New Romney, Kent: Kelly Jones

CONVICTED (2023) | Kelly Jones, born c. 1967, of Station Road, New Romney TN28 – strangled a 15-year-old dog to death.

Jones, an ex-soldier who served in the Falklands War, punched, kicked and stamped on 66-year-old drug addict Martin Marsh, before turning his attention to his elderly pet dog, known as Jack-Jack.

The two men had only known each other for a week when Jones turned up shouting outside Mr Marsh’s home at Pavilion Court in Marine Terrace, Folkestone late at night on April 14, 2023.

Both were said to be heavy users of class A drugs and “acrimonious, aggressive and abusive” with each other at the time of the incident.

Mr Marsh could not afford electricity at his bedsit and, once Jones was inside, a row broke out when he complained about the state of the property, said prosecutor Caroline Knight.

“The defendant punched Mr Marsh in the face and that blow sent him to the floor,” she told the court.

“The attack continued with Mr Marsh being kicked and punched and stamped on his head, he thinks, for around 10 to 15 minutes.

“The defendant also put his fingers and thumbs into Mr Marsh’s eyes, causing him to suffer very serious pain and to think he may end up blind.

“He describes being in fear for his life and screaming for help.”

Jones eventually fell asleep on a sofa and, on waking the next morning, apologised.

But the court heard the ex-serviceman then turned his attention to Marsh’s elderly dog, who was said to be very thin and possibly malnourished.

Ms Knight continued: “The defendant told Mr Marsh he should have the dog put down. When Mr Marsh refused, the defendant took it into the bathroom, put a cord around its neck and strangled him to death.”

Marsh fled to a neighbour and police were called.

Officers found Jones hiding in the kitchen where he said: “I’ll admit to what I’ve done and I would do it again”.

In interview he claimed to have he acted in self-defence and “assisted” Marsh in killing Jack-Jack, said Ms Knight.

Jones, who has 33 previous convictions for 63 offences, later admitted assault causing actual bodily harm and causing unnecessary suffering to an animal.

Sarah Thorne, defending, urged the court to show Jones “some mercy”, saying he accepted he had behaved “appallingly”.

She said that as well as battling a long-term addiction to drugs and alcohol, he also suffered from mental health problems, including a diagnosis of bipolar, and more recently been told he has bowel cancer.

Passing sentence, Recorder Michael Turner condemned Jones for his “prolonged and persistent” attack on “hopeless heroin addict” Marsh.

Of the killing of Jack-Jack, Recorder Turner continued: “I am prepared to accept this was a gross lapse of judgement on your part, fuelled by your drug addiction and your addled brain at the time.

“But your use of a ligature is an aggravating feature as it is effectively the use of a weapon. You used that to strangle this poor, malnourished, elderly animal to death.

“You killed it. You didn’t just harm it… you inflicted upon it the ultimate penalty for no good reason.”

At the time of the incident, the offence of animal cruelty carried a maximum jail term of six months, but new legislation introduced in July has increased that penalty to five years.

Recorder Turner told Jones he was therefore “fortunate” he had committed the crime three months before the law change.

The judge added he hoped Jones continued with the progress made while in prison on remand, and that he would receive “good news” regarding his cancer.

Sentencing | jailed for 27 months for the assault on Mr Marsh, and handed a concurrent prison term of 19 weeks for killing the pet.
He was also given a three-year restraining order.

Notting Hill, London: Joseph Ghessen

CONVICTED (2022) | pet shop owner Joseph Paul Ghessen, born December 1980, of 144-146 Westbourne Grove, London W11 2RR – kept a horribly abused marmoset monkey in a tiny cage.

Joseph Paul Gheesen kept the marmoset in a tiny cage lacking in enrichment.

Joseph Ghessen, who runs Cally Pets in Caledonian Road, Islington, has been banned from owning primates indefinitely after his depressed monkey escaped from a tiny cage in a London flat and showed signs of horrible abuse.

Ghessen was investigated by the RSPCA after the female marmoset named Nicky escaped his London flat in Notting Hill.

In June 2019 an animal welfare inspector found little Nicky in a sorry state showing upsetting signs of abuse including hair loss, bruising and rickets.

The depressed marmoset fell from Ghessen’s flat where she had been caged alone since her companion horrifically died in a fire. Previous reports said that Ghessen had owned five marmosets at one time and it’s not clear what happened to the others.

RSPCA Inspector Callum Isitt, who found Nicky, said: “I soon identified her owner as he had reported that his pet marmoset was missing.

“When I visited his home, I could see that Nicky was living in unacceptable conditions. Primates are intelligent, sentient and highly social animals with complex needs. But Nicky had been kept in a cage that was too small.”

The rickets was caused by the lack of ultra violet lighting, which is important for the bone health of monkeys.

Mr Isitt said Ghessen provided Nicky with very little environmental enrichment or mental stimulation.

In March 2021 Ghessen was found guilty of not meeting the needs of his pet marmoset and was disqualified from keeping a pet for 10 years, as well as being handed a £250 fine and was made to pay £1,200 costs.

However, on February 11, 2022 Ghessen appeared in court again to appeal against this sentence. But rather than reduce the terms of his sentence, a judge at Southwark Crown Court decided to increase his ban on keeping primates from 10 years to an indefinite period of time, and ordered that Ghessen pay a further £300 towards prosecution costs.

Nicky has since been re-homed to a specialist facility where she is living a happier life.

Mr Issit said: “It was clear Nicky’s needs just weren’t being met. She will now live out the rest of her natural life at a specialist primate boarding facility in a suitable environment where she will be able to socialise with other members of her species.”

Sentencing: ordered to pay £1,450 in fines and costs. Originally banned from keeping animals for 10 years but the ban on keeping primates was extended to indefinite after Ghessen appealed.

Holland Park, London: Robert McElhill

CONVICTED (2015) | Robert McElhill, born 06/06/1987, former co-owner of the Notting Hill Guest House, Holland Park Avenue, London W11 3QZ  and more recently (2018) of Millcroft Road, Cumbernauld, Glasgow* –  kept 33 dogs and puppies starving, neglected and living in squalor

McElhill, who operated a rescue called Canine99 , kept dozens of starving dogs in filthy, squalid conditions at the property.

Officers found 33 dogs of all shapes and sizes including a Great Dane ‘mix’, a Chihuahua, a Rottweiler and a Saluki, also known as an Arabian Greyhound.

Most of the dogs were covered in scars and were found shut inside rooms in the private living quarters.

The floors were covered in faeces and urine; the windows were boarded up or blacked out.

There was no bedding for the animals who were locked in rooms in groups of two to six.

There was even an 18 inch tall chihuahua that was found locked in a cage just 19 inches high. Two other dogs were barricaded in the stairs and there was no clean water.

In the basement police found a sandy coloured lurcher and seven puppies.

The lurcher was extremely underweight; her skin was stretched tightly over her bones.

The puppies were in poor physical condition with faeces matted in their coats and showed poor physical care.

Canine99 purportedly took in dogs that were in danger of being put to sleep or were hard to handle. In reality, it was said that McElhill was putting dogs to sleep himself and doing autopsies on dogs that had died while in his care.

Several dog rescues unwittingly sent dogs to McElhill although he disclosed the location of his kennels to very few.

McElhill had a network of female ‘fans’ – women who called themselves ‘Rob’s Angels’ on Facebook. The group, which had its own logo, continued to defend McElhill even after shocking evidence of his animal abuse came to light. Two of the women – Jo Weeks and Jo Phillips – allegedly made jokes about McElhill raping and torturing dogs. Others have also alleged that McElhill sexually abused dogs.

Jo Philips, who’s now calling herself Romani Scott, was romantically involved with McElhill, but it’s unknown if they’re still together.

McElhill was found guilty of six counts of animal neglect and four counts of ‘failing to prevent the causing of unnecessary suffering’ to animals.

Sentencing:
200 hours community service; £2000 costs. Banned from owning dogs for 10 years (expires January 2025).
