Elward and Thomas both pleaded guilty to an an offence under the Animal Welfare Act 2006.

When an RSPCA inspector visited the five ponies at Twyn, Garnant he found them to be in a neglected and in a poor state. They were thin and covered in lice and three of the ponies had scabs on their backs.

Sadly they had been neglected for some time and an independent vet found they had been clearly suffering.

RSPCA inspector Keith Hogben said: “These ponies had clearly been neglected for months on end and were suffering.

“There was some food being provided but clearly it was not enough. Their body condition was in a terrible state and they just did not have the energy to move to the little natural shelter that was available. It was so cold at this time of year so they suffered then even more.

“They should have known better and if people are struggling they need to ask for help instead of burying their heads in the sand.”

Following RSPCA care the ponies’ condition improved following an appropriate diet and veterinary treatment. All were made available for rehoming.

Sentencing: each ordered to pay a total of £850. Disqualified from keeping horses for 24 months (expired 2018).

Burry Port, Carmarthenshire: Shaun Hearne

Career crook Hearne pleaded guilty to two counts of causing unnecessary suffering to a protected animal.

The court heard RSPCA inspectors had visited the defendant on March 4, 2014, after reports of dogs in a poor condition being held in a white van.

“When they found the animals they noticed some were very thin and some were in a reasonable condition,” the prosecutor said.

He added that there was no water found for the dogs.

Inspectors were called out due to the weather and the “overpowering smell of excrement”.

“Hearne was told that it was unacceptable and he promised to keep them in a better location,” the prosecutor said.

However when they returned three days later they found the same four dogs in the van and the smell was even stronger. At this point the vet and police were contacted.

“Mr Hearne was cautioned and at that time he said ‘get out of my face or I will put you on the floor’,” he said.

Mr Tarrant said: “The floor was covered in excrement and it stung the inspector’s eyes and it made breathing difficult.”

The court heard that all four animals were seized.

Two dogs were found to be seriously underweight and had pressure sores due to a lack of adequate bedding.

Within a month, the two animals had seen their body weight increase by 30%, simply through nourishment.

Sentence: 12-month community order, 200 hours of unpaid work, total of £1,560 in costs and charges. Five-year ban on keeping animals (expired February 2020).

Hearne pleaded guilty to being involved in a conspiracy to supply cocaine. He was jailed for eight years and eight months.

Burry port, Carmarthenshire: Brett Simms

CONVICTED (2012) | Brett Paul Simms, born 09/01/1975, of 36F Gelli Road, Burry Port, Llanelli SA14 9AT – punched and stamped on a Cavalier King Charles spaniel, killing him

Simms punched and stamped on two-year-old spaniel Zac after, he said, the dog broke into his partner’s garden and killed a number of his chickens.

After killing Zac, Simms threw his body over the garden fence where a group of children were playing.

Sentencing Simms, magistrates described the incident as a serious crime which merited a custodial sentence.

Apart from the cruelty he had inflicted on the dog, they added he had also caused great distress to the children and others who had witnessed the dog being thrown over the fence.

After the hearing RSPCA inspector Neill Manley said: “This was a monstrous crime, one of the worst animal welfare offences I have ever come across and the defendant fully deserves this sentence.”

Simms previously served four months of imprisonment for assault in 2010.

Sentence: 18-week jail sentence,banned from owning or keeping any dog for five years (expired 2017).
