CONVICTED (2023) | Nicholas Kengere, born c. 2004, of Capstone Road, Bromley – left his dog tied up without food for over a week.

Kengere left his black Labrador crossbreed named Blade tethered to a coat hook in his hallway while he was in hospital.

Neighbours on Capstone Road reported that the dog had been abandoned prompting RSPCA officers to attend the property on January 24, 2023.

One of Kengere’s friends let the officers inside where they found a dog that was very thin, with bones visible, standing in his own faeces.

“The dog had been kept tethered in the stairwell with no bedding, no clean resting area and no access to toileting facilities,” prosecutor Andrew Wiles said.

A vet who assessed Blade rated his body condition as two on a scale of one to nine. They said the dog was 50 per cent underweight and had no palpable body fat.

The vet’s opinion was that Blade had likely been undernourished for two to three weeks or longer, Mr Wiles said.

Blade also had red lumps in his eyes, known as cherry eye, which required surgical intervention.

RSPCA officers placed seals on Kengere’s door to see when he returned home but these were unbroke on January 26.

Officers made contact with Kengere on February 8 and he was interviewed.

“He said he had been in hospital for a week before the RSPCA attended and that he tethered the dog to stop it from going into the bins in the kitchen. He admitted the dog was probably suffering and that it was his fault,” Mr Wiles said.

Kengere had been an unplanned stay in hospital as he was suffering with a chronic B12 deficiency but acknowledged he should have done more for the dog.

Sentencing | 12-week prison sentence suspended for a year and a half. Banned from keeping pets for a decade but can appeal from 2030 (expires August 2033).

CONVICTED (2023) | Chelsea Jade Ellis, born 15 March 1996, of Burrfield Drive, Orpington – repeatedly left her dogs alone for up to four days.

Mother-of-four Ellis was prosecuted in relation to chihuahua Rolo and crossbreed Sleigh.

The dogs were left on their own for days at a time with empty food and water bowls.

When the dogs were eventually confiscated, Rolo’s body condition was rated at one out of nine – the lowest score possible – as he was extremely thin, while Sleigh was assessed as two out of nine.

RSPCA prosecutor Andrew Wiles said: “Following information received by the RSPCA of dogs being left alone at Ms Ellis’ property an attendance was made on October 15. Dogs were heard there but nobody was present.

“Ms Ellis was spoken to on the phone. She said she did go out for long periods but she would be back that evening.”

The RSPCA officer put a seal on the door to see when it was opened. When they returned the following day the seal was still intact, indicating that Ellis had not been home.

“The RSPCA officer attending was able to look inside the property through the window and there were two dogs but there was no food or water for them. Four dog bowls were on the floor but they were all empty,” Mr Wiles said.

“The officer put dog biscuits through an open window. The dogs rushed to the biscuit and ate them quite ferociously.”

On October 30 officers attended again. They found nobody at home and no food was seen through the window.

The officer spoke to Ellis on the phone to tell her that arrangements needed to made for the dogs to be cared for.

The seals were unbroken when they were checked again on November 1 and November 2, and there was still no food for the dogs.

Police attended on November 2 and the dogs were seized and taken into RSPCA care.

A vet noted that both dogs were extremely thin and estimated that they had been suffering due to malnutrition, weight loss and general poor condition for two to three months.

When interviewed about the dogs Ellis repeatedly changed her story.
In her first interview she admitted that she was responsible for the two dogs and that nobody was looking after the dogs between October 30 and November 2. She said that four days was the longest they had been left alone.

She later phoned the RSPCA inspector and said she lied in the interview, and that Sleigh actually belonged to a friend called Danielle. She said she had been looking after Sleigh for a while and her mum had been feeding the dogs while she was away.

Ellis was subsequently invited to another interview, during which she confessed that she had lied again. She said Danielle was not real and that she had just been in “a real state” as her children had been taken into care.

Ellis’s solicitor told the court she was suffering enormous stress at the time of the offences.

Since coming into RSPCA care Rolo’s weight has increased by 60%, while Sleigh’s weight has increased by 28%.

Sentencing | 120 hours of unpaid work; £1,000 in costs to the RSPCA. Deprivation order on Rolo and Sleigh since Ellis had refused to relinquish them voluntarily. Banned from keeping pets for five years, but can apply to have this set aside in three years (expires June 2028).

Officers from Cambridgeshire Constabulary’s Rural Crime Action Team (RCAT) caught the four men, who were also with a 12-year-old boy, driving through a field in Abbots Ripton, Cambridgeshire, looking for hares.

On seeing the police, the group drove off through wildlife conservation areas and, after a short pursuit through the village, drove onto another field before stopping.

All four were interviewed and previous poaching convictions were revealed.

The vehicle was seized and the men were ordered to leave the county.

They all pleaded guilty to daytime trespass in pursuit of game (poaching) at Cambridge Magistrates’ Court on September 22, 2021, and were each handed a Criminal Behaviour Order (CBO) lasting three years.

The order prevents them from (while in Cambridgeshire, Norfolk, Suffolk and Essex):

  • being on private agricultural or farm land, or any yards or working areas associated with that land, in or on any vehicle, or on foot whilst in possession of one or more sight hound or x-sight hound breed, unless the land owner’s written permission has been obtained beforehand

All four were also ordered to pay £178 in compensation to the owner of the fields and wildlife conservation areas.

In addition, Thomas Connors was fined £150, while Anthony Connors, Rooney and Bell were fined £200.

Callous James, who is also known as ‘Shadow’, was found guilty of hanging the three-year-old dog, known as Boyzee, while punching him in the face as the terrified dog “gasped for air”. He had denied the charge, claiming Boyzee died accidentally during a “tug of war”.

Giving evidence, James’ neighbour Harlon Horsford told the court how he had heard shouting at about 8pm on September 6, 2015. He opened the front door and saw James with Boyzee.

He said: “He had the dog with a rope wrapped round its throat, repeatedly hitting the dog in the face and throat with his left hand.”

He stated the rope was wrapped around a metal railing, one end strangling the dog and the other end being pulled by James’ right hand, as he hit him with his left.

Mr Horsford continued: “The dog was secured to the railings.

“I confronted him, I said let go and he wouldn’t. He said he doesn’t care about the police or RSPCA, he’s named Shadow and no one can tell him nothing, It’s his dog.

“So I punched him in the face, he fell back on the floor and Boyzee dropped to the floor.

“I took the rope off of Boyzee’s neck. He couldn’t breathe properly, he was gasping for air. I pushed his tongue to the left, he had saliva all in his mouth, I was trying to breathe air into him.

“His back legs were twitching, he made his last breath and passed away. He was a lovely dog, very loving, very gentle.”

While giving evidence, Mr Horsford broke down in tears and had to compose himself. He said that throughout the attack Boyzee’s legs were not able to reach the floor, and he scrabbled to get a footing.

James was arrested later that day. He initially stated he was taking the dog outside to do his business, and dragged him through a crowd of people, inadvertently strangling it. But while giving evidence he claimed it was actually a tug of war between him and Mr Horsford which accidentally killed the dog.

James, who admitted he had been drinking that day, said: “He grabbed the lead, I said let go of my dog. He said he wanted the dog.

“I just kept pulling my dog not looking back. When I turned back around I saw the dog on the floor.

“I could never harm my dog, it’s what keeps me alive. I’ve got a 15-year-old daughter I can’t see, I bought the dog to keep me company.”

When passing the verdict, magistrates described his testimony as “not credible”.

Sentencing: 18 weeks in jail. Indefinite ban on keeping animals.
