New Ager Smith, who also works as a lorry driver, injured the black araucana cross cockerel named Eddy and left him with brain damage because his loud crowing woke her up at 3am.

The court heard how Smith was woken up in the early hours of September 2022. Smith believed that her neighbour had previously agreed to kill the bird, but had killed the wrong one – so she decided to take matters into her own hands

Another neighbour then saw Smith trying to strangle Eddy and hit him with a boat fender – which left him unconscious. The neighbour rushed Eddy to an emergency vet, who found blood around the bird’s nostrils.
He also said the cockerel was displaying clinical signs that were consistent with having sustained a brain injury, either via head trauma or via oxygen deprivation.

The vet also said it was not possible to determine if permanent brain damage had occurred or whether Eddy had been left with a disability.

He said that Eddy would survive the injuries, but would need close monitoring once he was back at his home in Preston.

Smith was found guilty of causing unnecessary suffering to Eddy on June 15, 2023.

RSPCA Inspector Taylor said: “There is never an excuse for deliberately harming and causing unnecessary suffering to an animal like this. Smith said that she worked nights and had been disturbed by noise made by Eddy’s owners – especially from their cockerel over the past couple of months. But other solutions could and should have been explored, rather than resorting to treating an animal like this.”

Sentencing | ordered to pay costs of £1,296 and a victim surcharge of £114. Banned from keeping birds for four years (expires June 2027)

Chorley, Lancashire: Ryan Oldfield

Oldfield, who’s originally from Morecambe and has something of a shady past, admitted a charge of causing unnecessary suffering to the animal during an incident in Chorley on August 12, 2018.

A regular participant in ‘strong man’ competitions, Oldfield also pleaded guilty to assaulting a woman by beating her on the same day. He admitted his role in both offences during a hearing before Preston Magistrates’ Court.

The magistrates’ bench also imposed a rehabilitation activity requirement, and Oldfield must take part in a Building Better Relationships probation programme.

Sentencing | Total costs and charges of £170. Rehabilitation.

Chorley, Lancashire: Aiden Daly

Career criminal Daly was given a 16 month jail term suspended for two years in January 2018 after admitting an affray in May 2017 in which he waved a machete at Jordan Reynolds.

But just over a month later he committed further offences against Mr Reynolds and his pet dog when he saw them outside a shop in Leyland.

Daly, who by the age of 21 had already amassed a long list of criminal convictions, admitted causing unnecessary suffering to the dog, a public order offence, and breaching a suspended jail term.

“At the time in February these offences were committed he found himself outside McColl’s where he saw Reynolds. He saw Mr Reynolds tie up his dog and go into the shop. He said before the complainant went in there he thought he had been staring at him and that made him upset.

Paul Cummings, prosecuting, said: “The defendant knows a man called Jordan Reynolds involved in the case from last May. As a result of that case it was said he was still very upset with Mr Reynolds

“He knew that dog could be vicious because he had been bitten by it previously but nevertheless he decided to kick it.

” When Mr Reynolds came out he said: ‘Kick the dog again and see what happens.’

” A fight then took place outside the shop. A scuffle took place on the pavement. After that came to an end he went over again and kicked the dog and then he walked away.”

Recorder David Swinnerton was told Daly, who is subject to supervision, smirked when probation officers had tried to assist him and had said: “Probation makes me laugh.”

Sentencing Daly he said: “You are 21 and are already amassing a lengthy criminal record. Since 2009 you’ve have 25 convictions for 44 offences.

” Not only were you on breach of the order, you had offended against the same person.”

Sentencing: 19 months in jail.

Chorley, Lancashire: Arlene Ashcroft

CONVICTED (2017) | animal hoarder Arlene Barbara Ashcroft, born 07/08/1952, most recently of Harewood, Chorley PR7 1XL – banned for keeping 11 dogs in appalling conditions; repeatedly flouted her ban

In June 2008 Arlene Ashcroft was banned from keeping animals for life after neglecting 11 dogs in her care. The lifetime ban was later reduced on appeal to just five years.

The RSPCA originally took action against Ashcroft after finding the dogs infested with fleas and living in squalor at her then property in Pennine Avenue, Chorley.

RSPCA inspector Lisa Lupson said: “The conditions these animals were living in were absolutely shocking. There was faeces and urine all over the house. We had to put wellingtons on to go in, and of course the smell was horrendous.

“These were all very young animals, being forced to live in incredibly awful conditions, and suffering as a result. It’s taken a very long time to rid them of some of the infections they picked up whilst in Mrs Ashcroft’s care.”

Ashcroft had been due to stand trial but pleaded guilty at the eleventh hour to failing to meet the needs of nine of her dogs and causing unnecessary suffering to two of them.

At the time Ashcroft’s neighbours spoke of their relief that the dogs had been found a new home because they said their constant barking and noise made their lives hell.

Her next door neighbour said: “I never saw the dogs because they were always in the house, I’m glad something has been done to end this.”

Another neighbour said: “She has had dogs taken off her before but it is about time she was banned for life. Seven dogs in a semi-detached house with a small garden is not right and they are stuck in that house permanently.”

The cruelty first came to light in July 2007 when a one-year-old shih-tsu dog was found tied up inside Ashcroft’s garage – the dog was underweight and police were called to seize him.

A German shepherd puppy, a spaniel puppy, and a mastiff puppy, all aged 12 weeks, as well as a mastiff aged six months and a shih-tsu aged nine months were rescued the following week.

In September 2007 another three dogs were seized: a German shepherd puppy, a Border terrier-type aged two years and a Jack Russell puppy.

In January 2017 Ashcroft was back before the courts after being found found in possession of a rabbit. Six months later in June she was given a community order with a curfew for breaching her banning order by keeping a lurcher dog.

Update November 2020

Arlene Ashcroft was summoned back to court to face allegations that she had breached her ban yet again by keeping a puppy and a kitten at her flat in May and June 2020. Ashcroft was a ‘no show’ however.

Her co-defendant, ex-partner Robert Ashcroft, 80, of Bolton Street, Chorley, faced two breaches of his ban, imposed in 2009, by participating in keeping a puppy and kitten at her address.

He also failed to attend and warrants were issued for their arrests.

Chorley, Lancashire: Christopher Dennett

A horrified neighbour caught the attack on video and rang police and sent it to the RSPCA, sparking an investigation.

Unremorseful Dennett, an HGV driver who transports livestock, laughed off the investigation telling RSPCA workers he was trying to train the dog for close-quarters protection for his girlfriend.

The court watched the 47-second video in which the frightened dog is heard barking and seen running away as Dennett swings at her with the wood.

RSPCA Inspector Helen Smith said the one-year-old puppy has been left terrified of men as a result of her treatment. She said: “Mr Dennett showed no remorse when interviewed and didn’t seem to understand what he had done wrong.

“As you can see from the video, Narla is terrified, and has been caused unnecessary suffering, fear and distress.

“She is now terrified of men and although we could find no significant physical harm, emotionally she is not in a good way”.

The court heard Dennett was trying to emulate a training video he had seen on Youtube. But Insp Smith said: “He said he was training the dog to protect his partner for when he was away but this is no way to train a dog.

“You can hear the dog growling and then yelping, although it is not clear if Narla was struck in the video.

“Mr Dennett has now signed Narla into the care of the RSPCA and we will look after her and then try to re-home her.”

Dennett admitted one offence under the Animal Welfare Act of causing unnecessary suffering by using threatening or abusive behaviour towards the dog.

Sentence: total of £726 costs and charges. Disqualified from keeping dogs for 12 months (expired March 2018).
