Starved and neglected dog Buster

Heroin-addicted Mark Neil, previously of St Andrews Street, Perth, admitted causing his one-year-old male boxer type dog, Buster, unnecessary suffering by failing to provide an adequate diet between an unknown date and 9 March 2011.

The Scottish SPCA were alerted by a local dog warden following a complaint from a member of the public.

Buster was severely emaciated with his spine, ribs and hips clearly visible. He weighed just 17kg when a healthy dog of his age and breed should be 24.5kg.

Buster recovered and was rehomed.

Two years prior to his conviction for animal cruelty Neil admitted wilfully exposing a 20-month-old girl to unnecessary suffering after heroin and needles were found in her bedroom. The court heard that Neil was running a “shooting gallery” for addicts at the flat.

Police found needles and heroin in a drawer in the child’s bedroom, among her clothes. There were needles and bloodstained surgical gloves “within easy reach” of the tot.

However Neil was admonished after social workers told a sheriff that jailing or even fining him would “punish” his family.

Sentence: £500 fine; three-year ban on keeping dogs (expired 2014).

Frome, Somerset: Scott Westlake

CONVICTED (2011) | Scott Westlake, born 7 December 1987, of 9 Austin Close, Frome BA11 5AY – punched a dog in the face causing an eye injury

Westlake attacked the Staffy, known as Dogger, after becoming angry at having to clean up mess the dog had made. The RSPCA were alerted by concerned neighbours who reported sounds of a dog being beaten, and attended to find Dogger with a cut to his eye. The inspector told Westlake to take the dog to a vet but he only did so two days later.

The vet who examined Dogger concluded that his eye injury was consistent with being struck by a human fist and the person responsible would have caused unnecessary suffering to it as a result.

Dogger belonged to Westlake’s friend, Jason Dando, who had apparently “dumped” him on Westlake on many occasions. Dando has been cautioned by the police.

Sentencing: two-year conditional discharge, £500 towards costs; three-year ban on keeping animals (expired 2014).

Croydon, South London: Leigh Lynch

CONVICTED (2011) | Leigh Lynch, born c. 1972, of Gorse Road, Shirley, Croydon CR0 – starved a German Shepherd and mastiff for 21 days

Mother-of-two Leigh Lynch pleaded guilty to starving her German Shepherd dog Lady and female mastiff Stella for 21 days.

She denied three extra counts of not ensuring animal welfare by not taking the two pets to the vets for overgrown claws, fleas and a skin condition.

Speaking after the case an RSPCA inspector said: “These dogs were very clearly underweight and that would have been obvious to anyone who saw them. The owner should have sought help to care for her dogs and not simply left them neglected and hungry. There is no excuse”.

Sentence: 250 hours’ community work; £500 costs, four-year ban on keeping animals (expired 2015).

Alexandria, West Dunbartonshire: Robbie Lees, David Cassels and Samuel Burgoyne

In late August 2011 the trio admitted deliberately hunting foxes with dogs in the Clyde Walkway in the East End of Glasgow.

A wildlife crime officer on the lookout for the badger baiters who plague the area saw one of the men, later identified as Samuel Burgoyne, holding a fox by the scruff of the neck. A small black dog had latched onto the fox. Burgoyne then separated the two and threw the fox into a bush. The dog went after the fox and snarling was heard.

Cassels was holding a net, which he tried to conceal when apprehended.

Three other dogs were seen. Two were wearing radio collars. One had blood on his nose.

Two metal spades, netting and three radio locaters were seized, as well as the four dogs.

Two of the dogs were found with fox hair and fox DNA in their teeth.

Sentence was deferred for good behaviour. However, the judge ordered that that the dogs be re-homed and disqualified all three from owning dogs for two years (expired 2013).

Tyldesley, Greater Manchester: William Edge

CONVICTED (2011) | William Sumner Christian Edge, born 23/01/1971, of 33 Beckford Court, Tyldesley M29 8GF – cut a puppy’s throat during a row with his partner.

During a heated argument with his partner, Edge grabbed the young dog and held a knife to his throat.

Edge, a former security guard at the Trafford Centre, claimed that the dog wriggled, causing the blade to pierce his throat. But prosecutors argued that the wound showed that “considerable force” had been used and was consistent with a “stabbing action” rather than an accident.

The dog required emergency surgery to save his life.

Edge admitted assaulting the woman and causing unnecessary suffering to an animal.

Sentence: 16-week suspended sentence; £350 in costs. Two-year ban on keeping animals.

Bournemouth, Dorset: Harry Clay

CONVICTED (2009) | Harry Clay, born 22 September 1989, of Darracott Road, Bournemouth BH5 – tormented a hamster and eventually killed her by throwing her against a wall.

Ever heard the saying “pick on someone your own size”? Well it’s a pity that Harry Clay from Bournemouth and one-time student of fishery management at Sparsholt College in Hampshire didn’t take heed. The tiny creature he tortured to death was a dwarf hamster named Smudge.

Clay began by tormenting Smudge, who belonged to another student, throwing her up in the air several times and catching her, before dropping her to the ground from a height of 15 feet. Another student picked up the stricken hamster, but Clay grabbed her back and threw her against a wall, finally killing her.

Finally he picked up the little corpse and dropped it into a dustbin.

After a three-day trial, Clay was found guilty of causing unnecessary suffering to a hamster under section 4 of the Animal Welfare Act 2007.

The principal of Sparsholt College said that they viewed “any form of animal cruelty with the utmost seriousness”. They did not, however, expel Clay but instead said they would try to ensure that “he re-learns the vital lessons of care and respect for all animals”.

Let’s hope they got through to him.

Sentencing | 12-month supervision order; 150 hours of community work. Banned from keeping hamsters for a year.

Connah’s Quay, Flintshire: Shane Burt

CONVICTED (2009) | Shane Paul Burt, born c. 1989, of 10 Deans Avenue, Connah’s Quay, Deeside CH5 4QF – filmed his dog trying to kill a badger.

Burt was found guilty of wilfully attempting to kill a badger after being prosecuted under the Badgers Act 1992.

The court heard the horrible attack happened in Dock Road, Connah’s Quay, sometime between September 30 and November 26, 2008.

Acting on information there was mobile phone footage that would incriminate Burt, police executed a search warrant on his home.

They seized the phone, which was found to have about 30-seconds of sickening footage showing the dog attacking the badger.

The footage ends with the badger leaving the scene.

Burt told police his dog had been injured in the attack and that he had washed the injuries with warm, salted water.

He said that the dog – a lurcher/Staffy named Hooch – had since been put down.

After the case, North Wales Police Wildlife and Environmental Officer Sgt Rob Taylor said: “I am very pleased with the result. It was a callous and sick act.”

Sentencing | 150 hours of community service; £250 costs. Three-year ban on keeping animals (expired 2012).

Morecambe, Lancashire: Christopher Collyer

Father of multiple children Collyer was found guilty  of causing unnecessary suffering to Charlie by hanging him from a pipe inside a stone bunker in woods in Keighley, West Yorkshire, leaving him to strangle to death.

Nigel Monaghan, prosecuting for the RSPCA, told the court the vet who examined Charlie after his death confirmed his death would not have been ‘instantaneous’ and said he was also suffering from a chronic skin condition.

The court heard that Collyer had been given the dog by his parents, Mandy and Ian Collyer, who were moving house and could not take Charlie with them.

The dog was found hanging in a concrete bunker in Hainsworth Woods, Keighley, by a member of the public on June 10 2008.

A prosecution witness had previously placed Collyer there on June 7.

Mr Monaghan said: “This was appalling cruelty. It was a deliberate and what appears to have been a premeditated act by the defendant.

“What followed was what can only be described as a tissue of lies.

“In court he maintained his story that he had taken the dog for a walk, met a woman and given it to her.

“It is difficult to think of a worse example of animal cruelty given the degree of suffering he must have been subjected to.”

Speaking about the case, the RSPCA inspector who found Charlie said it was the worst case he had seen in 15 years.

Inspector Dave Holgate said: ‘When I came across the dog hanging in the bunker, it was a horrific scene.

‘I’ve never seen anything like that in 15 years and I hope I never see anything like that again.

‘That poor dog must have suffered for a long time before it eventually died because its feet were just touching the ground.”

Richmond Hill, Leeds: Sebrina Carty

CONVICTED (2009) | Sebrina Carty, aka Sebrina Buttimer, born 03/12/1987, of Milner Gardens, Richmond Hill, Leeds LS9 8NW – threw a puppy off a three-storey high balcony during an argument with her boyfriend.

Seven-week-old Jack Russell Rocky was thrown from the balcony in his dog carrier after drunken Carty became enraged during the argument. Despite Carty’s wicked intentions, the tiny dog survived the plunge.

The court heard how police were called to domestic disturbance in Carty’s previous address in Appleton Square, Leeds, in October 2008.

They found the smashed pet carrier and Rocky collapsed nearby.

He was taken to a local vet who found he had soft tissue damage and bruises but no broken bones.

Carty pleaded guilty to causing unnecessary suffering to the puppy and was given a community sentence and a measly two-year ban on keeping animals.

RSPCA inspector Dave Holgate said: ‘This was a sickening case of deliberate and sadistic cruelty.

‘The puppy was only a few weeks old and must have been terrified. It’s a miracle that he wasn’t seriously injured or killed.

‘The sentence passed reflects the serious nature of this incident and serves to show that this kind of vile cruelty cannot and will not be tolerated.’

Rocky made a full recovery and now lives in a new home

Sentencing: 100 hours of unpaid work; £250 costs; two year ban (expired 2011).

Yeovil, Somerset: Simon Galliott

CONVICTED (2009) | Simon Galliott, born 09/08/1975, of Westfield Road, Yeovil BA21 3DA – shot a dog in the eye with an air pistol.

On 11 October 2008 Galliott shot his then partner’s Staffordshire bull terrier Jake in the eye with an air pistol leaving him in excruciating pain.

Galliott alleged that Jake became over-excited and bit an 11-year-old child.

Galliott flew into a rage and went upstairs to fetch his air rifle, returning a few minutes later.

The court heard how he goaded Jake before shooting him in the eye, which later had to be removed.

Sentencing: Galliott was banned from keeping animals for two years and ordered to pay fines and costs of £2,200. Jake remains with Galliott’s ex partner.
