Tamworth, Staffordshire: David Raybone

CONVICTED (2022) | David John Raybone, born 2 September 1983, of Tame Court, Lichfield Street, Tamworth B79 7QD – strangled a puppy to death.

Raybone admitted causing unnecessary suffering to the eight-month-old dog, known as Reggie, after putting a belt around his neck and dragging him, causing fatal asphyxiation.

The court heard from witnesses who saw the puppy dragged along the floor with his neck pulled and extended. Reggie was left motionless and sadly later confirmed dead despite the efforts of vets.

In a written statement to the court, a veterinary surgeon said Reggie was noted to have been “behaving playfully prior to having the belt tied around his neck”.

They added: “No other pathological findings could explain the death of this animal and therefore the most likely cause of death was asphyxiation.

Following the hearing, RSPCA inspector Pamela Bird said: “It is just heartbreaking to think about how Reggie must have suffered. I’d like to thank the police for their swift and effective action when they responded to the incident and their assistance throughout my investigation, as well as the vets who did everything they could to save Reggie and the members of the public and witnesses for helping to bring this extremely upsetting case to court.”

Sentencing | 20-week custodial sentence; ordered to pay a total of £656 in costs and surcharge. Disqualified from keeping animals for life and a seizure order was made for a cat he owns.

Daniel Mellors was fined but not banned from keeping animals after the court ruled that a ban “would not be proportionate”.

Witnesses in Birmingham saw Mellors strike the dog, Roxie, before picking her up by all four legs and slamming her onto the ground.

He also dragged her aggressively in the incident.

The incident took place on August 31, 2019 and was reported by the British Transport Police (BTP).

On 25 September 2019 BTP issued an appeal for information following the incident and released photographs of Mellors and his girlfriend, Jemma Milton, who reportedly swore at members of the public that tried to intervene.

BTP released these images of Mellors and girlfriend Jemma Milton following the attack on the dog.

The charge, under the Animal Welfare Act, alleged Mellors “caused unnecessary suffering to a protected animal, namely a dog, by a failure to act, namely struck the dog a number of times, drag the dog aggressively and pick the dog up by all four legs and slam the dog into the the floor, and you knew or ought reasonably to have known that the act would have that effect or be likely to do so.”

According to the court register, the reason for not imposing a disqualification order was because ‘this was a short incident falling within the lowest bracket of harm and culpability and in these circumstances such orders would not be proportionate’.

Sentencing: fined £267; ordered to pay a £32 victim surcharge and £450 in Crown Prosecution Service costs bringing his total bill to £749.

Dogs were kept in cramped conditions

“There was a real issue that two of the dogs were emaciated, others had skin conditions or fleas and in general they were kept in crates and not walked,” said Inspector Johnson.

“The people supposed to be looking after the dogs appeared to be completely ignorant in the needs of caring for animals.”

Two of the dogs were immediately signed over to the RSPCA and have since been rehabilitated and re-homed by the Leicester branch while following the outcome of the court case the three other dogs, Crystal, Skye and Diamond, are now in the animal welfare charity’s care.

Sentencing:  Janine and Nigel Fletcher were fined £240 each and Clay was fined £290. Three-year ban on keeping all animals (expired October 2021).
