The tiny seven-month-old pug, called Capri, was discovered with severe burns to her face, mouth and tongue after Giyo doused her with boiling water. She had also suffered trauma to her head. In addition, X-rays showed that she had a fracture to her right leg and healed pelvic fractures from older injuries.

The puppy was first taken to a vets in Chatham with swelling to her head believed to have been caused by trauma. A few weeks later she was back at the vets, this time with burns and injuries to her face, mouth and tongue. The RSPCA was then alerted.

The vet said in a witness statement: “Capri presented with massive burns over her face and nek. Her tongue was swollen to three times its size and sloughing.

“The substance she had been burned with also affected her left eye”.

In a court statement RSPCA Inspector Kirsten Ormerod, who investigated for the animal charity, said Capri’s owner claimed to have left her in the care of flatmate Giyo for around four hours while she went out shopping.

Inspector Ormerod added: “She stated that on her return at 6:30pm Capri had a sore face.

“She stated Giyo had wiped Capri’s face with an exfoliating glove but quite quickly Capri’s face started to swell and she was struggling to breathe so she took Capri to the emergency vet.

“She had red, open wounds to her face, nose and around her mouth. Her tongue appeared very swollen and she was not able to close her mouth due to her swollen tongue.

“She was also audibly breathing loudly and appeared lame on her back right leg and was very reluctant to put weight on it.”

Capri’s owner told Inspector Ormerod she’d informed police and had asked Giyo to leave the property, but was able to provide a contact telephone number for him.

The vet’s witness statement added: “Nobody was willing to tell us what substance Capri had been burned with. [Giyo] said he gave her a bath and used an exfoliating glove on her which didn’t add up to the severity of the injuries she presented with.

“While she was under anaesthetic for an endoscopy, she was also x-rayed. The x-rays showed a fracture of the right [leg]. The x-rays also showed healed pelvic fractures from older injuries.”

Speaking about Capri’s first stint in hospital, the vet said: “She was really calm and relaxed around females but shrank away and trembled in the presence of a male vet.

“She was absolutely terrified of males in hospital to the point where only females could handle her without stressing her out.”

When a feeding tube was fitted to help the puppy, it was later suggested that the burns had been caused by boiling water.

Two weeks after she was first admitted, Capri began eating on her own and her injuries started to improve.

In January 2023, she had surgery for her leg fracture and was moved to an RSPCA rehoming centre to recover.

She was later adopted by one of the vet nurses who saved her life.

In court Giyo, an inspiring rapper who came to the UK from Pretoria in South Africa, pleaded guilty to two offences under the Animal Welfare Act.

Giyo, who according to his LinkedIn profile works in network support for internet service provider Trooli, told the court that Capri’s injuries had been caused accidentally and denied having intentionally harmed the puppy,

Newport, South Wales: Troy Bowyer and Sam Hudacek

CONVICTED (2024) | prolific backyard extreme bully breeder Troy Eric Bowyer, born January 1992, of 5 Aberthaw Drive, Alway, Newport NP19 9QB* and Sam Hudacek, born c. 1999, of Albert Avenue, Maindee, Newport NP19 8FF – filmed themselves trying to artificially inseminate a pet dog.

The men were described in court as making a “crude and amateurish” attempt to inseminate a dog. A judge said when he first saw the footage he thought it showed “some sort of sexual perversion”.

The attempts of Troy Bowyer, who bred and sold cropped-eared bull-breed dogs under the name ‘One Hunna Bullys’, and Hudacek to impregnate the latter’s dog came to light after police executed a drugs search warrant and found the video on a mobile phone. The phone also showed Hudacek had been involved in dealing cocaine.

The video showed a female bull dog standing on her front legs with her back legs being held up and Bowyer moving his fingers in and out of the dog. A syringe could also be seen in the footage.

The court heard the footage was being shot by Hudacek and he could be heard laughing and giving Bowyer “encouragement” to carry on.

The court heard the footage appeared to show “some kind of artificial insemination” of the bitch.

When interviewed about the video footage Hudacek answered “no comment” to all questions asked while Bowyer accepted it was him on the footage but denied causing the dog unnecessary suffering.

Hudacek pleaded guilty to being concerned in the supply of cocaine and to causing unnecessary suffering to a protected animal, while Bowyer pleaded guilty to causing unnecessary suffering to a protected animal.

Defence counsel for Hudacek said the defendant had moved to the UK from Slovakia as a 12-year-old boy and initially struggled at school in Newport as he could not speak English. When his parents later returned home, however, he decided to stay in Wales. He said “there are people who think he is capable of a lot more” and said the defendant wants to support his partner and be a better role model. He said his client’s role in the animal offence had been “peripheral”.

Counsel for Bowyer, who is no stranger to the Welsh courts, said the dog belonged to the co-defendant Hudacek and his client had been “asked to assist with the artificial insemination”.

He said Bowyer had a long-term partner of 18 years with whom he had two children with a third was on the way, although the couple did not actually live together.

Judge Simon Mills described the matters involving the dog as “frankly unpleasant”, and said when he first saw the footage he “thought there was some sort of sexual perversion going on” but in reality it was a “crude and amateurish attempt at artificial insemination” which would have caused the dog considerable discomfort.

Scunthorpe, North Lincolnshire: Bogdan Gruia

CONVICTED (2024) | Bogdan Gruia (aka Bogdan Gruya), born 28 June 1990, of 178 Frodingham Road, Scunthorpe DN15 7NN – part of a group of men that stole a pregnant ewe from a farm, slit her throat and left her to bleed to death.

Prosecution of Roma gypsy Bogdan Gruia of Scunthorpe, North Lincolnshire, who was part of a gang that stole a pregnant sheep and illegally slaughtered her.

Roma gypsy Gruia, who came to the UK from Craiova in Romania, indicated a plea of guilty to aiding and abetting “a person unknown” to cause unnecessary suffering to a protected animal by cutting her throat and leaving her to bleed to death.

The remains of the sheep and her unborn lambs were found in an alleyway near premises in the control of Gruia, a garage owner who gave the court an alternative address of Digby Street in, Scunthorpe

The sheep had been stolen from a farm near Epworth, and subsequently slaughtered in an inhumane manner.

Gruia was found not guilty of handling stolen goods.

A second man called Elvis Anghel, born c. 2002, of Church Lane, Scunthorpe DN15 7HD, was charged in relation to the same incident but the outcome of the case against him is not yet known.

Three other suspects are still being sought by Humberside Police who have released images of them.

Speaking after Gruia’s conviction, PC Grant of Humberside Police’s Rural Task Force said: “This is the first conviction for an incident relating to the theft of sheep in the North Lincolnshire area since it became a local problem in 2018.

“Operation Bo Peep has been running since 2021 to tackle this issue and has, over the last three years, reduced sheep theft by 80%.

“I hope this conviction gives the farming community confidence that the police take this matter seriously and will bring offenders to justice.

“Three suspects for this incident are still outstanding, so I appeal to the public again to identify them.

Stanhope, Kent: Edith Nixon

CONVICTED (2024) | illegal dog breeder Edith Nishanthy Nixon of Monkton Close, Stanhope, Ashford TN23 5ET – neglected multiple puppies in her care, leading to many dying through malnourishment.

Local authority prosecution of illegal dog breeder and dog abuser Edith Nishanty Nixon from Stanhope, Ashford, Kent.

Nixon was prosecuted under the Animal Welfare Act 2006 for illegally breeding dogs. The case was brought by Ashford Borough Council.

She was responsible for breeding at least 10 litters of Pomeranian pups between 2020 and 2022 without holding an animal activity licence for dog breeding.

She advertised her dogs through social media and also placed adverts on classified site Freeads.

After receiving a complaint from a buyer of one of the dogs, the council carried out an investigation.

Nixon admitted that a number of puppies had died due to a lack of milk, and demonstrated a lack of basic care or knowledge which could have prevented the suffering and deaths of the pups.

She failed to act promptly when the pups were first noted to be subdued and lethargic, with a lack of understanding of how to tell if pups were dehydrated.

There was also no process in place to monitor the pups’ healthy growth and food intake through regular weighing.

On 13 March 2024, Nixon pleaded guilty to the offences at Folkestone Magistrates Court.

Cllr Liz Wright, Cabinet Member for Communities and Health, said: “This case sends out a clear message that the council will not tolerate the flouting of licensing laws that regulate this sector.

“The checks, inspections, and monitoring associated with licensing help to ensure that premises are suitable for dog breeding, that the licensee is competent, and that the welfare of the dogs and pups is not compromised through the breeding activity.

“It also acts to give buyers confidence that the pets they purchase come from a reputable breeder, who is subject to routine and unannounced inspection.”

“Sadly, some breeders do not prioritise the health and welfare of their dogs, and unsuspecting members of the public unknowingly buy puppies who are sick.

“We’d urge anyone who is thinking of getting a dog to consider taking on a rescue instead of buying a puppy. Anyone who is looking for a puppy can use The Puppy Contract to help them buy a happy, healthy dog.”

Tong, City of Bradford: Diana Kierpacz

CONVICTED (2024) | Diana Kierpacz, born 9 November 1997, of Kennerleigh Walk, Tong, Bradford BD4 0NS – kept an emaciated dog tied up in a rubbish-strewn yard.

The two-year-old Staffordshire bull terrier, known as Brenda, was so emaciated her ribs, spine and hip bones were visible. She appeared timid and nervous.

The dog, who had given birth seven weeks earlier, was found tied up in a faeces and rubbish filled yard with no access to food, water or shelter.

She also had a painful long-standing eye condition and was severely underweight, with a vet giving her a body condition score of just one out of nine

Diana Kierpacz, a Roma gypsy originating from Poland, pleaded guilty to causing unnecessary suffering to Brenda and failing to meet her needs following a prosecution by the RSPCA.

RSPCA inspector Demi Hodby had visited the house to investigate a report of concern over the welfare of a dog kept there.

In written evidence, Inspector Hodby said: “The dog looked to have recently given birth but there were no signs of the puppies. She had no access to water, shelter or food and her eyes were sunken into her head.

“All of the dog’s ribs were visible as well as her spine and hip bones.

“The dog was tethered to a fence using an extendable lead. The lead was tied to a piece of rope which was then attached to the dog’s collar. She was able to walk around but I was concerned she could injure herself as the tether was inappropriate.”

The court heard Kierpacz then appeared at the property and told inspector Hodby that Brenda was only outside for short periods and had access to water, despite none being present.

Kierpacz was told that Brenda’s living conditions were unacceptable and she was taken to the RSPCA’s Greater Manchester Animal Hospital.

She was examined by a vet who told the court in written evidence that the main concerns were her chronic entropion (eye condition ) and her thin body condition.

The vet said: “The most likely cause of this thin state was the increased nutritional demands of pregnancy followed by lactation which in particular is very energy demanding, requiring the animal to consume approximately three times the amount of calories and other nutrients than normal.

“In addition, the choke chain collar and height from which the dog was tethered gave a high risk of injury by choking or strangling if she tried to get away, was fleeing danger or chasing something.”

When asked about the circumstances in which her dog was found, Kierpacz said she had left Brenda there for one hour while she went shopping and she’d been tethered outside so she could “enjoy the weather.”

She said she didn’t feel the way the dog was found tied up compromised her health or welfare and claimed that water had been provided which Brenda must have drunk.

She said she’d been aware of the entropion but had not re-presented her pet for veterinary treatment for 18 months.

Kierpacz said she was not a breeder and Brenda had mated accidentally with a friend’s dog.

Brenda had surgery for her long-standing eye condition and was also neutered. She has since been re-homed.

Other dogs owned by Kierpacz will also now be rehomed.

Magistrates said Brenda had been found in a “very neglected and emaciated state and there was clear evidence that this offending has gone on for a long time”.

Despite this, they only gave Kierpacz a one-year ban. This seems to have been her sole punishment.

Goole, East Riding of Yorkshire: Viktorija Elksnite

CONVICTED (2023) | Viktorija Elksnite, born 9 May 2001, of Morley Street, Goole DN14 5TR* – left her two cats without food or water for several days at a time.

Latvian national Elksnite pleaded guilty to two charges under the Animal Welfare Act 2006 in relation to cats Bellis and Minnie.

The court was told she left the felines unattended over a number of days without food and water. Bellis was found very underweight and dehydrated, while Minnie was also underweight when the RSPCA gained entry to her property in December 2022.

Elksnite had received previous RSPCA warnings about leaving her pets unattended but when RSPCA animal rescue officer Olivia Farrar visited her home on a follow-up visit on November 28, 2022, the defendant was out and Bellis was clawing at the window in a distressed state.

The animal rescue officer made several more visits to the property, but on each occasion Elksnite had left the cats unattended.

RSPCA inspector Tom Hutton, who had made two previous visits to check on the welfare of the cats, returned with the police and a council officer to gain access on December 14

He found Bellis in a faeces-strewn living room in which there were two empty bowls, while Minnie was in the kitchen where again there was no sign of food or water, but a litter tray full of faeces.

The inspector said in a statement presented to the court: “Bellis was bright, active and alert but in a poor body condition in a living room in which there were two bowls but neither had any food or water in them. In the kitchen was the small female cat, Minnie, who was also in poor body condition.

The inspector took the cats to a local veterinary practice for treatment.

A vet, who examined both cats, said in his expert report that Bellis was emaciated with a body condition score of two out of nine and was also very dehydrated. Minnie scored four out of nine on the body condition chart.

In mitigation, the court was told that Elksnite was remorseful and was living a “chaotic lifestyle” at the time of the offences, but had now left an abusive relationship. She was staying at addresses in Goole and Bridlington, where she was working, and thought she had made “appropriate arrangements” for the care of her cats when she was away.

Both Bellis and Minnie were signed over into the care of the RSPCA and have recovered from their ordeal. The animal charity will now look to rehome both of them.

Tottenham, North London: Tiago Da Silva

CONVICTED (2023) | Tiago Da Silva, born c. 1995, of Steele Road, Tottenham, London N7 – battered a bull mastiff puppy to death and lied that she had drowned in the shower.

Brazilian national Tiago Da Silva was banned from owning pets indefinitely after an RSPCA investigation revealed his eight-month-old dog, Diva, had died from horrifying injuries.

Da Silva, previously of Seven Sisters Road, Islington, had claimed the puppy must have fallen and blocked the drain – but a post mortem revealed she died of internal bleeding from a blow to the liver, with other bruising and bleeding on her body.

The thug was found guilty at Willesden Magistrates Court on December 5, 2023, of failing to protect Diva from injury, despite his denials.

Diva’s limp body was taken to a vet on January 24, but she died despite attempts to resuscitate her.

Da Silva told vets he had put her in the shower after she defecated in his house and he thought she must have fallen and blocked the drain.

But assessments revealed bruising in her left ear, signs of recent haemorrhaging around the left eye, and marks on her lips.

The vet called the RSPCA.

Inspector Shahnaz Ahmad led the investigation and asked an expert vet to examine Diva’s body and decide if she had suffered.

The vet’s report said a post mortem found Diva had died as a consequence of “significant blood loss” into the abdominal cavity as a result of physical damage to the liver.

This was consistent with “blunt force trauma”, with further evidence of blows at the back of the skull and the chest.

It added: “The post mortem findings do not support death by drowning and it is difficult to explain how a dog may have sustained multiple blunt force trauma injuries while in the home environment accidentally while being showered by her owner.

“The suspicion of non-accidental injury (physical abuse) is raised.”

The report concluded that Da Silva had not protected Diva from injury, and that she may have suffered pain and distress as a result of trauma to her abdomen.

In mitigation, Da Silva said his failure to meet welfare needs was not intended and he denied that the injuries were caused by blunt force trauma.

Following sentencing, Inspector Shahnaz Ahmad said: “We are grateful to the vet for reporting this incident to us. If they hadn’t we would have never found out that an offence had been committed.

“We always encourage vets to report suspected animal abuse cases to us so that we can investigate and where necessary, pursue a prosecution.”

Sentencing | 20-week suspended jail sentence; 150 hours of unpaid work; victim surcharge of £114. Indefinite ban on owning animals.

CONVICTED (2023) | Abraham Andemariam, born c. 1992, of Asbridge Street, Toxteth, Liverpool L8 0UG – callously drove through a gaggle of geese and left the injured birds dying in the road.

Eritrean national Abraham Andemariam was captured on smart doorbell footage killing seven geese on Omega Boulevard in Great Sankey, Warrington, in July 2023.

Witnesses were distressed by the suffering of the birds, a court heard.

Tom Quirk, prosecuting, said the incident happened at about 07:00 BST on 15 July.

Andemariam “drove through a flock of geese killing seven of them” then carried on to work, he told the court.

Mr Quirk said “there was clear disregard for the animals in the road”.

A witness saw “the birds suffering on the floor causing her some distress”, he said.

“The birds were dying and also had dramatic injuries with skin torn away from their limbs.

“There were passengers inside the vehicle and residents were caused distress by what they witnessed and this was after aggressive driving.”

Mr Quirk said when police went to Andemariam’s work they saw feathers on the front of his bonnet and identified him as the driver.

He was subsequently sacked from his job with Amazon.

Andemariam was found guilty in his absence in September 2023 of seven charges of intentionally killing a wild bird, a Greylag Goose, and also driving without due care and without an MOT certificate.

Rebecca Templeman, defending, said Andemariam had admitted the offences in interview and was convicted in his absence after the death of his 16-year-old brother.

The defendant had travelled to the scene and emailed the court asking for an adjournment but he did not receive the postal reply and missed the hearing, she said.

On his return he saw in a newspaper he was wanted and surrendered himself to police.

Miss Templeman said Andemariam “was appalled when shown the CCTV footage and visibly upset at what he did that day”.

Andemariam pleaded guilty and was given a suspended 12-week jail term.

Sentencing | 12-week custodial, suspended for one year. 50 hours of unpaid work and 10 days of rehabilitation activities; £154 victim surcharge and court costs of £120. A collection order was made for deductions from benefits. Banned from driving for six months.

Harrow, London: Vasile Baltatu

CONVICTED (2023) | Vasile-Alin Baltatu, born April 1990, of 29 Hawkins Close, Harrow HA1 4DJ – caught on a doorbell camera hitting his pet dog with a plastic shoehorn.

Video evidence showed Romanian construction worker Baltatu chasing the brindle and white bulldog with a blunt instrument on December 8, 2022 then repeatedly striking him with it.

The dog, Nero, can be seen cowering under a vehicle and heard yelping in pain.

Baltatu can be heard yelling “I’ll get you tomorrow!” at him.

RSPCA inspector Mike Beaman signed Nero over to the charity when he visited Baltatu’s house on January 5, 2023.

In court, Baltatu pleaded guilty to causing unnecessary suffering to the dog following a successful investigation by the RSPCA.

On viewing the footage, a vet said: “There is nothing in the video to explain or legitimise this use of force against the dog from a veterinary perspective.

“The translated transcript of the video shows that the owner is using threats and expletives against the dog, and the phrase ‘I’ll get you tomorrow!’ makes me concerned that this dog would continue to face violence and harm had it stayed with the owner.

“It is clear from the transcript that the suffering he is inflicting is disproportionate and seems to be driven by malice.

“The brutality with which the man beats the dog means this is one of the more extreme and unpleasant pieces of evidence I have examined as an RSPCA witness. I have very grave concerns about this man’s ability to care for animals in the future.”

Speaking about the case, RSPCA Inspector Mike Beaman said: “The defendant’s behaviour towards his pet was totally unacceptable and disproportionate.

“Poor Nero couldn’t escape and was clearly terrified. We’re grateful to the person who contacted us with this footage so we could ensure Mr Baltatu was held to account.”

Nero has made a full recovery and has been successfully rehomed by the RSPCA.

Sentencing | 18-month community order with 20 days of rehabilitation activities; 150 hours of unpaid work; £500 in costs. A 10-year ban on keeping dogs.

Cheltenham, Gloucestershire: Tomasz Zimny

CONVICTED (2023) | Tomasz Zimny, born 9 November 1982, of 85A St Pauls Road, Cheltenham GL50 4HY – killed an elderly pet cat by swinging her over his head and slamming her onto the ground.

Polish national Zimny was caught on camera viciously killing much loved family pet Millie in the car park of the Cleeve School in the Bishops Cleeve area of Cheltenham. The horrific incident took place on 27 March 2022.

Zimny drove into the car park to collect his girlfriend Ewa Siebida, born 21 September 1980, who was waiting for him. He got out and let their two dogs out of the car who then chased the 12-year-old cat away.

The CCTV footage shows Zimny running after Millie before picking her up by her back legs or tail and swinging her up over his shoulder and slamming her onto the ground.

Horrifically, Millie’s ordeal wasn’t yet over. RSPCA Inspector Richard Carr, who investigated the case, said: “It is clear she is injured and unable to move but is still alive. He takes some steps away – but comes back and he then appears to kick her whilst she would already be in pain.

“She can be seen to move a few more times but then is motionless for a few seconds before dragging herself under the pallets.

“Neither Zimny nor his girlfriend bothered to check on her and instead got the dogs back into the car.”

A witness who had only seen part of what had happened rushed over to Millie, to find her lying still and in shock, so he rushed her to a vet.

Millie’s family were traced through her microchip and were informed the next day of her death.

It was believed at the time to have been as a result of a dog attack.

However, the school’s headteacher viewed the CCTV covering the car park and passed the footage of Zimny’s actions onto the police and RSPCA.

Millie’s body was exhumed for a post mortem which found a number of traumatic injuries including rib fractures, a collapsed lung, partial dislocation of three spinal joints and bleeding in the lung.

Zimny, who used a translator in court and is originally from Kostrzyn, Poland, claimed he had been bitten by Millie and said because his dogs were barking at her he thought the cat was attacking them.

Zimny had worked at Cleeve School as a cleaner for seven years before the attack, but resigned shortly after.

Solicitor Lindi Meyer, who prosecuted for the RSPCA said: “Millie did not die immediately but was then kicked by Zimny and she then dragged herself under the pallets where she died from her extensive injuries soon after

“[Zimny’s] actions were premeditated and in angry revenge.”

Zimny’s partner, Ewa Siebida, had worked for the school for ten years before resigning from her post as a cleaning supervisor on the same day.

Speaking to the Daily Mail she said Zimny “didn’t want to kill the cat. He didn’t come in there and he wasn’t going to do this.

‘[The dogs] wouldn’t have hurt the cat but they’d been barking quite loud in the carpark. The cat had run away and hid under a cleaning machine. I was going to take one dog and Tomasz had gone because one of them is only a young one.

‘She ran after the cat and was getting under the machine. Tomasz has gone to take the cat from under the machine and he put his hand under.

‘The cat – probably because he was frightened – he bites Tomasz, he cuts his hand and Tomasz has taken his hand from underneath the machine with the cat on his hand.

‘He didn’t know. There was just no time – he didn’t think what he was doing. It was just a reaction from his side.

‘The cat has bite him in his hand and he just reacted automatically because he didn’t know how to remove the cat so he just thumped him on the ground.’

Siebida continued: ‘I said [to him]: “Can you put yourself in the situation and think how you would feel if this happened to one of your dogs?”

‘He understands this and he knows about this. He didn’t want to do this.

‘He doesn’t even want to think about it. He knows how it would be for him if he was in that situation.’

She added: ‘I said it was unnecessary and he completely agrees with that. He didn’t want to do this. But he’s done it. He didn’t want this situation to go that way.

‘He’s quite reactive – so he can react and doesn’t think first.

‘And now he knows to stop for a minute and think what to do and not just straight away: bang! with a cat.’

‘It was so quick. I was there and not even five metres away and I hadn’t seen it. It was just two and a half minutes from when Tomasz came to the carpark.

‘It was unnecessary for everybody. This made us leave the job, it impacted our life and it’s going to stay in the head. It won’t go easy.’

She continued: ‘I got that statements from the family about Millie and read it from the top to the bottom. It’s breaking your heart, using words like this.

‘It was really bad so I don’t think the family will be happy that Tomasz has been in the court and I don’t think this will be enough for them.

‘I was myself surprised that he’s been treated as good. For me it was the best he could get out of the situation.

‘I can imagine that this is a really bad thing and really serious, especially in England. I was expecting that it would be really bad. I was even expecting that he can go to prison. We were expecting this. We have been ready for everything.’

Siebida now works in a bakery while Zimny does self-employed building work.

Sentencing | 18 week prison sentence, suspended for 12 months; 150 hours of community service. Disqualified from owning a cat for life but may appeal after five years (expires May 2028).
