding through her skin.. She was extremely timid and cowered when approached.

Romanian rescue Luna was severely emaciated and extremely nervous around people. She quickly put on weight in the SSPCA’s care and went on to be rehomed.

O’Donnell pleaded guilty to failing to provide veterinary treatment to her elderly dog, Millie. She was suffering from dental disease and her ears were full of tumours. Very sadly, she had to be euthanised to end her extreme suffering.

O’Donnell received a £250 fine, while Smith received a 12-month supervision order and 75 hours unpaid work. Neither owner was banned from keeping animals.

John Chisholm Scottish SPCA chief inspector, said: “We attended the property in April 2021 following complaints to our animal helpline of dog neglect.

“The reports described a Labrador cross type dog at the property who was extremely underweight and would often cower away. The dog was described by one caller as ‘skin and bone’ with their back end protruding.

“O’Donnell explained that her Labrador cross, Luna, was a Romanian rescue and they were working hard to get her to a healthy weight.

“Upon seeing Luna we were immediately concerned as she was severely emaciated, with her hips, spine and ribs prominently protruding.

“O’Donnell claimed that Luna had been seen by a vet and they had been given dietary advice. However, she could not recall any information regarding this. She also changed her story around this multiple times.

“Concern grew for Millie’s welfare and O’Donnell was cautioned.”

Inspector Chisholm continued: “Millie was scruffy in appearance and had areas of matted and tangled fur to her underside and around her ears.

“Concern grew for Millie’s ears and she was given a general anaesthetic in order to examine them fully.

“Once a large volume of thick black wax was removed, the procedure revealed Millie’s ears were full of tumours.

“Veterinary professionals advised her prognosis for recovery was poor, but she could be made comfortable with medication for the time being. She had not been treated for this previously, and was undoubtedly caused suffering.”

The charity have now hit out at what they consider a lenient punishment for the couple, and have expressed their frustration that the pair were not banned from keeping animals.

Inspector Chisholm added: “Both dogs were taken in to our care and Millie was sadly put to sleep on veterinary advice due to underlying health conditions.

“Luna made a full recovery and has been rehomed to a loving home.

“It is extremely disappointing that considering the amount of suffering that was caused to Millie and Luna, a harsher sentencing was not given.

“O’Donnell and Smith have clearly shown that they were not able to provide their animals with the care they needed, and we would have hoped this to be reflected in a ban on owning or keeping animals.”

Cumbernauld, North Lanarkshire: Yvonne Williams

CONVICTED (2022) | Yvonne Williams aka Yvonne Conroy, born 6 May 1971, of 372 Millcroft Road, Cumbernauld, Glasgow G67 2QW – failed to provide veterinary treatment or pain relief for her pet dog.

Williams failed to get veterinary treatment for her pet dog’s swollen, bleeding ear. The dog, Aria, was put to sleep on welfare grounds.

The mother of four also admitted to a further charge of failing to protect her two cats, Ginger and Bandit, from suffering, injury and disease.

Aria was put to sleep due to the severity of the ear condition after the Scottish SPCA attended the property and found her in significant distress.

Scottish SPCA chief inspector, John Chisholm, said: “On 31 March 2021, we attended Williams’ property in response to a complaint of dog neglect made to our helpline.

“It was reported that Aria had a swollen, bleeding ear and had not received any veterinary treatment. Further concerns were raised about the living conditions within the property and that a number of cats had fleas.

“We have received a number of complaints regarding animals at the property, dating back to 2017. Advice and subsequent follow up visits have been given to Williams over the last four years.

“In 2019 we agreed to take one of her dogs in to our care as she could not cope with two big dogs. Williams was strongly advised not to take on any more animals.

“When we visited the property in 2020 we were immediately concerned for Aria’s welfare as she was obviously suffering from a painful ear condition. Williams was issued an animal welfare notice to take Aria for vet treatment with which she complied. She was also advised to follow all veterinary treatment plans to which she agreed.

“At the most recent visit it was confirmed that Aria was again suffering with her ears, and Williams had not taken her to the vets since March 2020.

“Aria was visibly distressed and constantly clawing and scratching at both ears. Her left ear in particular was swollen and solid to the touch. The inside of the ear appeared to be completely blocked with thickened skin.

“Aria was taken for immediate veterinary attention. The vet described her condition as the worst ear condition they had seen in their career, confirming that Aria had experienced prolonged unnecessary suffering over a number of months.

“Due to the severity of Aria’s ear condition and the irreversible nature of the damage to her ear canals, she was put to sleep on veterinary advice to end her suffering.”

Although she was advised not to adopt any more animals, the Scottish SPCA discovered that she now had four cats and refused to allow inspectors entry to her property.

“Williams was uncooperative in relation to her cats and it became apparent that she now had four cats, despite being advised not to take on any more animals.

“Williams eventually agreed to hand over her cats for examination, but would not allow entry in to the property to inspect living conditions.

“Ginger and Bandit were taken to one of our centres and both were found to be suffering from heavy flea infestations and needed dental surgery to fix dental disease and inflamed gums. Both cats were also underweight.

“They have now received the treatment they need, but have remained in our care as Williams refused to sign them over meaning we were not able to rehome them.

“We are pleased Williams has pled guilty and received a five-year ban and community payback order. Now that the case has concluded we will finally be able to find Ginger and Bandit the loving homes they deserve.

“Aria was caused a seriously unnecessary amount of suffering and distress despite continued advice. Her condition could have been completely treatable had Williams provided her with the care she needed.”

Wishaw, North Lanarkshire: Jordan Edment

CONVICTED (2021) | Jordan Robert Edment (aka Jordan McQuade) , born 10 May 2000, of 38 Kilmeny Crescent, Wishaw ML2 8QS – left one dog in his care to starve to death and another to become severely malnourished.

Jordan Edment severely neglected his Pakistani Mastiff and failed to take the emaciated pup to the vet.

Edment’s two-year-old Pakistani mastiff, known as Rumple, had to be put to sleep after being found in extremely poor health, while a second dog was five kilos underweight.

The thug pleaded guilty to failing to animal cruelty offences relating to Rumple and a second dog named Butch.

Rumple was found in a dire condition, weighing just 40kg with his ribcage and hip bones clearly visible.

Scottish SPCA Inspector Heather Lawson said, “On November 7, 2019, we attended Edment’s property following a complaint of dog neglect to our helpline by Police Scotland, who had attended regarding a separate matter.

“They detailed how concerned they were for a dog they had met at the property who was skin and bones, and another who was underweight.

The young dog had to be put down after not responding to veterinary treatment. 

“When we attended, we found Rumple to be in extremely poor health. All his ribs, spine, and hip bones were prominent and he had a hunched posture.

“The second canine, a Johnston’s bull dog type named Butch, was very lean. Both dogs were friendly and very excitable.

“When given a drink of water, both dogs drank vigorously and emptied the entire bowl.

“It was further discovered that neither of the dogs were receiving any current veterinary treatment.

“We seized both dogs and took them for the immediate veterinary attention they desperately needed.

“Upon examination, Rumple was in an emaciated condition and was malnourished. He weighed 39.3kg and should easily be eight to ten kilograms heavier than this.

“He had a faster than normal heart rate suggesting he was dehydrated, had trouble using all four of his limbs correctly and an altered gait.

“Rumple was caused unnecessary suffering because of Edment failing to seek veterinary care, and a lack of nutrition.

“Butch was found to be around four to five kilograms underweight.

“Both dogs were taken to one of our centres to receive the proper care and ongoing treatment they needed.

“Sadly, Rumple’s condition deteriorated and the heart breaking decision was made to put him to sleep on welfare grounds.

“Butch is still in the care of one of our centres, and this sentencing means we can now find him the loving forever home he deserves.”

Sentencing: 10-year ban on owning animals. Deprivation order on Butch.

Newarthill, North Lanarkshire: Stephen Smith

CONVICTED (2020) | Stephen Smith, born c. 1977, formerly of High Street, Newarthill – failed to feed his pet cat for two months

Stephen Smith failed to provide his cat, Molly, with a safe, clean living environment and also failed to provide an adequate diet between April and June 2020.

This sadly resulted in Molly suffering severe organ failure due to malnutrition which resulted in her death.

Scottish SPCA inspector Dawn Robertson said the living conditions were some of the worst she had ever encountered.

She said: “A call came in to our animal helpline reporting welfare concerns about a cat, who we later found out was Molly, in Smith’s property. The caller told us that Smith left Molly in the property for long periods.

“We attended the address and found nobody to be home. We had immediate concerns due to the strong smell coming from inside the property. We returned the following day and were again met with no response.

“Working on intelligence, we obtained the address of where Smith was staying and found him there. Smith agreed to allow us entry to his home on the High Street where he had left Molly.

“Upon entering the house there was an overwhelming stench of ammonia and faeces.

“The property was in an appalling state. The floor wasn’t visible due to rubbish, damaged furniture and appliances throughout. There was faeces and dirt everywhere. It was no place for a human or animal.”

“There was only one litter tray in the property and was overflowing. The bathroom was covered in faeces and it would appear this is where Molly had been toileting.

“There was no sign of Molly in the house. Smith claimed she had been missing since June 25.”

Inspector Robertson added: “After a thorough search of the property, Molly’s extremely thin, malnourished body was discovered under a bed in the bedroom.

“A post-mortem found that Molly suffered organ failure due to severe malnutrition. It would have taken at least two months for her to come to be in this condition.

“Upon questioning, Smith said that he had not been living in the property but returned to feed Molly every few days. Due to the extent of Molly’s condition, we believe that Molly had not been fed at all over the two-month period.

“Molly would have been caused to suffer considerably in becoming this thin and living in the awful conditions at Smith’s property.

“We believe that any conviction is a success but we are disappointed with the sentence Smith received. We were hoping for a sentence that reflected the level of neglect in this case.

“Molly’s death was entirely avoidable if Smith had provided her with even the most basic of care. She suffered directly due to Smith’s actions and he is ultimately responsible for her death.

“We hope Smith will carefully consider his ability to look after any animal in the future.”

Sentencing: fined £420 and banned from keeping cats for ONE year (expired December 2021).
