Morton admitted causing unnecessary suffering to the dog, called Leo, by throwing him at a fridge.

The RSPCA investigated the circumstances surrounding Leo’s death. It is believed that Morton picked up and threw the dog in a rage after he hadn’t responded to being called.

An expert vet report into Leo’s death concluded that he died from severe head trauma. The injuries were consistent with him being thrown at and hitting the fridge.

The report stated that it is likely that Leo was “rendered instantaneously insensitive to pain upon colliding with the fridge and did not experience suffering via the mechanism of pain”.

However the report stated it is likely that Leo “experienced fear and distress momentarily” as he was thrown.

In mitigation Morton said he did not mean to do it.

Sentencing: 16-week prison sentence; costs of £1,304. Banned from keeping all animals for ten years (expires June 2031).

Southend-on-Sea, Essex: Connor Foster

CONVICTED (2021) | Connor Foster, born c. 2001, of Stanier Close, Southend-on-Sea SS1 2NF – stole a cat and drowned her in the sink for kicks

“Troubled and lonely” teenager Connor Foster found the cat in nearby Ambleside Drive on March 18, 2021, and took her home before killing her. He then put the cat’s body in a bag and hung it over a fence.

After killing the animal, Foster filmed himself pretending to do CPR on the lifeless body.

Prosecuting, Ashley Petchey, summarised a victim impact statement from the owners of the cat.

He said: “The owner and her stepsons are devastated. The cat was owned by her partner who died of cancer and the family was just healing.

“It was the last physical contact with the father and they say to Foster the cat was nothing more than a toy but he was priceless to them.

“When the cat was dead he filmed himself playing with it and doing sarcastic gestures doing CPR saying he had done a good job.”

Mitigating, Christopher Holt, told the court Foster was lonely and a troubled teenager.

He said: “He’s a very troubled young man who committed a very serious matter which leaves a bad taste in everyone’s mouth.”

Sentencing Foster, Elizabeth Hunter, chairman of the magistrates’ bench said: “This is a very nasty offence deliberately causing suffering to this cat.

“We’ve heard the distress caused to this family.

“Clearly you have a lot of problems.”

Sentencing: 12 weeks in prison; £228 in costs and compensation. Unspecified ban on keeping animals.

Southend-on-Sea, Essex: Chanel Knight

CONVICTED (2018) | Chanel Chelsea Knight aka Chey Davey, born 21 November 1996, of Wesley Court, Southchurch Avenue, Southend-on-Sea SS1 2FJ – failed to seek veterinary treatment for her pet cat’s broken leg.

Knight was found guilty of breaching the Animal Welfare Act 2006.

The court heard Knight failed to seek appropriate veterinary care for her black cat Ruby who had suffered a broken leg. The cause of the injury was not explained.

Southend magistrates heard how Knight, who did not attend the hearing, had left Ruby to suffer in pain for seven days with the injury.

Between July 7 and July 15, 2017, Knight failed to “take reasonable steps” to seek treatment of any kind for the cat’s injury which the court heard led to “unnecessary suffering”.

Eventually, vets were forced to amputate the leg due to lack of treatment.

The prosecution was brought by the RSPCA who believed Knight had not fulfilled her legal duty of care to her pet.

Sentencing:
120 hours of unpaid work; four-month tagging ordered. Total of £335 costs and charges. Disqualified from owning any animal for the rest of her life (no right of appeal for ten years).

Westcliff-on-Sea, Essex: Michael Royale

CONVICTED (2017) | Michael D Royale, born c. 1970, of Mornington House, Station Road, Westcliff-on-Sea SS0 8HF – inflicted blunt force trauma on a Staffordshire bull terrier dog

Royale was spared jail after he admitted causing unnecessary suffering to the unnamed dog.

He inflicted blunt force trauma to the Staffy in Westcliff on July 6, 2016. The condition or fate of the dog was not reported.

Sentencing: 12-week prison sentence suspended for 19 months. Total of £415 costs and charges. Banned for life from keeping animals as pets

Southend-on-Sea, Essex: Antione Johnson

CONVICTED (2015) | Antione Johnson, born 09/07/1989, of Malvern, Coleman Street, Southend-on-Sea SS2 5AD – beat a dog with an iron bar and left her to die.

Caretakers found Staffordshire bull terrier Gnasher dumped and dying on the stairwell of a block of flats, one floor down from Johnson’s flat. The RSPCA were called and attempted to give her water and comfort, but Gnasher died just minutes later.

A post mortem later revealed that the cause of death was blunt force trauma which ruptured the dog’s spleen.

In an interview, Johnson admitted he had smacked Gnasher on her rear end and then let her out of his flat.

RSPCA inspector Matt Gough said: “It must have been with quite some considerable force that this dog was attacked for the impact to rupture her spleen in this way – she basically bled to death.

“A vet expert said her spleen was otherwise healthy and the fatal blow must have been very strong and very painful.

“Poor Gnasher was alive when the caretakers discovered her, but incredibly weak. She was making attempts to stand but repeatedly collapsed to the floor.

“They offered her water but she died just minutes after being discovered. It was just too late.”

On 4 November 2015 Johnson pleaded guilty to offences under the Animal Welfare Act relating to the brindle and white dog and was banned from keeping animals for life.

Sentence: 12-week prison sentence, suspended for 12 months; 200 hours’ unpaid work; £575 costs; 10 day Rehabilitation Activity Requirement; disqualified from keeping animals for life.
