Weston-super-Mare, North Somerset: Lucas Slim-Fitzpatrick

CONVICTED (2023) | Lucas Slim-Fitzpatrick born 6 November 1996, most recently of Regent Street, Weston-super-Mare but with links to Plymouth, Saltash, Taunton and Wolverhampton – subjected an bull-breed puppy to a catalogue of violence.

Slim-Fitzpatrick, who promotes himself on TikTok as a mental health expert and also likes to showcase his ‘kindness’ to homeless people, was prosecuted by the RSPCA for assaulting and neglecting the 10-month-old bull-breed called Luna in Plymouth between June 1 and December 1, 2022,

He pleaded guilty to three offences under the Animal Welfare Act 2006 and was sentenced at Bristol Crown Court on December 7, 2023.

He inflicted “blunt force trauma, physical violence and multiple injuries of a non-accidental nature”.

He also failed to take steps to ensure the needs of Luna were met by not protecting her from “pain, suffering and injury and disease” and failed to provide “proper and necessary veterinary care and attention” for her injuries.

A vet who examined Luna said the dog had suffered blunt force trauma injuries in at least three separate incidents.

The RSPCA was shown doorbell footage from November 30, 2022 which showed Slim-Fitzpatrick riding his electric scooter in Mutley. while holding onto the lead of the dog, who was trying to follow behind.

A witness who contacted the police said he heard an animal in distress at the back of Slim-Fitzpatrick’s former address in Greenbank Road in Plymouth minutes later, the RSPCA said.

The court was told the witness saw Slim-Fitzpatrick “staggering around” on the scooter while talking aggressively to the dog before picking her up with both hands and throwing her six feet in the direction of a wall. He was later arrested.

When he was interviewed by police in December 2022, the defendant claimed Luna’s injuries – a broken left hip and pelvis, fractured jaw, cheekbone and wrists, three broken ribs, three broken teeth and a bloodshot eye – were caused by Luna being hit by a car and kicked by a horse.

He said her bloodshot eye was the result of her being attacked by a Jack Russell dog.

But RSPCA prosecutor Gregory Gordon told the court: “Expert veterinary evidence disproved the defendant’s various claims of accidental injury to Luna. For example, if she had been struck by a vehicle, there would have been evidence of skin abrasions or lacerations, and grit or oil in her hair.

“Radiographs indicated Luna’s different fractures were at different stages of healing, meaning that the injuries occurred on different dates. It has not been possible to identify the number of separate incidents from the injuries alone, but records indicate that injuries were sustained by Luna on at least three separate occasions, including June 29 and August 2 last year.”

On both of these dates, the defendant had been in contact with vets. However, in June 2022 he declined the vet’s recommendation that Luna undergo surgery for wrist fractures, citing the cost. He then failed to attend appointments to rebandage her wounds, instead using a pencil and sock as a homemade splint.

In August he phoned the vet to report Luna was eating painfully, but then failed to keep an appointment.

When RSPCA Inspector Miranda Albison attempted to make contact with the defendant in March and July this year to interview him about the allegations, he claimed he did not have a fixed address, but that he was staying with a friend in Birmingham.

In a statement read to the court, the inspector said: “The defendant said he was aware the RSPCA had been visiting his address, but that he was not prepared to be interviewed.

“I told him Luna was still in our care as he had not responded to my request to confirm we could rehome her. He became angry and said he thought he had already given permission and the dog was no longer anything to do with him.”

In mitigation, the court was told Slim-Fitzpatrick had experienced a troubled background and had spent time in the care system.

A judge said he had shown little remorse for his actions and told him: “This was prolonged, lengthy violence towards an animal in your care who should have been protected by you rather than becoming your punchbag.”

Luna was signed into the care of the RSPCA on July 5, 2023. The charity said she had recovered from her ‘horrific’ ordeal in their care. She was rehomed after undergoing surgery and extensive rehabilitation work to regain the use of her back leg.

Speaking after the sentencing, inspector Albison said: “The assaults carried out by this defendant on this poor dog started when she was a 10-week old puppy and continued until she was 10 months old. It was absolutely horrific as she was repeatedly beaten and suffered many fractures.

“Luna had surgery on her femoral head and that saved her back leg as the other option was amputation. Happily she is now doing very well and we have been able to rehome her.

“Without being provided with the Ring Doorbell footage by a member of the public we wouldn’t have been able to prosecute the defendant as he denied being in that area of Plymouth at the time of the assault allegation.”

Sentencing | 14-month custodial sentences to run concurrently on each of the three animal welfare offences and a further five-month prison sentence, to be served consecutively, for his breach of a suspended sentence imposed for an unrelated matter. Banned from owning animals for 20 years.

St Budeaux, Plymouth, Devon: Marie Emmett and Chris Lancaster

CONVICTED (2023) | Marie Emmett aka Marie Harrison, born 14 March 1987, and Chris Lancaster, born 7 September 1992, of Kit Hill Crescent, Barne Barton, St Budeaux, Plymouth PL5 1EW – starved and neglected a young American bulldog and allowed him to kill a puppy.

On December 21, 2022, police arrived at the the home of Marie Emmett and Chris Lancaster to find their two-year-old American bulldog, Bane, tied up outside the house. Officers were called after Bane had reportedly killed another dog – a four month old puppy named Lilo – within their home.

Bane was in an extremely underweight and dirty state, with overgrown claws, indicating that he had not been walked properly.

In a witness statement, one police officer said: “It looked like he had been kept in the kitchen. It smelt strongly of urine and small scratch marks from his claws could be seen all over the floors and walls. It appears the dog was possibly confined in this location. The rear yard was unkempt and covered in dog faeces.”

Bane was taken to a vet who found he was suffering severe dehydration, was smelly, with sticky fur and covered in urine. His feet and paw pads were covered with scalded areas and sores with areas of non-healing necrotic tissue.

The vet said Bane was emaciated with visible bones, no body fat and a loss of muscle mass. He weighed less than half the weight he should have been – at around 20 kg when he should have been 40-60 kg.

At the request of police, Bane was put to sleep and a post mortem found that he had rubber flooring in his stomach.

The vet report stated: “This dog had no access to food and was clearly eating what it could to survive using its basic survival instinct. This, and the lack of fat deposits throughout the entire body system, suggests this dog had been starved for a long time and supports my professional opinion that this dog was suffering and had been for a while.

Sentencing | both received a 12-week suspended prison sentence;40 hours of unpaid work; 15 rehabilitation activity requirement days; costs of £200 each. Ten-year disqualification order, which can be appealed after five years.

CONVICTED (2023) | backyard breeder Zoe Louise Small, born 21 April 1992, of Tamerton Avenue, St Budeaux, Plymouth PL5 1TW – starved a pregnant dog and kept her in horrendous conditions.

Small, a make-up artist trading under the name Make-up by Zoe Small, admitted two animal welfare offences in relation to springer spaniel Bella, following an investigation and prosecution by the RSPCA.

Shockingly, South and West Devon Magistrates’ Court ordered the destruction of Bella and her puppies supposedly on the grounds that they had endured enough suffering, but this was later overturned following an appeal from the RSPCA solicitor. All dogs will now be rehomed.

Small, who runs a dog breeding business with husband Daniel Small, specialising in French bulldogs, admitted failing to adequately explore and address the causes of Bella’s weight loss. She also failed to ensure that Bella’s needs were met in that the dog was not provided with a suitable environment that was dry.

Following Small’s conviction, the RSPCA released distressing pictures showing the living conditions the heavily pregnant dog was kept in.

RSPCA Inspector Jim Farr, who investigated for the animal welfare charity, was contacted by vets after Bella was admitted to the surgery in the evening, before an emergency caesarean.

The vet, who was concerned that Bella was very thin and lethargic, said she was suffering from prolonged malnutrition and that her needs as a pregnant dog were not being met.

As a result the RSPCA launched an investigation and Inspector Farr, who visited the run-down stables where Bella was being kept at Blackdown Meadows, near Kingsbridge, with police and a vet, described what he found.

He said: “We made our way to the stable block which comprises four individual stables. The immediate area to some of the entrances of the stables was flooded. There was also an assortment of discarded items, a large number of tools including a small motorbike.

“The second stable from the left was where the information I had received was where Bella was being housed up until her removal the day before.

“The interior was very damp. The floor had an inch or two of sodden earth and other matter which was possibly old shavings.

“The floor also had a scattering of faeces. In one corner was a small triangular sectioned area which offered some cloth bedding which was damp.

“This sectioned off area would have been too small if Bella had had her pups within it. The rest of the stable offered no dry area if she had given birth on the floor.

“There was an empty bowl but no water to be seen. A scattering of dog food was on the floor by the stable door which appeared to have just thrown in on the sodden floor. The stable itself was approximately 12ft x 12ft with the bedding area being 4ft x 3ft x 2ft 6insdeep approximately.”

Sentencing | 200 hours of unpaid work; 20 rehabilitation activity requirement (RAR) days; costs of £250 and £114 to fund victim services. Banned from keeping a dog for eight years (expires July 2031).

Plymouth: Jamie and Adrian James

CONVICTED (2022) | backyard breeders Jamie James, born 10 June 1995, of HMP Channings Wood & his father Adrian James, born c 1971 of Devonport Road, Plymouth – cropped puppies’ ears to make more money.

Jamie James, a habitual criminal who can now add animal cruelty to his list of previous convictions.

Jamie James, a cocaine addict with previous convictions for Class A drug dealing and domestic violence, admitted three animal welfare offences following an investigation and prosecution by the RSPCA. His father, Adrian James, was convicted alongside him although, it was claimed in court, played a “lesser role” in the cruel profiteering. The pair traded under the name Southwest Dogfather.

RSPCA officers visited in September 2021, after police obtained a warrant to search for puppies with illegally cropped ears.

During the visit, a female grey merle pocket bully with cropped ears and a tan and white male pocket bully with cropped ears were discovered.

RSPCA Inspector Pippa Boyd noted that bleeding indicated that the cropping had been done recently and was not fully healed.

Dog passports were provided by the men, but these did not contain the necessary vaccination stamps or details to support that the dogs had been legally imported. The date of birth also appeared to have been doctored on the passports to show a different date.

Evidence gathered by the charity from phone records showed dogs were being sold for commercial gain through Gumtree, with a business logo shared between the two men.

Whatsapp messages and videos shared between father and son also proved the dogs had been born under their care and their ears had been cropped.

In messages sent to his father on August 8, 2021, Jamie James shared videos of puppies with freshly cropped ears – just hours after sharing clips showing the same dogs with their ears intact. Earlier messages showed he had travelled to Gloucestershire with the dogs before returning to Plymouth that day.

Additional messages see the two men discussing the dogs’ ears and showing a tool to remove staples. There were also discussions about giving the dogs a substance to allow them to remove the staples, with comments and videos showing the effect the substance had on the dogs and a picture showing a staple that had been removed.

Sister Beth James also appears to be involved in backyard breeding and owns a dog with cropped ears.

They also discussed pictures for online selling sites and how much had been made from the sale of other dogs.

In another conversation between the two men, Jamie James is seen saying: “You get top money if you get their ears done. That’s what I’m going to do.”

CONVICTED (2022) | Josie Pickering, born c. 1990, of 15 Grimspound Close, Leigham, Plymouth PL6 8NY – for cruelty to three dogs.

Pickering caused unnecessary suffering to the three unnamed dogs by failing to get them dental treatment and failing to ensure their needs were met by keeping them in a hygienic environment.

Sentencing: 12-month community order with Rehabilitation Activity Requirement. Banned from keeping dogs for five years (expires March 2027).

CONVICTED (2021) | Christopher Jesper, born 26 February 1972, from Pydar Street, Truro – slapped a husky repeatedly

Drifter Jesper, who has links to Plymouth, Chester, York and Bangor in Wales, pleaded guilty to causing unnecessary suffering to the unnamed dog by slapping him or her several times.

Jesper was ordered to pay a fine of £40, a surcharge of £95 and costs of £85. He was barred from keeping a dog for a period of two years (expires March 2023).

Company director Michael Dawson, who owns Element Bullys Ltd, was caught with the mutilated American pocket bully-type bitch in a raid by police and other agencies at his Plymouth house.

The tan and white dog, called Riot, was found in a crate in the garden with cropped ears.

The dog was seized by the RSPCA and has since been rehomed.

Dawson pleaded guilty to permitting another person to perform a prohibited procedure or failing to protect a protected animal in June 2019.

Despite owning a plumbing and heating business, Dawson was not banned from keeping animals because he claimed breeding dogs was his only source of income.

He told the court that he had bought the puppy from a Scottish breeder for £5,000.

The RSPCA said that Dawson said to the magistrates that he had sent Riot away to meet a potential mate.

He said that he was upset when the dog returned with her ears cropped.

A vet who examined Riot found both of her ears, or pinnae, had been surgically removed and still had blue/purple sutures and pink antibiotic spray. Biopsies taken showed the injuries had been inflicted around two weeks earlier.

An RSPCA spokesperson said Riot was taken into foster care when the multi-agency warrant was executed with Plymouth City Council at the fore.

She added: “Riot was signed over to the RSPCA in March 2020 and settled in well to her new home.”

The RSPCA said ear-cropping was on the increase despite being illegal. It is allowed in America and other European countries.

The charity added that people were encouraged by celebrities who had cropped dogs as in a separate case shown above.

But the RSPCA says that it is painful and unnecessary, affecting the way dogs hear and communicate.

Dawson was fined in November 2020 at the same court for having illegal veterinary medicines.

Dawson and his company admitted having five substances, including prescription only antibiotic treatment for dogs.

It followed a raid under a search warrant by officials from the Department for the Environment, Food and Rural Affairs.

Both Dawson and the company pleaded guilty to possession of unauthorised medicinal products.

Dawson was fined £265 and ordered to pay £85 costs and £30 victim surcharge.

Element Bullys Ltd was fined £1,500, plus a £150 victim surcharge.

Sentencing: fined £1,000 and ordered to pay £100 victim surcharge.

Update March 2021

Dawson returned to court to face prosecution by Plymouth City Council for operating a dog breeding establishment without a licence. The court heard he sold dogs over Facebook and Instagram for 16 months without a permit. He made just over £63,000 by operating without a licence under legislation introduced in 2018.

It was reported that the council were also prosecuting Dawson under Proceeds of Crime legislation in an attempt to seize back the money he made through his business.

The council estimated he made £64,000, though this was hotly disputed by his solicitor.

Recorder David Chidgey rejected the council’s bid to ban him from keeping dogs or being in any business which bred or sold them.

He said: “There is no evidence to suggest that you have mistreated any animal at any time.”

Recorder Chidgey, noting that the defendant faced paying the council’s £7,000 costs and action under the Proceeds of Crime Act, imposed a two-year conditional discharge.

He added: “The reality is that the regulations are there to ensure that animals are protected.”

Urging him to get his licence, the judge said: “Get on and do it. Make sure you do not come back into court again.”

Gregory Gordon, prosecuting on behalf of Plymouth City Council, said the authority would use a ‘fit and proper person’ test on Dawson when he applied.

But he said that the defendant had three convictions for himself and his companies relating to dogs.

Dawson pleaded guilty to the single charge under the Animal Welfare Act of breeding dogs without a licence between September 30, 2018 and January 18, 2020.

Mr Gregory said that Dawson had run his business for 15 to 20 years but had fallen foul of the new regulations starting in 2018.

He said that during a 16-month period investigators had found evidence that Dawson had bred “some 22 identified dog litters” and that there was evidence that there “probably more litters”.

These were advertised on Facebook and Instagram accounts.

He added: “He said he was selling them around the world, including to celebrities in America.”

Mr Gregory said that Dawson’s attitude toward licensing had been “woeful”.

He added that no application was received by the council, though the defendant had called to ask when he was going to be inspected in June 2019.

The court heard that the average cost of a licence application, depending on veterinary fees, was £600.

Dawson had three Facebook accounts – Mike Dawson, Michael Dawson and Element Bullys – as well as an Instagram account. All were used to advertise his dogs.

The court was told that the Element Bullys was registered in Dawson’s name with Companies House and the firm was previously known as M Dawson Dog Breeding Ltd between April 2015 and August 2017. Both firms were based at Faraday Mill Business Park in Cattedown.

Mr Gregory said that puppies would be sold for between £1,000 and £1,500 but admitted that the claim that Dawson made £64,000 was an estimate.

Dawson’s solicitor Stephen Nunn said that his client “still lives and breathes dogs” and had two as pets. He said that the claims Dawson made on social media that he had a world-wide reputation were true.

He added that he was regarded as an expert on matching dogs to produce the desired colours in puppies.

Nunn said that the annual turnover for the business was £41,000, and nearly half of that was spent on veterinary fees.

He added that Dawson was a former addict who had “turned his life around”, building up first a painting and decorating business and then following in his father’s footsteps to breed and sell dogs.

Update February 2022

Following Proceeds of Crime action by Plymouth City Council, Michael Dawson was ordered to pay back more than £100,000 of his ill-gotten gains over a period of 20 years as an unlicensed dog breeder.

In October 2021 it was revealed the the council had granted Dawson a breeding licence after he supposedly passed a ‘fit and proper person’ test.

Judge William Mousley ordered Dawson pay a total of £106,000 under the confiscation proceedings – under laws usually deployed against drug dealers or big-time fraudsters.

Dawson was told he must pay within three months or face a year in prison.

A financial assessor estimated that he had assets to pay the bill – mainly four properties, two of which he had inherited.

By now Dawson had racked up three convictions for himself and his companies, relating to dogs but continues to sell dogs online on a massive scale.

Plymouth, Devon: Michael Rose

CONVICTED (2020) | Michael ‘Mikey’ Rose (aka Michael Garner), born c. 1997, previously of Hill Park Crescent, Greenbank, Plymouth PL4 but most recently no fixed abode – punched and kicked a police dog after constables found him living in a tent in woods

Rose, who is originally from Basildon, Essex, punched and kicked PD Ollie as constables tried to restrain him. But the dog managed to grab hold of his ankle as he’d been trained to do.

The thug also rained blows on three police officers who found him in a tent and tried to headbutt another back at the police station.

Rose then assaulted two custody officers who were taking him to court the next day. One of the officers later said it was the most aggressive he had seen someone in 17 years of policing.

Jailing him for 18 months in total, Judge William Mousley said all six officers had been “just doing their job”.

He added that Rose had significant mental health difficulties, including paranoia, though he had refused to co-operate with psychiatric staff in the past.

Rose pleaded guilty to six counts of assaulting an emergency worker and one of causing unnecessary suffering to a dog on December 23 and December 24, 2019.

He changed his pleas minutes ahead of his trial.

Police Dog Ollie’s Twitter account said after the attack that there were no serious injuries and that he “recovered quickly”.

Rose was jailed in December 2017 for 29 months for two offences of blackmail. The latest offences were committed on licence after his release.

Sentencing: 18 months in prison.

Plymouth: Kieran Mitchell

CONVICTED (2020) | Kieran John Jerome Mitchell, born 27/05/1995, of Keswick Crescent, Plymouth PL6 – punched and slapped his pet dog 36 times causing him to suffer wounds to his head and ears

Convicted cannabis dealer Mitchell, formerly of Penrose Street, Stonehouse, Plymouth, was convicted of causing unnecessary suffering to the bull terrier Hugo in November 2017. He was convicted in his absence back in July 2018 and a warrant issued for his arrest the following month.

Mitchell surrendered to custody in March 2020. He was released on bail but failed to turn up at the next hearing. Justice was eventually served in September 2020 when he returned to court to face charges of drug dealing.

RSPCA prosecutor Lindi Meyer told the court it was a “nasty sustained attack” with a total of 36 hits, punches or slaps heard on the recording.

As Mitchell attacked the dog he can be overheard goading him, asking him: “Are you crying now? Whimpering?”

The RSPCA seized Hugo from Mitchell and took him to a vet for examination. The vet found three lesions on his face, one of which was near an eye. The vet said that the beating would have been a traumatic experience for Hugo, causing him to feel “terror, fear, pain and anxiety”.

Mitchell admitted in his interview that he smacked Hugo and would rub his nose in it if he fouled on the floor.

The presiding magistrate told Mitchell: “You acted in anger against an innocent animal.”

Sentencing: 24 weeks in prison. £115 victim surcharge. Banned from owning animals for ten years.

In July 2019 Rhys Anderson caught a seagull chick, and proceeded to throw him in the air, kick him, and then beat him with a broomstick. Anderson and an as yet unidentified accomplice were caught on CCTV laughing manically as they attacked the helpless birth.

The badly injured chick, who has been named Hoppit, was taken into the care of Athena Wildlife & Bird of Prey Care (Rehab) – Plymouth. Although Hoppit’s broken leg had to be amputated he appears to be coping well.

Anderson pleaded guilty before city magistrates to hurting the herring gull chick in Plymouth on 10 July 2019.

Sentencing: 12-month community order with 60 hours of unpaid work. Completion of a Rehabilitation Activity Requirement and thinking skills course. Ordered to pay £250 compensation to Athena Wildlife & Bird of Prey Care.
