Bedford, Bedfordshire: Zohaib Khan and Priya Sidhu

CONVICTED (2023) | Zohaib Khan, born 24 October 1995, and Priya Sidhu, born 2 June 1998, both of 11 Adelaide Square, Bedford MK40 2RN – caused the death of a five-month-old kitten after leaving her to suffer with open wounds and broken bones.

The couple had both pleaded guilty to one animal welfare offence in relation to the kitten called Coco, whose suffering was described by a vet as “significant.”

Khan and Sidhu initially took Coco to see the vet on May 27, 2022, stating that she had fallen from a sofa and injured her leg. Following veterinary examination, the couple were advised the kitten would require specialist surgery but they never returned.

Less than three months later, on August 6, RSPCA inspector Stephen Reeves was called by Khan and Sidhu to collect a seriously injured Coco from their home.

Inspector Reeves said: “I was advised by the two individuals that they were unable to afford veterinary care.”

He added that she had multiple injuries and was unable to stand.
Her injuries included wounds to her lip and ears, broken teeth, fractures on both back legs, a dislocated pelvic bone, a fractured jaw and a possible sternum fracture.

Coco died of her injuries while under sedation for treatment.

Expert witness Dr Sean Taylor found that there were discrepancies between Khan and Sidhu’s accounts with neither of them able to offer ‘any reasonable explanation’ for the repeated and severe injuries sustained by the kitten in their home.

Ultimately it was deemed that Khan had caused the greatest suffering to Coco.

Dr Sean Taylor said in his statement: “In my opinion, Coco has been caused to suffer as a consequence of being subjected to physical abuse. Suffering will have been experienced by this animal via mechanisms of fear, distress and pain for a period of at least four days, probably longer.”

Following the sentencing, inspector Stephen Reeves said: “The death of Coco was entirely unnecessary and the pain inflicted on this little kitten in her short lifetime was immense.

Zohaib Khan: 18-week custodial sentence suspended for 12 months, 25 Rehabilitation Activity Requirement days and 80 hours of unpaid work; costs of £400. Banned from keeping animals for life.

Luton, Bedfordshire: Joyce, Adam and Kyley Davies

Joyce Davies, Adam and Kyley Davies each pleaded guilty to four offences in relation to their dogs Snowdrop, Scooter, Prince and Lucky.

The dogs died after they had been shut away in a room for weeks without food and water, it is thought that as they tried to scavenge and search for food they may have consumed something toxic.

Prosecutor Janita Patel told the court that a report by a vet in the case stated that toxicity is likely to have been the cause of death, but the cause was immaterial to the offences charged, as they related to a prolonged period during which the dogs lost weight and hence found the need to scavenge.

The family took the seriously ill four dogs to an out of hours vet, but when they arrived Snowdrop was already dead, and Scooter had to be put to sleep on welfare grounds as he was too poorly.

Prince was kept in the vets, but sadly died overnight and the family were allowed to take Lucky home as long as they returned to the vet should his condition deteriorate.

The vet contacted the RSPCA as they were concerned by the emaciated condition of all four dogs and their filthy state, and for the welfare of Lucky who had been taken back by the Davies.

RSPCA Deputy Chief Inspector Mel Fisher and the police attended the family home to check on the welfare of Lucky, but when they arrived he was collapsed, non-responsive and fitting. They took him to the veterinary practice and he too sadly had to be put to sleep because nothing further could be done to save him.

Inspector Fisher said: “Over the years this family have been given advice by the RSPCA and their own vet, regarding the level of care they have been providing for their dogs and we have tried time and time again to work with them.

“But it was all in vain, as they chose to ignore this advice and ignore the welfare of their dogs. They simply just didn’t care enough and shut the poor dogs away in a room and ignored them. Even though they took the dogs for veterinary attention it was too little, too late, and also when they were allowed to take Lucky home with instructions to return if his condition worsened, they didn’t do so.

“I have known all these dogs for a number of years and I was in tears when they had to be put to sleep, yet the family seemed unmoved. I am just heart-broken that these poor dogs suffered. There was even tins of dog food in the house, but the dogs were so emaciated it was clear they had not been fed for a very long while”.

Sentencing: 14 weeks in prison for each offence to run concurrently; ordered to pay £300 costs and a victim surcharge of £115 each. Lifetime ban on keeping all animals.

CONVICTED (2017) | Dariusz Jakimowicz (aka Darek Kuba), born 21 December 1981, of Havelock Road, Luton LU2 – caught on camera brutally punching his German Shepherd puppy in the face and body and battering him with a pole.

Neighbours of Dariusz Jakimowicz described hearing ‘whipping noises’ coming from his home on a daily basis as the dog, Zeus, ‘screamed’ out in pain.

A woman who recorded the abuse on her mobile phone told Luton Magistrates’ Court that she ‘heard a puppy crying and in distress’ after she moved next door.

She said: ‘I own a dog myself and I know the difference between a playful noise and the sound of a dog in pain or distress.

‘I would hear the dog sounding in pain or distress on a regular basis. As a result I decided to try and capture what was happening on my mobile phone.

‘I heard a whipping noise and a dog crying out of my window and I saw a male with a large plastic stick in the rear of a property near my own.

‘I saw the man advance towards him with the stick twice and heard whipping noises and heard the dog cry out.

‘It was a high pitched cry and it is a sound I never want to hear again.

A second video shown to the court, taken by another neighbour, showed Zeus cowering in front of a large hole in a garden fence and being punched by Jakimowicz.

In a statement read to the court, the female neighbour said: ‘I was in my bedroom and I heard a dog crying.

‘I went to my bedroom window and saw a man I know to be my neighbour with a dog, a German Shepherd.

‘He was standing side on to me so I could see his face and easily identify him as my neighbour.

‘I watched the man holding the dog by the scruff of his neck and I saw him hit the dog in the body area and punch him with clenched fists.

‘The male punched the dog 10 to 15 times. The dog responded by crying out, he wasn’t fighting back.

‘We could heard the dog crying out on an almost daily basis.’

Speaking about the second video, RSPCA inspector Mel Fisher said: “He was punching Zeus so hard that he was shaking and rubbing his fist afterwards because it hurt his hand. He admitted in interview that he did this because he lost his temper. Thankfully Zeus wasn’t left with any long-lasting injuries from this incident.

“Additionally, he was using a pinch collar to walk Zeus, which is a horrific medieval-looking training device which pinches the dog’s skin when they pull on the lead. Wearing this collar would have caused Zeus pain while walking. It is certainly not a training method which is recommended.”

Jakimowicz initially denied using any excessive force against his pet but when confronted with the video evidence eventually  admitted causing unnecessary suffering to Zeus, by inflicting physical abuse and blunt force trauma.

Sentencing: 
12-week custodial sentence, suspended for 12 months. 100 hours of unpaid work. A total of £626.80 in costs and charges. Five-year ban on keeping animals (expired January 2022).

Bedford, Bedfordshire: Hayley Cronin

CONVICTED (2011) | Hayley A Cronin, born 24/06/1983, of Kimble Drive, Bedford MK41 9SZ – allowed her dog to die of hyperthermia after leaving him tied up in direct sunlight for several hours

Single mother Cronin pleaded guilty to causing cross-breed Buster unnecessary suffering when she left him tied up in the sun.

The court heard how Cronin, who supports her three young children on benefits, was under severe stress when the incident happened in June 2011.

The court heard how an RSPCA inspector attended the address after concerns were raised that a dog had died at Cronin’s home. Cronin confirmed that the dog had died and took him to a neighbour’s address where Buster was found on the kitchen floor covered in a damp sheet.

A post-mortem later showed that Buster’s temperature had reached 41.9 degrees. A normal temperature is between 37.9 and 38.9 degrees. The vet also reported that Buster had gone through extreme suffering in the run-up to his death.

Cronin was fined £500, which included court costs and a victim surcharge and banned from keeping a dog for seven years. Her father, who attended the hearing, said that he would pay the fine his daughter’s behalf.

Sentence: £500 fine; seven-year ban on keeping dogs (expired 2018).
